Analysis on the Cy-Pres Doctrine in the Public Benefit Trust

A Study on the Challenges of Human-Centric Cyber-Security and the Guarantee of Information Quality

Information security and quality management are often considered two different fields. However, organizations must be mindful of how software security may affect quality control. This paper examines and promotes methods through which secure software development processes can be integrated into the Systems Software Development Life-cycle (SDLC) to improve system quality. Cyber-security and quality assurance are both involved in reducing risk. Software security teams work to reduce security risks, whereas quality assurance teams work to decrease risks to quality. There is a need for clear standards, frameworks, processes, and procedures to be followed by organizations to ensure high-level quality while reducing security risks. This research uses a survey of industry professionals to help identify best practices for developing software with fewer defects from the early stages of the SDLC to improve both the quality and security of software. Results show that there is a need for better security awareness among all members of software development teams.

基于“玄府-络病-浊毒学说”治疗前葡萄膜炎的思路及经验

前葡萄膜炎是葡萄膜炎中最常见的类型,其病因病机十分复杂,西医治疗时使用糖皮质激素,副作用较大。本病极易反复,产生的并发症对视力影响很大。前葡萄膜炎属于中医学“瞳神紧小”“瞳神干缺”范畴,其病因病机复杂多样。五脏之玄府郁闭,其病理产物化生浊毒,浊毒害清,影响五脏功能,进而影响目之玄府。络脉受损,其病理产物化生浊毒,浊毒损络,影响目中的络脉,故本病的病因病机为玄府郁闭,络脉受损,浊毒内生上扰目窍。本文为前葡萄膜炎的治疗提供新思路及方法,进一步丰富浊毒致目病理论。

目的本文旨在深入探讨耳针止痛作用机制,结合中医理论与现代医学理论,为临床应用提供理论依据,并验证其广泛性和实用性。方法分析中医经络与脏腑理论、近现代神经学说、体液学说及全息理论等多个理论角度,收集并分析耳针治疗不同疼痛的临床案例。结果耳针止痛机制被多维度理论所支持,并结合临床案例共同揭示了耳针在缓解疼痛方面的复杂作用网络。结论本研究通过综合理论分析与临床实践验证,明确了耳针止痛的多元作用机制及其在临床应用中的广泛性和实用性。耳针疗法不仅为临床疼痛治疗提供了一种新的、有效的治疗手段,也为中医现代化和中西医结合研究提供了新的思路。未来,应进一步深入研究耳针疗法的具体作用机制,优化治疗方案,以更好地服务于广大疼痛患者。

输血感染民事侵权归责原则之适用问题研究

输血感染民事侵权归责原则的适用理论上存在争议。经实证分析中国裁判文书网上近15年共221份与输血感染民事侵权相关的生效判决,发现该类案件之归责原则的适用在司法审判中也存在分歧。鉴此,立足于血液的法律属性,就输血感染的民事侵权归责原则适用提出解决方案。

比较视域下孔子中庸观与亚里士多德中道观研究

在人类文明轴心时代,东西方思想流派异彩纷呈,思想巨擘纷然涌现,孔子(公元前551-前479)与亚里士多德(公元前384-前322)是其中涌现出的重要思想家,中庸和中道分别是他们思想体系中的基本范畴和重要理念。孔子中庸观和亚里士多德中道观有相似之处,体现了人类文明的共通性,但二者又处于不同的文化地理环境中,相似的内涵里又有着不同的认知差异。中庸和中道的相似之处表现在具体内涵、习得途径和达成效果等方面,不同之处则表现在哲学渊源、衡量标准和对待财富的态度等方面。通过比较二者思想在中庸观和中道观上的异同点,有助于我们厘清二者观念的差异和把握二者观念的共通之处,进一步深入理解人类历史上这一宝贵的思想遗产。

A Novel Data Schema Integration Framework for the Human-Centric Services in Smart City

Human-centric service is an important domain in smart city and includes rich applications that help residents with shopping, dining, transportation, entertainment, and other daily activities. These applications have generated a massive amount of hierarchical data with different schemas. In order to manage and analyze the city-wide and cross-application data in a unified way, data schema integration is necessary. However, data from human-centric services has some distinct characteristics, such as lack of support for semantic, matching, large number of schemas, and incompleteness of schema element labels. These make the schema integra- tion difficult using existing approaches. We propose a novel framework for the data schema integration of the human-centric services in smart city. The framework uses both schema metadata and instance data to do schema matching, and introduces human intervention based on a similarity entropy criteria to balance precision and efficiency. Moreover, the framework works in an incremental manner to reduce computation workload. We conduct an experiment with real-world dataset collected from multiple estate sale application systems. The results show that our approach can produce high-quality mediated schema with relatively less human in- terventions compared to the baseline method.

单位犯罪教义学的两个问题

刑法教义学体系中应区别自然人构建单位或法人的教义学理论。对法人进行制裁,应首先考虑三点:法人是否具有人格;法人是否具有刑事责任能力;法人是否具有独立承担刑事谴责的可能性。立足法制统一原则,从刑法与民商法的关系来看,刑法并没有确认某一主体人格的功能,在民法上承认法人具有人格,在刑法上也就不能否认法人不具有人格。单位人格的特殊性,实质上决定了对单位承担刑事责任的哲学根据不是其具有相对的意志自由,而是其内部治理结构存在着弊端。组织体责任论的“内核”应采取规则组织体的观念,从合规的角度对单位进行分析,单位犯罪成立的判断流程设计应当在构成要件的适格性阶段进行。

论我国民事诉讼法学的法理化——兼论法理学与法教义学的关系

我国民事诉讼法学历经注释学到规范研究的方法迭代。着眼于规范研究超然于现行立法和司法实践,受法理学和部门法学之影响,民事诉讼法教义学被青睐和提倡。囿于我国民事诉讼立法和司法的发展阶段,尤其是当事人主义诉讼体制转型尚未最终完成,民事诉讼法教义学存在异化可能,即低估理论对实践的指引作用,盲从于立法和司法实践,消解来之不易的诉讼理论共识,蕴含退回职权主义诉讼体制之系统风险。停留在注释和实证分析的民事诉讼法教义学也终将枯竭其思想体系而退化为单纯的知识体系,最终由“深科学”退步为“浅科学”。充分肯定和贯彻当事人主义,实现法理在法律体系和审判实践中的泛在,这既是改革开放以来我国民事诉讼体制转型和研究方法革新的有益经验,亦是民事诉讼法教义学的中国式现代化必须坚持的目标与路径。

辩证法的理论思维和实践智慧源于人的生活经验和生命体验,但只有“进入广阔的研究领域”并“通晓思维的历史和成就”,才能真实地掌握辩证法的理论思维和实践智慧。对于辩证法的最大误解,就是把思想的内容和形式、概念的内涵和外延、哲学的理论和方法割裂开了,把辩证法变成了没有思想内容、概念规定、理论内涵的纯粹的“工具”或“方法”。辩证法的实践智慧,不仅是如何看待和对待“人生”的智慧,也是如何看待和对待“历史”的智慧,还是分析、研究、解决“问题”的智慧。把辩证法的理论思维和实践智慧升华为学理化、体系化的概念系统就是辩证法的理论或学说。自觉地掌握和运用辩证法的理论思维和实践智慧,需要学习和研究学理化、体系化的辩证法理论。构建中国自主哲学知识体系,就要在总结辩证法史的基础上,创建具有新的思想内涵、时代内涵、文明内涵的当代中国辩证法理论。

基于子午流注的气交灸法在脑卒中后气虚型尿潴留病人中的应用

目的:探讨基于子午流注的气交灸法治疗脑卒中后气虚型尿潴留病人的临床效果。方法:选取2022年1月—2023年1月在我院住院治疗的60例脑卒中后气虚型尿潴留病人,采用随机数字表法将其分为治疗组和对照组,各30例,对照组给予脑卒中后尿潴留护理常规护理,治疗组在对照组的基础上实施基于子午流注的气交灸法,比较两组治疗前、治疗2周后膀胱残余尿量、治疗后的临床疗效和满意度。结果:治疗2周后,治疗组膀胱残余尿量、临床疗效和满意度均优于对照组,差异有统计学意义(P<0.05)。结论:基于子午流注的气交灸法能有效减少脑卒中后气虚型尿潴留病人的残余尿量,改善临床疗效,提高病人满意度。

公司意思标准下有限责任公司股权代持的体系重构

股权代持对股权归属的约定牵扯到公司股东认定的问题,并因此带来公司治理与权利公示上的混乱。有限责任公司股权代持应区分为合同法与公司法两个层面的问题,实际出资人和名义股东之间依据代持协议的债权债务关系处理,股权归属应当回归《公司法》关于股东身份的认定标准上。股东认定应采用公司意思标准,考察公司是否接纳实际出资人作为股东参与公司,公司意思可以通过明示或者默示方式作出。完全隐名与不完全隐名的区分应以是否获得公司认可为标准。同时,为保障其他股东对公司人合性的控制,应引入优先购买权制度作为事后救济,优先购买权的行使产生撤销股权变动的效力。商事外观主义原则应当通过登记对抗效力实现,名义股东的一般债权人原则上不受外观主义保护。

企业重罪合规改革的理论基础与制度建构

企业重罪合规改革在刑法上面临的主要争议是正当化事由尚不明晰,以及是否违反罪刑法定、罪责刑相适应等刑法的基本原则。应当肯定的是,企业重罪合规改革具有充分的理论基础与重要的现实意义。在改革过程中,重罪合规应当划分为事前重罪合规与事后重罪合规两个方向。在组织体责任模式下,企业在事前制定有效的合规计划,并有效落实合规计划可以排除单位责任;企业事后合规义务的履行可以熔断企业刑事责任,进而带来刑罚上的从宽处罚,并解决罪责刑不相适应的问题。为了能够使企业合规改革在遵循罪刑法定原则的前提下得到充分落实,立法机关应当对《刑法》第30条、第31条以及分则有关条款进行修正,并由司法机关制定关于企业合规有效性的司法解释,以确保其在实践中的应用。
