启示一:有必要把资产价格纳入中央银行实施货币政策时的监测对象。因为一旦资产价格通过财富效应或者其他渠道最终影响到总需求或总供给,就会对通货膨胀率产生影响。即使是实施通货膨胀目标制的中央银行,也很有必要把资产价格的涨落作为制定货币政策的重要参考。

The international semiinar on"Protection of the Rights of Specific Groups in Pandemic Prevention and Control",organized by the Institute of Human Rights,Wuhan University,under the guidance of the China Society for Human Rights Studies,was held online on May 23,2020.Nearly 50 scholars and practitioners from domestic and foreign universities and research institutions conducted discussions and exchanges focusing on a series of topics including"Leave No One Behind:To Guarantee Specific Groups’Access to Public Service under the Pandemic","Justice for All:Prevention and Relief of Discrimination against Specific Groups",etc.

An Academic Summary of the International Seminar on “Comparison of the Human Rights value between the East and the West in Epidemic Prevention and Control”

The international video seminar"Comparison of the Human Rights Values between the East and the West in Epidemic Prevention and Control",hosted by the Institute of Human Rights Law of Huazhong University of Science and Technology,was successfully held on May 30,2020.Against the background of the fight against the CO VID-19 pandemic,this seminar fostered exchanges and discussions on human rights values.As the first country that has contained the epidemic successfully,China shared its experience in the practice of human rights values in epidemic prevention and control,while experts from various countries also shared different human rights values embodied in epidemic prevention and control.This seminar allowed for demonstration of the situation of human rights protection in different countries and regions and exchanges of dilemmas and countermeasures during the specific practice of human rights protection.In the collision of different views and the exchange of multi-dimension dialogues,the seminar called for a sense of a global community of health for all and aimed to foster solidarity and international cooperation for greater contributions to the human rights protection in global epidemic prevention and the development of human rights worldwide.

Robust Control for Uncertain Nonlinear Feedback Systems Using Operator-based Right Coprime Factorization

The robust control issue for uncertain nonlinear system is discussed by using the method of right coprime factorization. As it is difficult to obtain the inverse of the right factor due to the high nonlinearity, the proving of the Bezout identity becomes troublesome. Therefore, two sufficient conditions are derived to manage this problem with the nonlinear feedback system as well as that with the uncertain nonlinear feedback system under the definition of Lipschitz norm. A simulation of temperature control is given to demonstrate the validity of the proposed method.

Digital Rights Management：Model,Technology and Application

with rapid achievement of current information technology and computing ability and applications,much more digital content such as films,cartoons,design drawings,office documents and software source codes are produced in daily work,however to protect the content being copying,shared or deliberately stolen by inside or outside,digital rights management(DRM) became more and more important for digital content protection.In this paper,we studied various DRM model,technology and application,and first proposed DRM Security Infrastructure(DSI),in which we defined encryption,hash,signature algorithm,watermarking algorithms,authentication,usage control,trusted counter,conditional trace,secure payment,and based on the DSI we then proposed a whole classification approach and architecture of all kinds of DRMs,in which we proposed 6 typical classes of copyrights and content protection DRMs architecture:(1) Software-oriented DRM,(2) e Book-oriented DRM,(3) Video-oriented DRM,(4) Image-Oriented DRM(5) Unstructured data oriented DRM,(6) Text-oriented DRM.Based on the above DSI,we then proposed a dynamic DRM model selection method for various DRM application,which can be adapted dynamically for different technology of different applications,which can provide awhole solution for variant DRM development in a rapid and customized mode.The proposed DRM method,technology and application in this paper provided a common,flexible and extendable solution for variant DRM scenes,and can support rapid and customized development.Moreover,we proposed an opinion that the future life will enter into a new era that the content usage and consumption will not again adopt DRM technology rather than with law,liberty and morality.

THE OPTIMAL CONTROL OF DELAY CONTROL SYSTEMS WITH RESTRICTED STATE RIGHT ENDPOINT

In this paper, for the delay control system: (x) over dot (t)=f[x(t), x(t-1), u(t), t] t is an element of[t(0), t(1)] x(t)=psi(t) t is an element of[t(0), t(1)] with state right endpoint restricted by condition psi(k)[x(t(1))]=0 (k=1,2,..., l) a maximum principle is given. And as a specific example, this paper gives a maximum principle under the condition that partial stares right endpoints be completely fixed. Finally, this paper gives an example to explain the application of the main result of this paper. All the results are suitable for the control systems with multidelay as well.

An Academic Summary of the International Seminar Series on “Safeguarding the Right to Life in the Epidemic Prevention and Control”

Guided by the China Society for Human Rights Studies and organized by Southwest University of Political Science and Law,the First Session of the Series of International Seminars on"Global Epidemic Prevention and Control and Human Rights Protection"was held in Chongqing on May 9,2020.The seminar featured the theme of"Guarantee of the Right to Life in Epidemic Prevention and Control"and two sub-topics:"Value Status and Legal Protection of the Right to Life"and Safeguarding the Right to Life of Vulnerable Groups under the Pandemic".Over 40 experts and scholars from China,the Netherlands,France,Pakistan and Sri Lanka attended the conference,and conducted in-depth discussions on specific issues such as"life supremacy","attributes of the right to life","government responsibilities","protection of vulnerable groups","balance of the right to life and other human rights",and"science-based approaches to epidemic prevention".This conference reaffirmed the key idea of life supremacy,which is conducive to strengthening the safeguarding of and attention to the right to life in the global pandemic prevention and control.

Quasi Controlled K-Metric Spaces over C^(*)-Algebras with an Application to Stochastic Integral Equations

Generally,the field of fixed point theory has attracted the attention of researchers in different fields of science and engineering due to its use in proving the existence and uniqueness of solutions of real-world dynamic models.C^(∗)-algebra is being continually used to explain a physical system in quantum field theory and statistical mechanics and has subsequently become an important area of research.The concept of a C^(∗)-algebra-valued metric space was introduced in 2014 to generalize the concept of metric space.In fact,It is a generalization by replacing the set of real numbers with a C^(∗)-algebra.After that,this line of research continued,where several fixed point results have been obtained in the framework of C^(∗)-algebra valued metric,aswell as(more general)C^(∗)-algebra-valued b-metric spaces andC^(∗)-algebra-valued extended b-metric spaces.Very recently,based on the concept and properties of C^(∗)-algebras,we have studied the quasi-case of such spaces to give a more general notion of relaxing the triangular inequality in the asymmetric case.In this paper,we first introduce the concept of C^(∗)-algebra-valued quasi-controlledK-metric spaces and prove some fixed point theorems that remain valid in this setting.To support our main results,we also furnish some exampleswhichdemonstrate theutility of ourmainresult.Finally,as an application,we useour results to prove the existence and uniqueness of the solution to a nonlinear stochastic integral equation.

Research on Corporate Right of Control: Mode of Arrangement and Innovation of Governance

The mode of arrangement and innovation of governance for corporate rights of control should be in accordance with the global resource disposition opportunities and efficiency competition. Based on rights formulated by acts and regulations, this paper establishes models of arrangement for corporate rights of control, and then analyses the composite basic features derived from the models. To conclude, a main frame for the arrangement and innovation of corporate rights of control is put forward based on the real practice of listed companies in China.

The Limits of the Intervention of Public Power in Individual Health Choices——From the Perspective of the Realization of the Right to Health in the Prevention and Control of Chronic Diseases

Noncommunicable chronic diseases have become the most important public health problem in the world today,so the focus of public health services should be shifted from the traditional area of communicable diseases to the prevention and control of chronic diseases.Since bad living habits are the most direct cause of chronic diseases,the most effective measure to prevent and control chronic diseases is to promote healthy lifestyles for the individual citizen.The theories of equal health opportunity,the right to health from the perspective of human rights,and determinants of a healthy society provide justified reasons for the intervention of public power in individual health choices.In the current legal system,the intervention of public power is limited to flexible measures such as health education,which shows respect for individual autonomy.However,it is inconsistent with the needs of current public health practice.We should expand diversified intervention means to encourage individuals to make healthy choices under the guidance of the management model.The“ladder of intervention”outlines a panoramic view of the intervention measures available.However,for the selection of specific measures,it is necessary to consider the public health objectives and the invasion of individual freedom,introduce the“legal reservation principle”and“proportionality principle”as policy analysis tools,and reasonably choose intervention measures at different levels on the ladder to properly handle the tension between public power and private rights.

基于联合体双方异质性特征的EPC项目控制权配置模型研究

为确保联合体双方各自利益不受损的同时,实现项目效益最大化,EPC(Engineering-Procurement-Construction)项目控制权的合理配置成为关键。在考虑联合体双方异质性特征的基础上,构建EPC项目特定控制权与剩余控制权的配置模型,并对模型进行理论推导与假设检验。研究发现:联合体牵头者的身份能够有效抑制自利性投入行为;较高的决策偏好度会诱发自利性投入行为;特定控制权与剩余控制权配置区间的增加均会激发联合体双方的项目性投入;提高风险承受度而降低风险偏好度有利于减少设计方的自利性投入。研究成果为具有异质性特征的联合体成员间控制权的合理配置提供对策。

FOB卖方权利保护的运输法路径选择——《海商法》实际托运人的制度设计

中国作为贸易大国,FOB贸易占80%以上的份额,为了保护FOB贸易中卖方的权利,国际立法采取的路径有二:一是在贸易法中规定卖方的中途停运权,二是在运输法中规定卖方的控制权。然而,这两种路径都因为贸易法和运输法规定的割裂或冲突而未能真正奏效。通过分析中途停运权和控制权的优缺点,可以发现FOB卖方并非运输合同的当事人,要么受制于合同相对性而无法顺利地行使中途停运权,要么因不持有可转让单证而不享有货物的控制权。在上述两种情形下,FOB卖方均难以在未收到货款时通过控制货物来保障自己的权利。基于此,提出实际托运人的权利保护路径应该是授予FOB卖方实际托运人的法律地位,使其有权请求承运人向其签发提单,并通过持有提单而享有货物的控制权(即《汉堡规则》+《鹿特丹规则》模式),实施对货物的有效控制,有效保护未收到货款的FOB卖方的权利。

问责吸纳控制权:乡村产业振兴项目激励失灵的理论解释——以A省F县为例

在乡村振兴中,产业项目因其带来的巨大财政资源和增量绩效,理应有效激发基层政府的能动性。然而,一些地区却出现产业项目对基层政府的激励失灵现象。在“问责吸纳控制权”的分析视野中,问责压力的强化改变了纵向政府间的控制权配置模式,凸显基层行动者的权责失衡样态,这是诱致产业项目激励失灵的深层机制。具体而言,问责总领与检查验收权的向上集中使得基层政府追求控制权的空间不断被压缩,督查问责与正向激励的不均衡加剧了控制权内部冲突,消解了基层干部发展产业项目的主体性,进一步催生出目标设定权的价值偏离,诱发避责共同体的形成及项目制基层实践扭曲。对此,需要在总体上重构控制权,通过强化县域产业自主发展能力、健全权责对等机制、培育乡村内生参与力量破解项目化运作的基层激励失灵困境。

控制权争夺动因和社会资本参与影响研究——以奥马电器的控制权争夺为例

控制权是公司治理机制及利益相关者实现利益最大化的核心因素,因此,控制权争夺成为各利益相关者博弈的主题。在控制权争夺的过程中,公司大股东和公司创始团队的社会资本运作能起到不可忽视的作用。基于控制权争夺动因和社会资本影响的视角,通过对奥马电器控制权争夺的案例研究,以社会资本理论、公司治理理论、委托代理理论为基础构建理论框架,探究奥马电器被控股的成因,分析奥马电器控制权争夺的历程和公司价值的发展趋势,重点剖析社会资本在奥马电器的控制权争夺过程中产生的影响。研究发现:社会资本对企业发展具有促进利益共享、降低交易成本、高度集中控制权等益处,是企业获得控制权不能忽视的关键因素。同时对于控制权争夺过程中企业价值如何更好发展提出了可行性建议和启示。

党“管”数据:基于政企数据权力演化的治理逻辑

数据是治国理政的重要资源,党“管”数据则是推动国家治理体系和治理能力现代化的关键路径。而在数据资源的流动下发生着数据权力的动态演化,存在政企主体数据发展优势表现不同,且需平衡少数大型企业依托政府数据资源优势异化形成数据权力的利弊影响,呈现出党“管”数据的需求。基于此,本文将从静态视角和动态视角分析政企主体间数据权力的形成和异化,从理论与实践的角度分别阐释党“管”数据的必要逻辑,进而探讨中国特色治理模式下党“管”数据的实现路径。研究认为,党“管”数据是制度优势、组织架构和安全发展的必然要求,是规制政企数据权力动态异化的必然选择,并凝练出“1+4”治理路径,推进实现善治目标与国家治理体系和治理能力现代化。

董事会失败容忍对环保投资效率的影响研究

双碳目标的提出,再次强调了环境治理的急迫性。想要实现双碳目标,除了加大环保投入之外,更要重视环保投资效率。本文基于失败容忍这一理论视角,以2011~2022年沪深上市公司为样本,使用面板数据分析模型实证检验了董事会失败容忍和环保投资效率之间的关系。研究结果表明:董事会失败容忍对环保投资效率具有正向作用,即提高董事会失败容忍程度能通过激励管理层达到提高环保投资效率的效果;内部控制会显著增强董事会失败容忍对环保投资效率的正向作用,机构投资者关注会削弱董事会失败容忍对环保投资效率的正向作用;异质性分析表明:内部控制的正向调节作用在国有企业和非重污染企业更显著,机构投资者关注的负向调节作用在私营企业和重污染企业更显著。本文的研究结论对提高环保投资效率,推进环境治理具有重大意义。

控制权转移与企业金融化——来自A股民营企业的证据

利用2013—2021年我国A股民营企业的数据,实证检验了控制权转移对企业金融化的影响。研究发现:民营企业控制权转移到其他民营企业,可显著降低金融资产占比、提高货币资金占比,即对企业投机动机产生抑制作用、对“蓄水池”动机产生促进作用;东部地区、实际控制权大的民营企业,控制权转移对企业金融化的影响更加明显;两职合一民营企业的控制权转移对金融资产占比的抑制作用更加明显,两职分离民营企业的控制权转移对货币资金占比的促进作用更加明显;民营企业间的控制权转移可通过缓解委托代理问题、提高实体投资效率、整合产业链供应链渠道对企业金融化发挥作用;控制权转移对企业金融化的作用仅在短期有效,在长期作用并不明显。

血糖控制对2型糖尿病患者左、右心室心肌功能的影响

本研究探讨血糖控制对2型糖尿病(T2DM)患者左、右心室心肌应变的影响,以及左、右心室心肌功能障碍之间的关系。选取100例左心室射血分数正常的T2DM患者,根据糖化血红蛋白(HbA1c)水平分为HbA1c<7%组(n=54)和HbA1c≥7%组(n=46);同时选取40名健康成人志愿者作为对照组。测量常规超声心动图及左心室整体纵向应变(LVGLS)、右心室整体纵向应变(RVGLS)、右心室游离壁纵向应变(RVFWLS)数据。比较各组数据的差异,应用多元线性回归分析HbA1c对左、右心室心肌应变的影响,以及左、右心室心肌应变之间的关系。从对照组、HbA1c<7%组到HbA1c≥7%组,LVGLS、RVGLS逐渐减低(均P<0.05)。与对照组比较,HbA1c<7%组、HbA1c≥7%组的RVFWLS均减低(均P<0.05),但后两组的RVFWLS差异无统计学意义(P>0.05)。多元线性回归分析显示,在T2DM患者中,HbA1c是LVGLS、RVGLS、RVFWLS的独立影响因素,LVGLS与RVGLS、RVFWLS独立相关。左心室射血分数正常的T2DM患者左、右心室心肌应变均减低,且两者间存在相关性,HbA1c是左、右心室心肌应变减低的独立影响因素,提示高血糖可能同时对双心室的心肌产生直接作用,且心室间存在不利的相互作用。

乡村振兴背景下加强牧区沙地治理路径探索——基于内蒙古巴林右旗的调查

近年,巴林右旗在沙地治理方面积累了丰富的经验,在生态修复、农牧民增收、产业结构调整等方面取得了显著成效。但仍存在持续治理难度逐渐加大、成果巩固任务艰巨、相关政策机制尚未完善等问题,建议合理规划布局、采取系统治理措施、通过转型升级产业生产方式、激发农牧民积极性、加强执法和管护力度等进一步加强科尔沁沙地治理,持续推进乡村振兴。
