Human Rights and Development:China's Contributions Based on a Larger Concept of Human Rights

The Western liberal view of global governance can no longer effectively address the challenges facing the world today or respond to the demands of developing countries in the fields of human rights and development.Meanwhile,the United Nations human rights and development agenda also has its limitations.Against such a backdrop,China's path of human rights development has avoided the trap of human rights confrontation and the clash of civilizations.It has set an example of complementarity and positive interaction between human rights and development by unifying collective human rights with individual human rights and integrating the universality and particularity of human rights.Xi Jinping,general secretary of the Communist Party of China(CPC)Central Committee,delivered a speech at the 37th group study session of the Political Bureau of the CPC Central Committee on China's Path of Human Rights Development.This elevated China's human rights development to a new historical height.Practice has proved that China's concept and path of human rights in the new era have not only effectively promoted the development of its human rights cause,but also contributed Chinese wisdom to the global cause of human rights and development with a larger concept of human rights.Under the framework of the concept of building a community with a shared future for mankind,the Belt and Road Initiative,and the Global Development Initiative,China has contributed to enhancing the discourse power of developing countries in human rights and building a fairer,more just,more reasonable and more inclusive system for global human rights governance.

Research on the Constitutional,Historical and Practical Logic of the Chinese Path of Human Rights Development——From the Perspective of the Inclusion of Human Rights Clause in the Constitution

The inclusion of the human rights clause in the Chi-nese Constitution is a concern and expression of the spirit of the Con-stitution,which has laid the institutional regulations of the fundamen-tal law for the development of human rights in China,provided the principles and value norms of the highest level of effectiveness for the legal protection of human rights,and built a profound constitutional basis for the formation and improvement of the Chinese path of human rights development.The human rights clause is not only a summariza-tion and affirmation of the historical practice of Chinese human rights development under the leadership of the Communist Party of China,but also a new starting point for the development of human rights in China under the leadership of the Communist Party of China.It marks that the development of human rights in China has entered a new era.The Party and the state have finally embarked on a path of human rights development with Chinese characteristics by formulating and implementing the Human Rights Action Plan of China,eliminating ab-solute poverty through the national poverty alleviation campaign,and promoting human rights protection through the rule of law.

Viewing Chinese modernization and Its Requirements for Human Rights Protection from the Perspective of Human Development

Modernization,as a specific stage in the historical development of human society,possesses a multi-layered composite structure,with each layer playing both a promoting and inhibiting role in human development and dignity simultaneously.Chinese modernization is a strategic choice made based on lessons learned from various experiences of modernization processes in other countries,reflecting judgments on the benefits and choices on the values of human development and dignity in modernization.It values the promotion of the free and well-rounded development of all individuals as its standard,demanding the full realization of the positive effects of modernization on human development and the overcoming of its negative effects.Human rights,aiming to promote the free and well-rounded development of every person as the ultimate value goal,are not only an intrinsic structural element of the modernization stage but also a social normative tool that restrains the direction of modernization development,aligning closely with the values pursued by Chinese modernization.Chinese modernization poses dual requirements for human rights protection:on the one hand,it demands the affirmation and promotion of the positive effects of modernization on human development and dignity through human rights standards,and on the other hand,it requires the prevention and mitigation of the negative effects of modernization on human development and dignity through human rights standards.There exists a certain tension between these two dimensions,necessitating an appropriate balance and thereby presenting corresponding requirements for China’s approach to human rights protection.

Pioneering a New Realm of Human Rights Civilization in the Chinese Path to Modernization——An Overview of the Symposium on“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”

On October 14,2023,a symposium themed“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”was held in Changchun,Jilin Province,China.More than fifty experts,scholars,and researchers from national institutions and universities engaged in discussions and exchanges on human rights on the Chinese path to modernization,including the path,practice,knowledge systems,and civilization forms of human rights.This symposium played a significant role in advancing the construction of the disciplinary system,academic system,and discourse system of human rights in China.

The Characteristics and Prospects of China's Assistance to Minority Areas in Realizing the Right to Development

Assisting minority areas to realize the right to development is an important part of Chinese government’s goals of protecting human rights and building a prosperous society. To assist minority areas to realize the right to development, China’s Constitution, laws, administrative regulations and policy documents define the State’s constitutional obligations. There also exists a legal and policy support system to help the minority areas to achieve economic and social development through measures such as transfer payments, assistance to Tibet and Xinjiang and counterpart support for poverty alleviation. However, China is also faced with the difficult challenges of poverty reduction, development, unbalanced regional development and other issues in assisting ethnic minority groups to realize the right to development.

Study on Tourism Development and Community Participation in Villages of the Minorities ——With the Dong Village in Zhaoxing,Southeast Guizhou Autonomous Prefecture of Miao and Dong Nationalities,China

Based on basic theories of community participation in tourism development,questionnaires were designed for the field investigation in one of the largest Dong Villages in China,the Dong village in Zhaoxing.Community participation in tourism development of the Dong Village was analyzed from the perspectives of residents' participation in decision-making and management,reception and catering services,group performance,making and selling ethnic artworks,protection of village tourist resources and environment.And meanwhile,problems were pointed out as "still maintaining in the early stage of its tourism development,fewer opportunities for its residents participating in tourism development,resource protection being divorced from tourism benefits and so on",on the basis of which corresponding solutions were offered as "expanding the field of participation,improving the level of participation,increasing benefits of local residents;insisting on the principle of "not participating intentionally is the best way of their participation,guaranteeing economic compensation for rural residents;enhancing infrastructure construction;establishing a museum of folk-custom materials;creating a favorable atmosphere of folk cultures;enhancing cooperation with its neighboring villages in tourism development,and creating a "local industrial chain";establishing a research center of cultural tourism development of the Dong Minority.

A Study on Innovation Mode of Tourism Development in Minority Village

It was of vital significance for sustainable development of tourism in minority village to explore tourism development mode suitable for minority village.Based on comparison of development,characteristics,advantages and disadvantages of three modes which were Suoga mode,Shenzhen folk village mode and Langdeshang Village mode,it was considered that the contradiction between development of minority village economy,protection of national traditional culture and guarantee of villagers' benefits hadn't been radically eliminated in the three modes.In view of this,5Cs mode had been proposed which were culture,company,characteristics,community and concord;and running mechanism of 5Cs mode had been constructed,that is,environmental protection and cultural inheritance;government's guidance and company's leading;theme positioning and characteristic highlighting;community power-increasing and villagers' profit-obtaining;economic development and community harmony.

Study on the Tourism Development in Micro Settlements of Ethnic Minorities

Through comprehensively analyzing the development status and existing problems of tourism resources in micro settlements of ethnic minorities,this study aimed to put forward the significance of promoting economic development through primarily developing tourism industry in these areas,and relevant countermeasures to culture feature tourism into the 'growth point' of economy,so as to promote the economic development of ethnic minorities' settlements and the realization of a prosperous society in an all around way.

Construction of China Osmanthus City and Intellectual Property Right Protection in Xianning City in the Context of Three New Developments

Xianning City of Hubei Province is one of the five major traditional osmanthus producing areas in the world and the hometown of osmanthus in China. Xianning is constructing China Osmanthus City in the whole city. This paper first introduces the main characteristics of the osmanthus industry in Xianning City, and analyzes the characteristics of traditional knowledge, biological genetic resources, new plant varieties, patents, geographical indications, and trademarks. Then, it studies the intellectual property resources of the osmanthus industry, and analyzes the main problems existing in the construction of China Osmanthus City and intellectual property right protection. Finally, it comes up with constructive recommendations including applying for China and Globally Important Agricultural Heritage Systems, developing colored-leaf osmanthus varieties, creating a regional public brand of osmanthus specialty products, and building a new development pattern of osmanthus industry.

The Right to Carbon Emission: A New Right to Development

For the past few years, the international community has regarded the right to carbon emission as a new right to development. The legal basis of this mainly includes “the United Nations Framework Convention on Climate Change”, “the Kyoto Protocol” as well as the sustainable development principle, the principle of common but differentiated responsibilities and the principle of fairness and justice, etc. The distribution of the right to carbon emission of the post-Kyoto age should consider the need of development, population, historical responsibility, the principle of fairness and justice and other factors. As a dominant country of greenhouse gas emission, on the premise of sticking to “the principle of common but differentiated responsibilities”, China should achieve the transformation from the “difference principle” to “common responsibilities” progressively. Meanwhile, in strengthening coordination with developing countries, China should appropriately support the requests of the Alliance of Small Island States and the least developed countries and attach importance to the issue of the right to development in the distribution of the right to carbon emission.

Inheritance,Innovation and Development of Wuling Mountain Area in Hubei Province Based on Intellectual Property Rights

Using the methods of field survey and literature collection,this paper firstly introduces the intellectual property resources of the Wuling Mountain Area in Hubei Province from folk literature and arts,traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,and trademarks.Then,it analyzes the main problems in the protection and inheritance,innovation and development of intellectual property rights(IPRs).In addition,it discusses the strategy of inheritance,innovation and high-quality development of this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with recommendations including carrying forward and inheriting folk literature and art,protecting traditional knowledge of traditional craftsmanship,inheriting and innovating to develop traditional Chinese medicine and ethnic medicine,improving the protection and use of geographical indications,and strengthening the IPR protection.

Following the Charter of the United Nations: The Basic Guarantee for the Realization of the Right to Development——From the Perspective of Transforming Our World: the 2030 Agenda for Sustainable Development

This study discusses the basic guarantee of the Charter of the United Nations to realize the right to development from the angle of Transforming Our World: the 2030 Agenda for Sustainable Development. The concepts regarding the people as the focal point, the dignity, the worth of the human being, as well as larger aspects of freedom, and other basic concepts within the Charter of the United Nations, guide the right direction of action for the realization of the right to development. The purpose and principles of the United Nations establishment in the Charter constitute the basic legal protection of the right to development. Values of peace, international dialogue, and international cooperation show the right path to the realization of the right to development.

China-US High-Tech Competition,Trade Conflict and Development Rights

The power and interest of industrial manufacturers are determined by their status in the relations of production.At the international level,countries see their economic and political status rise only when they climb the ladder in the international division of labor.As the primary production forces,science and technology are the main drivers behind such change.As new technologies give rise to new industries and restructure the international division of labor,developed countries strive to enhance the protection of their intellectual property rights(IPR)and safeguard their monopoly over core technologies.For developed countries,technological prowess holds the key to their supremacy in the global supply chain and international relations.The 19 th CPC National Congress makes clear the overarching goal in the new era is to rejuvenate the Chinese nation and turn China into a strong modern country.As an important material condition for achieving this goal,China must transition from being medium-and low-end links in the international division of labor to becoming high-end links.In this process,China will encounter backlash from developed countries that lead in the international division of labor.The recent China-US tussle over trade in high-tech goods is a case in point,and should be viewed through the lens of the relations of production and the international division of labor.The insights thus achieved will be of great significance to China’s future development.

The Relationship between Human Rights and Development——A Brief Analysis of the Perspectives of Chinese Scholars and the Practice of Chinese Government

With the change and development of the concept of human rights, the thinking about the relationship between human rights and development is becoming more and more deeply. Under this background, the author profoundly realizes that both recognizing the economic development as the first priority like some developing countries do and considering the human rights to be the most important thing as most developed countries do are unilateral and harmful to the social progress. Human rights and development are interdependent and mutually promoting each other. This paper introduces the three main viewpoints of the relationship between human rights and development. Based on the changes of the attitudes of the UN and China to the relationship between human rights and development, this paper holds that though it is a great progress for the Chinese government to understand that human rights and development are interdependent, there are still lots of difficulties in realizing their mutually benefiting relationship in reality. These difficulties are due to the lack of professionals who enjoy good understandings of the rules for social development and are capable of practicing human rights theories. Therefore, the authors suggest that the promotion of human rights education is instrumental to the development and progress of human society.

The Conflict and the Balance between the Right to Development and the Right to the Environment——Perspective and Reflection Based on China

The right to development and the right to the environment are both third generation rights, closely related to human development and world peace. For developing countries, there is a de facto conflict between the right to development and the right to the environment, which leads to serious consequences. To coordinate development and the environment, developing countries should shift their pattern of development, take the path of sustainable development and realize environmental protection and ecological balance while promoting economic growth.

The Declaration on the Right to Development as a First Step towards a Comprehensive Southern Vision on Human Rights

Having proper sanitation and hygiene, access to affordable health care and enough food on the table are the basic conditions for a dignified life. This link between human dignity and the right to development was made very persuasively already in the White Paper on human rights, issued by the State Council of P.R.C. in 1991. The Declaration on the right to development can be considered the first successful joint action undertaken by Southern states in the area of human rights. The Declaration was based on Southern scholarship, such as the pioneering research conducted by the Senegalese jurist Kéba M’baye. And its adoption was the result of joint stage management performed by diplomats from different continents. Therefore the Declaration serves as a source of inspiration for the work of drafting a Comprehensive Southern Vision on human rights. The Vision document will lay out a common Southern outlook on human rights issues as an elaboration of the Universal Declaration.

Minority population and sustainable development in mountain regions a case study of the Tibetan inhabited region in Sichuan, China

China boasts 56 nationalities who are mostly inhabited in the sparsely populated mountain regions in West China. Like many other places in the Han nationality distributed regions, minority nationality inhabited regions are also facing the challenge of sustainable development in terms of both natural and human factors. Taking the Tibetan inhabited regions (TIR) in Sichuan Province as a case, this paper points out some major problems in the process of economic development in perspective of sustainability and leaves some hints for development strategies. While natural conditions such as geological instability are playing a major role to the environmental degradation, human activities and improper use of resources might constitute an important agent in the environmental deterioration. In order to promote local economic development and improve people’s living standard, sustainable planning is expected to be made and people’s awareness of sustainability should be strengthened.

The Contribution of the Belt and Road Initiative to the World's Right to Development

The Belt and Road Initiative makes an important contribution to the right to development in theory and practice in the current world. Since the reform and opening-up, the Chinese government puts the rights to subsistence and development before any other human rights, which effectively guarantees and accelerates a rapid economic development in China. Nowadays, countries along the Belt and Road have joined a "community of common destiny". Inside the "community of common destiny," countries have enjoyed not only the responsibility, rights and benefit of the right to development, but also a win-win cooperation that ensured the right to development. Therefore, the Belt and Road initiative enriches the UN Declaration on the Right to Development, and "community of common destiny" of countries becomes a higher form of the right to development.
