The Protection of the Right to Equality of the Elderly in the Digital Society

The inequality faced by the elderly in a digital society is the digital inequality caused by both public and private actions,as well as the societal inequality exacerbated by the digital inequality.The essence of this issue lies in the unequal social participation due to the expansion of digital space under digital inequality.The characteristics of the elderly,combined with their inherent human dignity,determine that the ultimate goal of protecting their right to equality in a digital society is not limited to equal digital rights alone.Instead,it aims to ensure that the elderly have equal opportunities for social participation in both digital and non-digital spaces by eliminating digital inequality and curbing the expansion of digital space.This ensures the autonomy of the elderly in the digital society.Accordingly,the State should implement two policies based on both prohibitive obligations that prevent direct infringements and protective obligations that safeguard the equal rights of the elderly against encroachments from private entities.The first policy,“Digital Integration”,empowers the elderly with digital skills and helps them actively integrate into the digital society.The second policy,“Digital Coexistence,”ensures that the elderly can equally participate in society even when they choose to abstain from digital technology.

CHINA SOCIETY FOR HUMAN RIGHTS STUDIES

Sponsored by scholars and experts concerned with human rights at nine Beijing-based schools of higher learning and research institutes, the All-China Federation of Trade Unions and the All-China Women’s Federation, the China Society for Human Rights Studies (CSHRS) was founded in January 1993. It is the largest academic organization specializing in human rights studies in China, and a non-government organization that is in consultative status with the United Nations Economic and Social Council. A non-profit organization, CSHRS relies on financial aid and donations to maintain its operations.

Bringing the building a moderately prosperous society in all respects to successful completion is a great achievement in China’s modernization and contributes to the development of human rights in China and the world alike.The practice of building a moderately prosperous society in all respects has added new connotations to human rights theories,developing and outgrowing the traditional jurisprudence of human rights.This is reflected in the following aspects:the injection of the overall and equal human development has expanded the traditional western values of human rights based on human freedom and dignity;the injection of interpersonal mutual development,win-win cooperation and risk management and control has expanded the traditional western presupposition of social relations based on the social contract and civil society,and has thus expanded the social foundation of interpersonal cooperation,enriching the social concept of human rights.Guided by the concept of building a community with a shared future for human beings,the building a moderately prosperous society in all respects,enriching the human rights worldviews,has changed the worldviews of racism and zero-sum game among western developed countries and generated the new connotation that mankind should share the development opportunities and achievements.This has constituted a profound jurisprudence of human rights in China and formed an important discourse system in international human rights dialogue.

The Action Logic of China's Human Rights Development in Three Dimensions

Building a moderately prosperous society in all respects is a milestone in China’s human rights development.It clearly reflects the profound action logic of the CpC leading the Chinese people to fight for and realize the protection of rights.At the level of values,the logic of rights for China’s human rights development is mainly manifested in four aspects:prioritizing the right to subsistence and the right to development in the rights system;importance given to citizenship and democracy by the goal of building a moderately prosperously society in all respects;advocating the right to unity and the right to participate in the common cause of the Chinese people;implementing the responsibility of leaders and managers to safeguard human rights.At the practical level,the protection logic of China’s human rights development mainly includes four links:firstly,gradual upgrading is a reliable procedure for the coordination of the human rights system;secondly,the rule of law is a solid foundation for the steady development of human rights;thirdly,the courage to explore is the important factor for the success of human rights practice;lastly,seeking common ground while shelving differences is the key consensus for mutual learning among human rights civilizations.In terms of time and space,China’s human rights development has achieved world-recognized success,laying a solid foundation for this endeavor to proceed,and providing experience and reference for people all over the world to pursue common human rights ideals.

受教育人权理念的嬗变:基于国际组织的经验

受教育权作为一项基本人权,对人的发展与完善具有奠基作用。20世纪中叶以来,联合国教科文等国际组织发布了有关受教育人权的系列报告,受教育人权理念经历了从“注重学会生存技能”“赋能学习化社会”到“增进全球共同利益”“重新构想教育社会契约”的嬗变,凸显了受教育人权理念内涵不断深化的政治逻辑、经济逻辑与文化逻辑、教育逻辑,充分体现了受教育人权理念对个体乃至人类命运共同体的深切关照。在充满不确定性的未来,我们在制定教育法的过程中,需要充分吸纳不断发展变化的受教育人权理念的丰富内涵,以真正保障公民受教育的权利,从而充分发挥教育的潜能与价值。
