以人民为中心的发展思想日益成为主导基层治理的逻辑,在北京市接诉即办工作不断深化改革的基础上,以北京市平谷区“下交群评”工作为例,探索党建引领多元主体参与社会治理的机制,并重点关注如何引导群众成为基层治理的主体。研究发现,“下交群评”通过治理主体的组织嵌入化、治理单元的熟人社会化、治理规则的崇公抑私化、治理机制的交互整体化形塑了新时代“三治融合”的实践机制,为系统治理和源头治理提供了重要保障;从接诉即办的倒逼式治理到主动性治理,再到自主性治理,人民群众真正成为治理问题的发起者、治理过程的参与者、治理成效的获得者、治理情况的监督者。这是全过程人民民主的生动实践,体现了基层正在从被动的市民诉求驱动迈向人民主体性的治理。

基层人民法院诉源治理的理念革新与路径优化

经过几年的实践,基层人民法院诉源治理取得了积极进展和重要成果,但也呈现人民法院的职能与界限缺乏清晰性、角色和职能存在模糊性、人民法院事实上成为诉源治理的主导者、诉前治理异化等诸多困境,因此有必要革新基层人民法院诉源治理的基本理念。应该看到:诉源治理进程不是“一条线”,而是“一个圆”;诉源治理的根本目标不是解决法院“案多人少”问题,而是纠纷的终极化解;诉源治理旨在进一步加强纠纷解决的多元性。据此,基层人民法院诉源治理应重点通过审判实质化解纠纷,着力完善纠纷“诉前调解”机制,积极融入构建诉源综合治理大格局,充分发挥人民法庭化解乡土纠纷的前沿阵地作用,提速智慧法院建设。

数字经济与民生协调发展:数字政府的调节作用

数字经济突破性创新对民生发展带来错综复杂的影响,给治理体系和治理能力提出了新的要求。数字政府建设是政府对经济演进到数字形态的自我适应,有望成为政府有效应对数字经济发展带来的民生挑战的破局之策。然而,目前从理论和实证层面深入探究数字政府、数字经济和民生三者之间关系的研究尚较为缺乏。本文从理论上梳理数字经济对民生发展的影响机制以及数字政府在保障数字经济促进民生发展中的作用机制。在此基础上,以中国城市为研究对象,利用面板数据固定效应模型和工具变量法进行实证分析。研究结果显示中国数字经济在起步阶段对民生发展的影响以促进作用为主,异质性分析结果显示数字经济对民生发展的促进作用在西部地区最大、东部地区次之、中部地区最小;数字政府在数字经济促进民生发展中起到正向调节作用。研究发现能为新时代数字政府在数字经济与民生协调发展中发挥重要作用提供理论和实践依据。

世界百年未有之大变局下,中国治理体系与治理能力现代化水平的提高,彰显出中国式现代化的突出优势。相较于西方,中国式现代化以多元现代观为基本前提,超越了西方现代化一元统治的格局;以人民至上为根本遵循,将民生福祉置于资本增殖逻辑之上,超越了西方现代化资本至上的价值立场;以独特的政治优势、完善的制度架构和高效的运行模式展现实践伟力,超越了西方现代化盲目追求资本扩张的实践困境。中国式现代化道路的开创,打破了后发国家对西方现代化模式的依赖,拓宽了世界各国走向现代化的路径,具有广泛的世界意义。

在新发展阶段,无论是为应对复杂不确定的国内外发展环境而构建以国内大循环为主体的新发展格局,还是积极应对日益严峻的少子老龄化形势,都需要充分发掘民生服务的基础性、战略性作用。民生领域出现的“难”“贵”“烦”等社会问题,正是民生服务有效供给不足、作用尚未充分发挥的集中反映。强调依靠改革的办法促进供给灵活适应需求的供给侧结构性改革,是破解民生服务有效供给不足难题的有效途径。为此,必须直面重点民生服务领域存在的突出问题,积极践行以人民为中心的发展思想,深化供给侧结构性改革,加快建设包容性制度体系与政策生态,采取包容审慎性监管体制与方式,有效调动各类主体的积极性,全面推进不同性质与类型的民生服务包容性发展与治理。

预算绩效管理是加强财政收支管理、提高财政资金使用效益的重要手段,也是加快建立现代预算制度的必由之路,更是提高政府治理能力和水平、推动高质量发展的重要保障。笔者以政府治理能力的内涵为切入点,从经济、政治、社会三个维度探讨了预算绩效管理改革影响政府治理能力的内在逻辑,论证了实施预算绩效管理改革所取得的预期成效,提出了“双动力”“内外力”和“三方面”三条路径来提高政府经济、政治和社会民生治理能力,为我国全面推进预算绩效管理改革、进一步深化预算管理制度改革提供理论指引,助力地方政府治理能力提升。

研究基于民生科技对城市社区建设在社区安全、节能环保、健康卫生、生活便利和学习交流等方面发挥的功能和作用,提出民生科技在城市社区建设中体现贡献绩效的主要因素,建立城市社区民生科技贡献绩效评价指标体系,并采用D-S理论的分析方法,通过算例对天津市华苑社区民生科技的贡献绩效进行评价,为民生科技在城市社区的绩效评估提供支撑。

《地方组织法》调整对象的重塑与结构优化

为适应改革开放初期民主法制建设需要,1979年《地方组织法》在确定调整对象时采取了“扩张性”策略,“有法可依”成为当时立法的首要价值需求。国家机构相关法律规范体系建立和完善后,《地方组织法》立法功能与其他法律开始出现重合,对法律的稳定性和国家法制统一造成挑战,“扩张性”的调整对象面临重新检视和策略调整。《地方组织法》调整对象的重塑,应在厘定相关法律调整对象基础上,排除替代性立法功能,以实现国家机构法律规范体系的时代自新和协调统一。
