In answering the questions as whether China's rising labor price and ageing workforce have affected rural land leasing and whether these factors have any joint effect,we have employed RCRE data of the Ministry of Agriculture to carry out an empirical analysis and the result indicates that labor price hike has significant positive effects on both the land lease-in and lease-out of rural households,i.e.labor price hike will help increase the land leasing of rural households.At the level of ageing workforce,our empirical results indicate that ageing workforce does not create any significant impact on rural land leasing market no matter for land lease-in or lease-out in overall samples,plain regions and mountainous regions.In our empirical analysis on whether ageing workforce will intensify or weaken the effects of labor price hike on rural land leasing market,the regression result also indicates that there is no significant effect from a statistical perspective. 展开更多

Based on the research introduction of domestic and foreign scholars,dynamic equilibrium between the rural labor force flow and the price of agricultural product is analyzed by VEC model,according to the data of the rural labor force flow and the price of agricultural products in the years 1990-2007.Chows breakpoint test is used to measure the stage characteristics of the impact of rural labor force flow on the price of agricultural product.Result shows that there is a long-term and stationary relationship between the flow quantity of rural labor force and the price of agricultural product.Rural labor force flow,as an exogenous force,affects the agricultural production,and further influences the price fluctuation of agricultural products.Impact of rural labor force flow on the price of agricultural product is from weak to strong,then grows gradually weaker,and reaches its peak value at the year 1998.With the development of rural society and economy and the market process,rural labor force flow endogenously affects the price of agricultural product,which has periodic characteristics.In order to achieve a dual stabilization of the rural labor force flow and the price of agricultural products,the following countermeasures are put forward:vigorously developing vocational education,increasing the support for agricultural production,and making active employment measures. 展开更多

当前,我国对劳动关系的法律调整总体上实行整齐划一的单一调整模式,劳动法对所有劳动者实行"一体适用、同等对待"。这种模式产生了诸多问题。现实中,由于用工形式不断发展以及劳动者"从属性"的弹性,雇员类型表现出多样性,除了典型雇... 当前,我国对劳动关系的法律调整总体上实行整齐划一的单一调整模式,劳动法对所有劳动者实行"一体适用、同等对待"。这种模式产生了诸多问题。现实中,由于用工形式不断发展以及劳动者"从属性"的弹性,雇员类型表现出多样性,除了典型雇员,还存在从属性较弱的"类似雇员的人"以及其他特殊雇员。为此,应更新劳动法的立法理念,在坚持劳动者是弱势群体的前提下,根据具体场景,考察不同类型雇员的差异,进行相应的规则设计。在立法技术上,应打破传统的针对所有劳动者的综合立法模式,向针对特定类型主体和特定事项的专门立法模式转变。应摒弃传统的劳动法规则"全部适用"或"全不适用"的陈旧模式,对雇员进行类型化处理,为类似雇员的人、特殊雇员以及特殊雇主的雇员提供特殊规则,实现劳动关系法律调整模式从一体调整向分类调整和区别对待转变。 展开更多

We examine how the trade-off between labor and leisure would affect asset prices and derive a familiar principal partial differential equation which asset prices must satisfy. It has made the labor relations more complex and labor conflicts apparent and frequent. However the coordination mechanism has not been developed correspondingly. Based on the empirical research upon current domestic and overseas labor relations, it is concluded that the supply of labor force exceeding the demand of it is the fundamental reasons for explaining labor conflicts in the economic transformation in China. It also suggested that the coordination mechanism of labor conflicts has mechanical dysfunction and the structure of harmonic labor relations would take a long time. 展开更多

HIV/AIDS Related Stigma among Male Labor Migrants in Nepal

This cross-sectional study has tried to examine HIV/AIDS-related stigma among Nepalese returnee male labor migrants. Migrant workers who have worked at least six months abroad were asked different questions related to sexual behavior, knowledge on HIV/AIDS & condom and HIV/AIDS-related stigma. Stigma was measured on a three-point rating scale as high, average and low stigma. About 58% of migrants had the view “I would rather not know if I have HIV” followed by “I don’t want to be friends with people living with HIV” (53.6% migrants) and “people with HIV are cursed” (35.5% migrants). High stigma was present among 15.5% of the total respondents with high proportion among those with higher age, lower education, rural residence, and no knowledge on Voluntary Counseling and Testing (VCT) service. About a quarter of respondents were of the view that migrants infected with HIV while abroad should not be allowed to return Nepal. Some level of stigma on HIV/AIDS exists among male labor migrants in Nepal. Interventions aiming at reducing stigma should consider the factors like migrants’ age, education, place of residence and knowledge on VCT services. 展开更多

From the relative labor time of economic entity,this paper discusses the relationship between labor time and price readiness,demand curve or supply curve,and establishes the market equilibrium model based on labor value. In a perfectly competitive environment,the equilibrium exchange price of the model is the ratio of labor value between two commodities,and combines demand and supply sides' recognition of commodity quantity of labor,reflecting the socially necessary labor time contained in commodities. 展开更多

家族企业更重视员工利益吗?——基于劳动力成本粘性的考察视角

家族企业追求“基业长青”,其在对待员工这一重要利益相关者时,是否会表现出显著的行为偏好和特征?本文切入劳动力成本粘性的研究视角,以2003年—2019年民营上市公司为对象,考察了家族企业劳动力成本的决策行为表现及其机理.研究结果表... 家族企业追求“基业长青”,其在对待员工这一重要利益相关者时,是否会表现出显著的行为偏好和特征?本文切入劳动力成本粘性的研究视角,以2003年—2019年民营上市公司为对象,考察了家族企业劳动力成本的决策行为表现及其机理.研究结果表明,与非家族企业相比,家族企业进行劳动力成本调整时会表现出更强的粘性特征,且随着家族持股水平提升、进入代际传承阶段以及董事会中家族成员占比提高,劳动力成本粘性现象会更加突出.进一步研究发现:维护员工关系和保持良好声誉是造成这一现象的主要原因;家族企业中的劳动力成本粘性具体表现为用工粘性,而非薪酬粘性;行业竞争程度和非劳动密集性都会加剧家族企业的劳动力成本粘性;家族企业承担适当的劳动力成本粘性还有助于促进生产效率,实现劳资“互惠”.本文既丰富了家族企业行为特征和成本粘性影响因素的相关研究,也为处理劳资关系和实现共同富裕提供了一定的现实启示. 展开更多

从属性是解读劳动关系的一把钥匙,在各类劳动关系认定理论中获得了最广泛的认可。从历史的角度考证,源于启蒙时代个人主义思潮的从属性催生了劳动法,使之从行会规则中独立出来,进入国家干预的领域,同时赋予了劳动法“人法”的属性,从而... 从属性是解读劳动关系的一把钥匙,在各类劳动关系认定理论中获得了最广泛的认可。从历史的角度考证,源于启蒙时代个人主义思潮的从属性催生了劳动法,使之从行会规则中独立出来,进入国家干预的领域,同时赋予了劳动法“人法”的属性,从而脱离民法交换给付的维度,形成了一个以关注主体特征和组织特征为视角的全新的法律领域;从现实的角度观察,我国劳动法学界在全面接受了劳动关系从属性理论之后,正在有意识地构建中国自主的劳动法知识体系。在法律规范的层面上,我国目前虽然没有明确从属性的类型、权重和要素等相关内容,但是在法律实践的层面上,已经确定了“从属性+要素”的劳动关系认定思路,并开始反哺劳动法教义学体系的构建。“不完全劳动关系”系我国为应对平台用工进行的一项政策性司法创设,劳动关系从属性提供了充分且必要的理论支撑。从逻辑上推理,不完全劳动关系与劳动关系、民事劳务关系遵循一致的从属性考量标准,因此能够构成一类独立的法律关系。 展开更多

价值预期与价值赋予:高校教师劳动关系的匹配博弈模型

在市场化转型时期,高校教师劳动关系的深层逻辑是不同价值间的博弈。价值预期体现为劳动主体在意识层面对价值回报的判断与预估;价值赋予表现为制度对劳动过程的支持程度。基于劳动价值论与制度价值论,对人、劳动价值与制度之间的关系... 在市场化转型时期,高校教师劳动关系的深层逻辑是不同价值间的博弈。价值预期体现为劳动主体在意识层面对价值回报的判断与预估;价值赋予表现为制度对劳动过程的支持程度。基于劳动价值论与制度价值论,对人、劳动价值与制度之间的关系进行深入剖析,以价值赋予与价值预期为横纵坐标,构建基于价值博弈的高校教师劳动关系博弈模型。从模型中发现,高校教师劳动关系有4种基本类型关系:高价值预期与高价值赋予;高价值预期与低价值赋予;低价值预期与高价值赋予;低价值预期与低价值赋予。通过质性访谈检验发现:当人、劳动价值与制度之间的关系相互协调时,以高价值预期与高价值赋予为代表的“双高”类型是劳动关系中的最优博弈类型;反之,则可能出现劳动关系的稳定性缺陷。这由此反映出“人与制度”的伴生性问题。因此,建立高校教师和谐劳动关系需要强化人、劳动价值与制度之间的内在共生逻辑,以及扭转价值失序局面,从而回归价值理性,提升价值赋予与价值预期的适配性。 展开更多
