Inheritance,Innovation and Development of Wuling Mountain Area in Hubei Province Based on Intellectual Property Rights

Using the methods of field survey and literature collection,this paper firstly introduces the intellectual property resources of the Wuling Mountain Area in Hubei Province from folk literature and arts,traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,and trademarks.Then,it analyzes the main problems in the protection and inheritance,innovation and development of intellectual property rights(IPRs).In addition,it discusses the strategy of inheritance,innovation and high-quality development of this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with recommendations including carrying forward and inheriting folk literature and art,protecting traditional knowledge of traditional craftsmanship,inheriting and innovating to develop traditional Chinese medicine and ethnic medicine,improving the protection and use of geographical indications,and strengthening the IPR protection.

Inheritance,Innovation,Development and Intellectual Property Protection of Tea Industry in Wuling Mountain Area of Hubei Province

Wuling Mountain Area of Hubei Province is a key tea-producing area in China,and the tea industry is its agricultural pillar industry.First,this paper introduces the tea industry in Wuling Mountain Area.Then,from traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks,etc.,it studies the intellectual property resources of its tea industry.Next,it analyzes main problems of its intellectual property protection and inheritance,innovation and development.It also discusses the strategy of inheritance,innovation and high-quality development of the tea industry in this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with pertinent recommendations,including implementing the traditional tea production process and technical protection project,protecting the biological genetic resources of tea trees,cultivating new varieties of tea plants bred independently,creating high value patents,building regional public brands,and strengthening intellectual property protection.

Intellectual Property Protection and High-Quality Development of Xinjiang Melons under the Big Food Concept

The development of diversified foods such as melons under the big food concept can reduce the pressure on staple food grain.Xinjiang has the advantages of building a new development pattern of dual circulation of diversified food industry and establishing a national diversified food safety and high-quality assurance center.The construction of an agricultural power needs the strategic support of an intellectual property power.This paper introduced and studied Xinjiang s melon industry and its agricultural intellectual property resources,analyzed the six main problems,including many idle land resources have not been developed into melon fields and the role of melons in diversified food supply systems not well played.Finally,it proposed to vigorously develop diversified food industries such as melons in Xinjiang and establish an eight-point strategy such as national diversified food safety and high-quality assurance center.

Study on Agricultural Intellectual Property Protection and High-Quality Development of Traditional Chinese Medicine of Ginseng

Agricultural intellectual property has the functions of carrying forward agricultural cultural heritage,encouraging agricultural scientific and technological innovation,cultivating the brand of agricultural products and so on. The protection and application of agricultural intellectual property rights can enhance the vitality,innovation and competitiveness of agricultural economy,and promote the strategy of high-quality agricultural development and rural revitalization. Ginseng is a traditional medicinal variety with superior characteristics in Northeast China,and it is one of the most famous " three treasures" in Northeast China. This paper introduces ginseng( Panax ginseng C. A. Mey.) and its medicinal value,analyzes the traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks and other agricultural intellectual property resources of ginseng,studies the traditional Chinese medicine GAP certification and certification of " Three Agricultural Products" and the construction of the dominant area of agricultural product( Fusong ginseng) with Chinese characteristics,and explores the rural revitalization strategy and traditional Chinese medicine development strategy,ginseng agricultural intellectual property protection and high quality development strategy.

Intellectual Property Protection and High-quality Development of Cotton Industry in Xinjiang

This paper firstly introduces the general situation of cotton planting areas in China and cotton industry in Xinjiang,and the current situation of intellectual property protection of Xinjiang's cotton industry.Then,it analyzes the main problems in its intellectual property protection and high-quality development.On this basis,it comes up with the recommendations for high-quality development of cotton industry in Xinjiang under the strategy of strengthening the country with intellectual property.The recommendations include improving the level of creation of creative intellectual property rights,building an intellectual property rule system in the entire cotton industry chain in Xinjiang,building protected zones for production of major high quality agricultural product cotton,establishing a demonstration zone to undertake the transfer of the domestic cotton textile and garment industry,undertaking education on the sense of community for the Chinese nation in response to the Xinjiang cotton incident,and developing the"Belt and Road"blue market for Xinjiang cotton and its products.

Cotton Breeding in Xinjiang and Its Intellectual Property Protection

In 2021,Xinjiang's cotton output was 5.129 million t,accounting for 89.50%of China's total.The autonomous region produces high-quality long-staple cotton,natural colored cotton,fine-staple cotton(upland cotton),organic cotton,etc.The southern Xinjiang cotton area is one of the three major long-staple cotton(island cotton)producing regions in the world.This paper introduced the history of cotton planting and breeding in Xinjiang from the aspects of cultural relics records,history of entering Xinjiang,historical achievements of breeding and breeding leaders.We studied the intellectual property protection of cotton breeding in the autonomous region from the aspects of biological genetic resources,invention patents,utility model patents and new plant varieties,analyzed the six main problems existing in cotton breeding and its intellectual property protection,and discussed the tactics for cotton breeding and its intellectual property protection in Xinjiang under the strategy of strengthening the country with intellectual property.Eight suggestions in response to the Xinjiang cotton incident were also put forward,including establishing a Xinjiang national cotton germplasm nursery,protecting biological genetic resources,and strengthening the protection of creative intellectual property rights in the field of breeding to escort technological innovation in the cotton seed industry.

Protection of Intellectual Property and Authenticity of Chinese Herbal Medicine Chrysanthemum morifolium

This paper first introduced Chrysanthemum morifolium Ramat. and its medicinal value. Then, it studied agricultural intellectual property resources such as geographical indications, trademarks, patents, new plant varieties, biological genetic resources, and traditional knowledge related to C. morifolium . Finally, it summarized poverty-stricken areas ecologically suitable for planting C. morifolium , analyzed the GAP certification of C. morifolium , pollution-free agricultural product certification, green food certification, and organic food certification, and discussed the strategies for C. morifolium intellectual property protection and authenticity protection in the context of TCM development strategy and rural revitalization strategy.

The Establishment of Intellectual Property Rights

A common act taken by every innovation-oriented country is its protection for intellectual property. The main mission for establishing intellectual property rights is to normalize the rights and laws over its entire domain of jurisdiction. This article introduces the new concept of "intellectual-property-rights-ization", and discusses about the role and importance of this concept; a country that has normalized intellectual property rights are characterized by a people that realize the importance of intellectual property rights, a presence of a rule system that protects one 's intellectual property, an administration that regulates intellectual property rights, a specialization of labor in protecting IPR, and a strong education system.

Innovative development path of ethnomedicines： a case study

Innovative development extends the vitality of ethnomedicines. Developing ethnomedicines is not only beneficial to the public but also to the related industry and transforms economic growth, driving local social and economic development further. Its economic benefit can be used to optimize and promote the hardware and software of the platform, as well as support the sustainable development of ethnomedicines. Apart from research and discussion on the innovative development of ethnomedicines on the basis of theory and regulations, this series of articles also summarizes cases that are conducive to the overall understanding of the necessity and feasibility of the innovative development. In terms of industrial development, large enterprises and products, such as Yunnan Baiyao, Guizhou Miao ethnomedicines, Cheezheng Tibetan Medicine, products developed from Dengzhanhua （Erigeron breviscapus）, the Gold series of Yi ethnomedicines, and products developed from Sanqi （Panax notoginseng）, in China are introduced and summarized, focusing on resource superiority, sustainable innovation, standard research and development, and production, as well as intellectual property protection.

知识产权保护对数字产业创新效率的影响

知识产权保护是提升数字产业创新效率的有力支撑,也是助推创新型国家建设的重要抓手。本文借助渐进式双重差分模型,使用2010~2022年我国上市公司数据考察知识产权保护对数字产业创新效率的影响。结果显示:(1)知识产权保护能够正向提升数字产业创新效率,且随着数字产业创新效率持续提升,知识产权保护的正向驱动效应呈边际递增特征;(2)机制检验结果显示,知识产权保护可通过促进知识溢出、提升技术创新和人力资本水平驱动数字产业创新效率提升;(3)异质性检验结果显示,相较于西部及东北部地区、传媒服务业和国有企业,知识产权保护更能推动东、中部地区、软件开发及信息技术服务业和非国有数字企业创新效率提升。基于此,提出多管齐下健全知识产权保护机制、多路并进提升数字产业创新效率、因地制宜推动数字产业协同发展的对策建议,希冀为提高数字产业创新效率提供相关理论经验。

新质生产力的知识产权驱动路径与制度协同

新质生产力发展依靠创新发挥主导作用,知识产权是建设与新质生产力相适应生产关系的制度载体。现有理论对新质生产力的范畴内涵尚未达成充分共识,导致关于新质生产力发展路径研究缺乏针对性。生产力以产业为载体,从产业结构转型需求出发,发展新质生产力不限于追求未来技术、颠覆性技术创新,根本上是对科技作为第一生产力的需求强化,既包括通过创新壮大战略新兴产业、培育未来产业,也包括推动传统产业转型升级。作为创新驱动发展的主要制度载体,知识产权通过双重路径驱动新质生产力发展:一是支撑建设科技创新的市场导向机制,二是衔接市场力量和国家战略科技力量,保障科技创新的新型举国体制顺畅运行。面向新质生产力的发展要求,知识产权需从供给、需求、环境三个维度作出制度协同,从而优化知识产权创造供给,提升知识产权保护效能,加强知识产权转化运用,深度参与知识产权全球治理,建设有利于新质生产力发展的国内外制度环境。

金融发展、知识产权保护与企业创新--基于制造业知识产权保护的视角

创新驱动经济高质量发展的过程中,企业是微观基础,金融是推动企业创新的重要力量。文章从知识产权保护的视角研究金融发展与企业创新之间的关系,并选取2013-2019年我国制造业A股上市公司数据进行实证研究。研究结果表明:金融发展对企业创新有稳健的促进作用;增强知识产权保护能提升金融对企业创新的促进作用,主要影响的是企业创新的质量。异质性分析显示,知识产权保护在金融发展和企业创新之间的正向调节作用仅存在于民营企业和国有企业中。研究结论为金融发展和知识产权保护推动制造业企业技术创新提供了有益思考。

创新驱动发展战略下高校知识产权信息服务现状与思考

在创新驱动发展战略背景下,高校成为知识产权信息服务和科技创新的重要资源保障机构,高校知识产权信息服务的质量也体现了高校知识产权保护与运用的成效及科技创新水平。文章以福建省成立知识产权信息服务中心的高校为调查对象,通过调研总结各高校知识产权信息服务的现状,分析存在的问题,并提出相应的优化策略。

国家知识产权战略对高技术产业创新效率的影响——基于时间断点回归设计

在我国从知识产权大国向知识产权强国迈进的关键时期,探究实行国家知识产权战略对高技术产业创新效率的影响,既是推动高技术产业升级的有效手段,也是改革完善知识产权保护与管理制度的内在需求。基于2000—2019年中国28个省市地区高技术产业创新数据,运用时间断点回归方法检验中国实施国家知识产权战略对高技术产业创新效率的影响。研究表明:国家知识产权战略的实施在整体上显著促进高技术产业创新效率提升。区域异质性分析发现,战略实施显著提升了东、西部地区高技术产业的创新效率,但对中部地区创新效率的提升作用不显著。研究结论为优化知识产权政策设计、提高高技术产业的创新能力提供了经验证据。未来应进一步健全知识产权制度体系,并结合区域差异因地制宜制定知识产权政策。

新时代知识产权强国建设中的制度转换--结合党的二十届三中全会精神的解读

《知识产权强国建设纲要(2021—2035年)》是继《国家知识产权战略纲要(2008—2020年)》之后,推动我国知识产权“由大到强”所作出的重大战略部署。党的二十届三中全会为知识产权强国建设进一步指明了方向。知识产权强国建设以知识产权现代化治理作为总基调,以现代化的制度体系建设为核心,从以下四个方面进行制度转换:(一)以创新为基本原则,强化知识产权保护的同时,限制不公平竞争行为;(二)从行政与司法的“双轨制”,转变为“协同保护体系”建设;(三)从注重国内市场的自我发展,到统筹国内和国外,深度参与全球知识产权治理;(四)从强化知识产权指标体系,到拓宽知识产权的制度基础,积极开展知识产权的基础建设。

知识产权金融赋能科技型中小企业创新发展:作用机理、现实困境与政策建议

科技型中小企业是提升科技创新能力的重要载体,是保持经济韧性的重要支撑,是发展新质生产力的重要力量。《中共中央关于进一步全面深化改革推进中国式现代化的决定》明确指出,要加强对国家重大科技任务和科技型中小企业的金融支持。目前,我国科技型中小企业创新发展面临“融资难、融资贵”困境,利用知识产权进行融资可以为科技型中小企业拓宽融资渠道,为科技型中小企业创新发展增添新动力。以科技型中小企业为研究主体,从知识产权金融视角出发,通过作用机理分析、现实情况考量、实践经验总结等途径探索知识产权金融赋能科技型中小企业创新发展面临的现实困境,进而提出针对性政策建议十分必要。通过重点分析知识产权证券化、知识产权融资租赁等其他融资模式,为科技型中小企业利用知识产权融资提供实践指导,可为完善知识产权金融赋能科技型中小企业创新发展理论体系提供智力支撑。

地方高校科技成果转化现状分析及对策建议

从我国地方高校近几年科技成果转化的数据入手,阐述了地方高校科技成果转化的现状;从研发经费投入结构不合理、专利质量不高、管理模式单一、校企之间存在信息差、科研人员积极性不高五个方面分析了地方高校科技成果转化中存在的问题;提出优化科研经费投入结构,培育高价值专利,加强服务体系建设,搭建校企之间的合作桥梁,持续推进科技成果转化政策落实等对策,以期调动高校科研人员的积极性,充分发挥地方高校服务地方经济的作用。

营商环境与企业创新--来自工商注册数据的证据

营商环境作为影响市场主体活动的综合环境,对企业的生产经营活动产生重要影响。本文使用国家工商行政管理总局的企业注册信息,计算各城市企业五年存续率、年度创业率和企业密度等数据,并通过主成分分析法构建城市营商环境发展水平指数。在此基础上利用2011-2020年的A股上市公司数据,实证检验营商环境对企业创新的影响。研究发现:好的营商环境能显著促进当地企业创新,在更换被解释变量、更换回归模型、剔除创新中心城市样本(直辖市)等稳健性检验后,以上结论依然成立。本文进一步使用周围城市营商环境均值作为营商环境的工具变量,缓解内生性问题后以上结论依然成立。机制检验表明,营商环境主要通过提高金融发展水平、增强知识产权保护力度的途径促进企业创新。拓展研究发现,营商环境在政府补贴与企业创新的正向关系中发挥促进作用,在外部审计与企业创新的正向关系中发挥替代效应。本文的结论为进一步优化营商环境、加快建设创新型国家提供了重要的政策参考。

知识产权保护、要素配置效率与企业绿色技术创新

选取我国2012—2022年沪深A股上市公司的面板数据,运用双向固定效应与中介效应模型,考察知识产权保护、要素配置效率与企业绿色技术创新三者间关系。研究结果表明:知识产权保护可显著促进企业绿色技术创新,且这一结论经过稳定性检验后依然成立。机制检验发现,知识产权保护能够显著提升要素配置效率,继而赋能企业绿色技术创新。异质性分析显示,知识产权保护对经济禀赋较强地区企业和国有企业绿色技术创新的促进作用更明显。鉴于此,政府部门及相关企业需建立健全知识产权保护制度、构建要素配置体制机制、动态调整绿色技术创新模式,以期为全面赋能企业绿色技术创新提供新动能。

新质生产力赋能外贸高质量发展——来自省域面板数据的实证检验

2024年全国外贸工作会议指出要加快发展新质生产力,扎实推进贸易高质量发展。基于新质生产力发展水平和外贸高质量发展水平的评价指标体系,利用省级面板数据进行固定效应回归分析,探讨新质生产力对外贸高质量发展的影响。研究发现,新质生产力发展水平逐年递增,但地区间发展不平衡;新质生产力对外贸高质量发展具有显著促进作用,经过稳健性检验及内生性分析后仍然成立;机制检验表明,新质生产力可通过提高创新能力促进外贸高质量发展;知识产权保护具有正向调节作用,能增强新质生产力对外贸高质量发展的促进作用;新质生产力对经济基础发达和市场环境良好的省份具有显著促进作用,对经济基础欠发达和市场环境欠佳省份影响不显著。最后,提出强化创新驱动和产业协同、加强知识产权保护、优化市场环境等对策建议,以推动新质生产力快速发展和外贸高质量发展。
