Intellectual Property Protection and High-quality Development of Cotton Industry in Xinjiang

This paper firstly introduces the general situation of cotton planting areas in China and cotton industry in Xinjiang,and the current situation of intellectual property protection of Xinjiang's cotton industry.Then,it analyzes the main problems in its intellectual property protection and high-quality development.On this basis,it comes up with the recommendations for high-quality development of cotton industry in Xinjiang under the strategy of strengthening the country with intellectual property.The recommendations include improving the level of creation of creative intellectual property rights,building an intellectual property rule system in the entire cotton industry chain in Xinjiang,building protected zones for production of major high quality agricultural product cotton,establishing a demonstration zone to undertake the transfer of the domestic cotton textile and garment industry,undertaking education on the sense of community for the Chinese nation in response to the Xinjiang cotton incident,and developing the"Belt and Road"blue market for Xinjiang cotton and its products.

RCEP框架下企业OFDI技术利益的理论机制与实证检验

区域全面经济伙伴关系协定(RCEP)合作框架下中国企业对外直接投资(OFDI)及其技术利益格局会深远影响成员国的后续科技创新与合作。本文基于上市公司面板数据,运用“熵权法”测算技术利益,结合企业、环境、东道国与OFDI特征研究中国企业对RCEP国家直接投资的技术利益实现问题。研究发现:对RCEP国家直接投资对实现技术利益具有显著促进作用;管理效率的提升强化技术利益的实现能力,高知识产权保护水平强化技术利益实现的动机。进一步分析表明,国有企业能实现更多的技术利益,而民营企业可以通过提高管理效率和知识产权保护水平提升技术利益实现水平;企业OFDI水平越高、东道国知识产权保护水平越高,技术利益实现效果越好;投资到RCEP国家的企业相比投资到“一带一路”国家的企业会获得更多技术利益。

基于区块链共识激励机制的新型联邦学习系统

随着云存储、人工智能等技术的发展,数据的价值已获得显著增长。但由于昂贵的通信代价和难以承受的数据泄露风险迫使各机构间产生了“数据孤岛”问题,大量数据无法发挥它的经济价值。虽然将区块链作为承载联邦学习的平台能够在一定程度上解决该问题,但也带来了三个重要的缺陷:1)工作量证明(Proof of Work,POW)、权益证明(Proof of Stake,POS)等共识过程与联邦学习训练过程并无关联,共识将浪费大量算力和带宽;2)节点会因为利益的考量而拒绝或消极参与训练过程,甚至因竞争关系干扰训练过程;3)在公开的环境下,模型训练过程的数据难以溯源,也降低了攻击者的投毒成本。研究发现,不依靠工作量证明、权益证明等传统共识机制而将联邦学习与模型水印技术予以结合来构造全新的共识激励机制,能够很好地避免联邦学习在区块链平台上运用时所产生的算力浪费及奖励不均衡等情况。基于这种共识所设计的区块链系统不仅仍然满足不可篡改、去中心化、49%拜占庭容错等属性,还天然地拥有49%投毒攻击防御、数据非独立同分布(Not Identically and Independently Distributed,Non-IID)适应以及模型产权保护的能力。实验与论证结果都表明,本文所提出的方案非常适用于非信任的机构间利用大量本地数据进行商业联邦学习的场景,具有较高的实际价值。

数字化时代非物质文化遗产的知识产权保护:基础、困境及应对

步入数字时代,随着技术与经济的进步,非物质文化遗产的良性传承与发展对知识产权保护提出了更高的要求。加强非物质文化遗产数字化知识产权保护,既回应了非物质文化遗产数字化创新发展的现实需要,又与非物质文化遗产数字化保护与传承的利益平衡需求相契合。现阶段我国非物质文化遗产数字化知识产权保护存在权利主体模糊、权利客体形态复杂、权利内容不清及权利交易不畅的现实困境。对此,为促进非物质文化遗产数字化传承与发展,可以从明晰相关权利主体、构建分层保护体系、廓清相关权利主体的利益边界及建设非物质文化遗产知识产权交易平台入手,破解当前的保护困境。

RTA知识产权保护强度对出口贸易稳定性的影响研究

在国际贸易不确定性加剧的背景下,RTA知识产权保护强度对其成员国间出口贸易有着重要的影响。基于DESTA数据库2003—2020年间有效运行的RTA,选取有RTA关系的165个国家组成的2927组国家对作为研究对象,测度了RTA的知识产权保护强度,并构建回归模型探究RTA知识产权保护强度对出口贸易稳定性的影响。研究发现:RTA知识产权保护强度越大,越有利于提高RTA成员国间出口贸易的稳定性。此外,国家间信息流动性越强,以及进口国经济自由度越高,RTA知识产权保护对出口贸易稳定性的促进作用就越强。该效应对于不同类型国家和不同出口行业而言不一样:RTA知识产权保护对南北国家间的双边出口贸易稳定有促进作用,而对南南国家和北北国家间的促进作用不显著;对动植物及食品制造类,皮革、纺织及杂制类,电子、化工及机械制造类行业出口贸易稳定有促进作用。这些研究结论对国家间开展贸易合作,签订合理知识产权保护强度的RTA,维护长久稳定的出口贸易关系具有重要意义。

知识产权法治建设的三个维度

私权保护、国家治理和国际协调是知识产权法治建设中的三个维度。知识产权的本质是人们依法就智力活动成果享有的私权,其客体是通过知识创新或经营劳动产生的特定信息,制度运行中出现的抢占信息资源并将其包装成知识产权客体牟利的乱象应予以纠正。基于信息的无形性,知识产权保护通常需要首先确定客体范围边界,然后对权利人予以及时充分的救济,因此需要行政和司法机关提供专业、便捷的确权及公正、高效的保护。这一建立在“以公开换保护”基础上的公权力介入特色,使得知识产权制度成为国家治理工具。知识产权保护还与国际贸易紧密相关,这一领域存在诸多国际条约。法治建设不能脱离本土实践,应基于地域性原则,结合经济学、社会学等原理,寻求国内国际法治协调发展的共赢之道。

知识产权保护对数字产业创新效率的影响

知识产权保护是提升数字产业创新效率的有力支撑,也是助推创新型国家建设的重要抓手。本文借助渐进式双重差分模型,使用2010~2022年我国上市公司数据考察知识产权保护对数字产业创新效率的影响。结果显示:(1)知识产权保护能够正向提升数字产业创新效率,且随着数字产业创新效率持续提升,知识产权保护的正向驱动效应呈边际递增特征;(2)机制检验结果显示,知识产权保护可通过促进知识溢出、提升技术创新和人力资本水平驱动数字产业创新效率提升;(3)异质性检验结果显示,相较于西部及东北部地区、传媒服务业和国有企业,知识产权保护更能推动东、中部地区、软件开发及信息技术服务业和非国有数字企业创新效率提升。基于此,提出多管齐下健全知识产权保护机制、多路并进提升数字产业创新效率、因地制宜推动数字产业协同发展的对策建议,希冀为提高数字产业创新效率提供相关理论经验。

长江经济带知识产权保护与城市绿色技术创新效率——基于创新价值链视角的空间效应分析

基于创新价值链视角,将绿色技术创新活动分解为科技研发和成果转化两个阶段,对2011—2020年长江经济带108个城市知识产权保护的绿色创新效应进行实证分析。结果表明:(1)知识产权保护对本地绿色技术创新总效率及其子阶段效率的直接影响均显著为正;空间效应结果表明,知识产权保护对科技研发效率存在正向空间溢出效应,对成果转化效率则具有负向空间溢出效应,但对总效率的空间影响效应依然为正。(2)强化知识产权保护能够通过吸引外商直接投资、促进金融发展、提高人力资本质量三种渠道促进城市绿色技术创新效率提升。(3)异质性分析表明,长江经济带下游城市强化知识产权保护有利于推动科技研发效率和成果转化效率的提升;而中上游城市加强知识产权保护对科技研发效率的提升作用并不显著,对成果转化效率甚至具有消极影响。本文结论为长江经济带推进知识产权保护建设和绿色技术创新发展提供了有益启示。

类型化视角下非遗知识产权保护体系研究

非遗知识产权保护的类型化梳理是非遗知识产权保护体系构建的前提,类型化思维和传统概念化思维的有效互补可以化解非遗知识产权保护的规则冲突。以促进文化传承和推动区域经济发展为价值标准规划出非遗知识产权保护的具体路径,通过利益平衡原则指导下的非遗“权利主体”和惠益原则指导下的非遗“保护客体”类型化分析,解构非遗的传统类型,厘清非遗知识产权保护的内容和样态,合理重构非遗知识产权保护类型,为非遗知识产权保护提出有效配置方案,实现非遗知识产权保护的良性循环。

知识产权政策对制造业市场竞争力的影响

基于知识产权示范城市政策的准实验,利用2009—2020年中国沪深A股上市制造业企业的数据,结合三重差分模型考察知识产权保护政策对制造行业的企业市场竞争力的作用。研究发现:知识产权示范城市设立对不同制造行业的企业竞争力的影响具有差异性,高技术行业的竞争力相较于传统行业得到进一步提升;对于低股权集中度、国有性质以及大规模等特征的制造业企业,其影响存在差异。进一步分析发现,知识产权示范城市政策能够通过缓解融资约束、影响运营成本以及提高关键技术创新能力推动不同制造行业市场竞争力出现差异性变化。据此提出强化知识产权保护制度建设、完善知识产权服务体系、扶持关键核心技术创新联盟等政策建议。
