A Study on Intellectual Property Right Protection of Geographical Indications and Regional Public Brand Building in Xinjiang

This paper studies the geographical indication resources of Xinjiang and their distribution in administrative regions,national grain production functional zones,protected zones for production of major agricultural products,advantageous areas of Chinese characteristic agricultural products,and national advantageous characteristic industrial clusters.It analyzes the main problems existing in the protection of intellectual property rights of geographical indications.Besides,it discusses the strategies for the protection of intellectual property rights of geographical indications in the autonomous region and the building of regional public brands in the contest of the strategy of strengthening the country with intellectual property and rural revitalization strategy.Finally,it comes up with recommendations,including collecting and sorting out the human factors and natural factors of geographical indications of famous,excellent and special products,strengthening the protection of geographical indications of Xinjiang cotton and its products,enhancing the protection of geographical indications of grain and oil crops and sugar beet,implementing the protection of geographical indications for products with special needs for ethnic minorities,building national geographical indication product protection demonstration areas,formulating national and international standards for geographical indication products,and take full advantage of the EU-China Agreement on Cooperation on and Protection of Geographical Indications to actively participate in the EU protection of geographical indications.

Geographical Indication Characteristics and Agricultural Intellectual Property Protection of the Tea in Enshi Prefecture

Agricultural intellectual property rights can protect the innovation of agricultural science and technology. Enshi Prefecture is China's important tea-producing area. Its tea industry has become a pillar industry. The prefecture enjoys a reputation of " world selenium capital",and is the best birthplace of natural selenium-enriched tea. The national geographical indication protection has been implemented for Enshi Yulu Tea,Enshi selenium-enriched tea,Wujiatai Tribute Tea,Hefeng Tea,Mapo Tea,etc. This paper introduces the geographical indication characteristics and agricultural intellectual property protection of the tea in this world selenium capital,analyses the countermeasures for agricultural intellectual property protection,and puts forward some constructive suggestions.

Protection of Geographical Indication Intellectual Property of Tea in Guangdong Province

As to tea resources in Guangdong Province at present,there are 4 kinds of national geographical indication products,2 national geographical indication trademarks,and 1 kind of national geographical indication of agricultural products.We conduct a analysis on the current protection of geographical indication intellectual property of tea in Guangdong Province,and put forth the following countermeasures:(i) Conducting indepth study of geographical indication characteristics of famous tea;(ii) Exploiting and arranging the intangible cultural heritage of tea;(iii) Focusing on the protection pattern of geographical indication products established by the General Administration of Quality Supervision,Inspection and Quarantine;(iv) Taking full advantage of special mark of geographical indication.

Protection of Geographical Indication Intellectual Property of Tea in Zhejiang Province

As to tea resources in Zhejiang Province at present, there are 8 kinds of national geographical indication products, 23 national geographical indication trademarks, and 7 kinds of national geographical indication of agricultural products. From the geographical indication protection, geographical indication trademark registration, geographical indication registration of agricultural products, we conduct a analysis on the current protection of geographical indication intellectual property of tea in Zhejiang Province, and put forth the following countermeasures: (i) Based on the relevant tangible cultural heritage and natural heritage, conducting in-depth study on the characteristics of natural factors and human factors concerning geographical indication of famous tea; (ii) Based on the protection pattern of national geographical indication products, registering the national geographical indication trademarks, and registering the national agricultural product geographical indication; (iii) Taking full advantage of special mark of geographical indication products and agricultural brand heritage, and integrating the tea brands within the scope of protection of geographical indication; (iv) Exploiting and arranging the intangible cultural heritage related to tea, strengthening the intangible cultural heritage protection of tea in the province, and endeavoring to include Longjing tea in the world's intangible cultural heritage list on traditional craftsmanship of green tea.

GEOGRAPHICAL INDICATIONS AND ENVIRONMENTAL PROTECTION

The protection of geographical indications （hereinafter ＂GIs＂） is required by all members of the World Trade Organization （hereinafter ＂WTO＂）, as this is mandated by the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights （hereinafter ＂TRIPS＂）. Among the primary justifications for the protection of GIs is to enable producers to secure the premium prices which are attracted by products which have a unique quality that is attributable to their place of production. As this article points out, one reason for this premium price, in the case of agricultural products is that traditionally produced goods are often free from contaminants, such as herbicides and pesticides. Not previously discussed in the literature is the fact that from an environmental protection perspective, GIs applied to agricultural products provides some consumer confidence in their purity, as well as in their traceability. In securing higher returns for agricultural producers, GIs play an important role in securing rural development and the maintenance of rural landscapes. Finally, the article points out that the international GIs regime provides an important means of protecting the traditional knowledge of agricultural producers.

Protection of Geographical Indication and Intangible Cultural Heritage of the Chinese Food Product Resources

The geographical Indications intellectual property and intangible cultural heritage are the general focus of attention of the world today. In the Chinese food product resources, there are 44 kinds of national geographical indication products, 41 national geographical indication trademarks, 9 kinds of national and 212 kinds of provincial-level intangible cultural heritage. This article introduces the geographical indication protection and geographical indication trademark registration of the Chinese food products, the protection of intangible cultural heritage of traditional craftsmanship; discusses the countermeasures for the protection of geographical indication intellectual property and intangible cultural heritage; finally puts forth several recommendations.

Protection of the Geographical Indication Right and New Plant Variety Right of Green Chinese Onion in China

Geographical indication right and new plant variety right are important agricultural intellectual property.This article researches the current situation on protection of geographical indication right of green Chinese onion resources and new plant variety right.And it puts forward the following measures for improvement:(i)Promoting the implementation of geographical indication product protection based on the national quality system;(ii)Establishing the national quality standards of geographical indication green Chinese onion,in order to improve quality standardization;(iii)Encouraging more enterprises within the scope of protection of geographical indication to use special signs of geographical indication;(iv)Unifying the green Chinese onion brands within the scope of protection of geographical indication;(v)Achieving the dual protection of geographical indication right and new variety right of green Chinese onion;(vi)Developing the tourism resources on geographical indication green Chinese onion,to develop tourism agriculture.

环境规制与知识产权保护耦合协调对绿色增长的影响

“双碳”目标背景下,环境规制与知识产权保护的政策协同对破除绿色技术创新“双重外部性”困境,驱动绿色增长具有重要现实价值。基于2006—2020年省际面板数据,采用系统GMM模型,探讨环境规制与知识产权保护耦合协调对绿色增长的影响与中介机制。研究发现:环境规制与知识产权保护耦合协调对绿色增长的影响呈显著“U”型关系,目前全国耦合协调水平总体尚处于抑制绿色增长的阶段;在上述“U”型影响中,研发投入强度、资本错配在资本投入层面分别发挥部分中介效应,技术创新质量、技术交易活跃度在技术创新层面分别发挥部分中介效应,产业结构合理化、产业结构高级化在产业结构层面分别发挥部分中介效应。

我国地理标志产品实践范例、注意问题与创新路径

地理标志品牌建设、保护与应用对于农业高质量和可持续发展起到了非常重要的作用。目前,我国地理标志产品主要采取行政审批的方式,市场上假冒地理标志产品的现象、地理标志产品质量下降的情况屡见不鲜,官方对地理标志侵权案件的处理难度大,缺乏公开、公正的依据。文章提出“地标生境(GIES)”解决方案配合管理,即采取开放科学的方法在地理标志产品及其生态环境与市场之间建立起可以溯源的系统,将地理标志信息数字化、溯源公开化和案例标准化促进管理法制化。“地标生境”方法与技术的创建与数字检察关系密切,两者相互促进。为了更好地开展我国地理标志维权法治管理工作,检察履职应与地标生境案例论证有机结合,构建多主体协同治理模式,建立优质地理产品溯源大数据库,发挥社会治理检察效能整合产业资源,综合履职打造优质地理产品反侵权服务平台,为国内外地理标志知识产权保护提供检察治理的新方案。

地理标志作为知识产权制度的重要内容之一,在道地药材知识产权保护过程中发挥重要作用。通过对云南省道地药材地理标志保护现状进行分析发现,云南省在道地药材地理标志保护过程中,存在确权机制待完善、监管职权归口混乱、立法保护体系不健全、侵权救济制度不完善、信息平台建设待加强和品牌建设规划不全面等问题。为提升云南省道地药材地理标志保护水平,建议从完善地理标志确权机制、优化归口部门管理职能、推动地方立法保护体系建设、健全侵权救济体系、加快信息平台建设和加强地理标志品牌建设等方面加以改进,以推动云南中药材产业长期健康发展。

数字经济发展对城市绿色创新的影响研究——基于异质性视角

如何提高绿色创新水平是我国密切关注的问题,在实现绿色技术研发的过程中,数字经济发挥了作用。基于此,本文选取2011~2022年我国270个城市数据,探究了数字经济对绿色创新的影响及其异质性,进一步利用门限空间杜宾模型检验了绿色创新的非对称空间溢出。结果发现:(1)数字经济发展显著促进了本地和邻近城市的绿色创新。数字经济对本地绿色创新的促进作用在较低的环境规制强度、较高的知识产权保护程度以及我国中部地区更为明显。数字经济的正向溢出效应在较高的知识产权保护水平和我国东部地区得到更好体现。同时数字经济发展能够促进本地和邻近城市的绿色创新质量和数量提升;(2)城市绿色创新表现出显著的非对称空间溢出效应,数字经济发展处于高水平的城市获得更大的正向空间溢出。

地理标志保护制度的环境影响及控制对策研究

地理标志保护制度能够引导生产者以传统方式替代工业化方式进行生产,在理论上能够为环境保护带来有利影响,但其环境保护属性具有相对性,在地理标志保护制度的众多目标中处在边缘地位,带来有利环境影响这一目标的实现具有不稳定性,特定产品的部分生产环节造成的环境污染更甚于工业化生产。地理标志保护制度对生物多样性有一定保护,但损害了未进入产品规格的物种,且所带来的负面影响会随着对经济利益的追求放大。需要提高环境保护在地理标志保护制度核心目标中的重要性,重构地理标志保护制度的目的与价值追求,完善地理标志产品的生产技术规范要求,并通过与其他配套政策相结合来充分发挥地理标志保护制度的环境保护功能。
