Human Rights and Development:China's Contributions Based on a Larger Concept of Human Rights

The Western liberal view of global governance can no longer effectively address the challenges facing the world today or respond to the demands of developing countries in the fields of human rights and development.Meanwhile,the United Nations human rights and development agenda also has its limitations.Against such a backdrop,China's path of human rights development has avoided the trap of human rights confrontation and the clash of civilizations.It has set an example of complementarity and positive interaction between human rights and development by unifying collective human rights with individual human rights and integrating the universality and particularity of human rights.Xi Jinping,general secretary of the Communist Party of China(CPC)Central Committee,delivered a speech at the 37th group study session of the Political Bureau of the CPC Central Committee on China's Path of Human Rights Development.This elevated China's human rights development to a new historical height.Practice has proved that China's concept and path of human rights in the new era have not only effectively promoted the development of its human rights cause,but also contributed Chinese wisdom to the global cause of human rights and development with a larger concept of human rights.Under the framework of the concept of building a community with a shared future for mankind,the Belt and Road Initiative,and the Global Development Initiative,China has contributed to enhancing the discourse power of developing countries in human rights and building a fairer,more just,more reasonable and more inclusive system for global human rights governance.

Pioneering a New Realm of Human Rights Civilization in the Chinese Path to Modernization——An Overview of the Symposium on“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”

On October 14,2023,a symposium themed“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”was held in Changchun,Jilin Province,China.More than fifty experts,scholars,and researchers from national institutions and universities engaged in discussions and exchanges on human rights on the Chinese path to modernization,including the path,practice,knowledge systems,and civilization forms of human rights.This symposium played a significant role in advancing the construction of the disciplinary system,academic system,and discourse system of human rights in China.

Impacts of Changes in Structure of Rural Land Property Rights on Agricultural Performance

In the reform process of the rural land property rights system,the incentive mechanism of the rural land property rights system has a crucial impact on the production activities of rural economic entities.Due to the different rights structures of the property rights system in different social and economic development stages,the land rights and interests enjoyed by rural economic subjects are different,and the degree of incentives for farmers is also different.This difference in incentives affects farmers investment in agricultural production factors,which in turn affects agricultural performance.This paper analyzes the incentive impacts of the structure of rural land property rights on the changes of farmers land rights and agricultural performance since the founding of the People s Republic of China,in order to further deepen the reform of the land system,protect the rights and interests of farmers,promote the modernization of agriculture and rural areas,and explore the realization form and operation mechanism of the rural collective land system in the new era.

Research on the Impact of Digital Transformation on the Business Performance of Commercial Banks

Nowadays,with the development of the digital economy,commercial banks are actively conducting digital transformation.Studying the impact of the digital transformation of commercial banks on their operating performance can help commercial banks form a stronger core competitiveness and promote high-quality financial development.Based on the above background,this article first describes the status and development of digital transformation and development of commercial banks,and secondly analyzes whether Chinese commercial banks’digital transformation is conducive to improving their operating performance.Thirdly,by selecting the data of the listed commercial banks in the ten years of 2012–2022,this article obtains the empirical testing of the digital transformation on different property rights.Finally,the higher the level of digitalization,the higher the digital level,the more significantly promotes the performance of commercial banks.Finally,based on the above analysis,this article puts forward feasibility opinions on commercial banks and related regulators.

Constructing China’s Human Rights Science:Cause,Cognition,and Paradigm

“China’s Human Rights Science”is undoubtedly a brand-new concept.Just as China has its own philosophy,literature,history,law,political science,and sociology,it should also have its own human rights science.China’s Human Rights Science refers to the cognitive science of human rights in China.Developing its disciplinary system,academic system,and discourse system,and constructing an independent Chinese human rights knowledge system,are essential requirements for promoting the great rejuvenation of the Chinese nation through Chinese modernization and creating a new form of human civilization.China’s Human Rights Science originated in China,grew in China,and deepened through China’s human rights practices.China’s Human Rights Science adhere to the universality of human rights principles and possess distinctive characteristics.It works as the knowledge-based organization,academic refinement,and theoretical expression of the path of human rights development that conforms to the trend of the times and suits China’s national conditions,as pursued by the Communist Party of China in leading the people.China’s Human Rights Science can enrich and develop the theory of human rights civilization,and should become a global public product of human rights.

The Core of the Chinese Democracy Is to Respect and Protect Human Rights——A Summary of the Academic Seminar on Chinese Democracy and Human Rights Protection

On March 26,2023,a Seminar on Chinese Democracy and Human Rights Protection was held,jointly organized by the National Human Rights Education and Training Base and the Human Rights Research Center of Central South University under the guidance of the Chinese Society for Human Rights Studies.The event adopted a combination of online and offline channels.Over 30 experts and scholars from universities,research institutions,and practical departments across the country participated in extensive discussions on“Theoretical and Practical Aspects of Chinese Democracy and Protection of Human Rights.”The seminar aimed to focused on the essence,characteristics,advantages,and human rights implications of Chinese democracy and interpreted the concept of Chinese democracy and the protection of human rights through academic and theoretical methods.

Human Rights in China:Exploration and Development of Whole-process People’s Democracy

Whole-process people’s democracy represents a new exploration of socialism with Chinese characteristics for a new era as well as a novel and important method for protecting the human rights of the Chinese people.It is conducive to solving a multitude of problems hindering the protection of civil rights and political rights.The greatest highlight of whole-process people’s democracy is that the people are the masters of their own country and exercise the power to govern the state through“extensive participation and consultation.”China’s experience and approaches in advancing whole-process people’s democracy provide a reference for other countries.

Political Connection, the Nature of Property Rights, and Enterprise M＆A Performance——Empirical Study based on the Panel Data of Listed Companies

Mergers and acquisitions （M＆A） are the important methods to quickly acquire external resources, achieve the economies of scale and the economies of scope, improve market share, and expand the scale of enterprise, while M＆A performance is an important index to measure if enterprise M＆A is successful. In this paper, the influence of entrepreneurs＇ political connection on the M＆A driving factors and M＆A efficiency of the enterprises with different property rights are analyzed using 357 mergers and acquisitions of China＇ s 189 listed companies in 2005-2011 as samples based on the distinction between political connection and the nature of enterprise property rights. The results show that the political connection plays a very significant positive influence on the M＆A performances of the central state-owned enterprises and private enterprises, but exerts a very significant negative influence on the local state-owned enterprises; the intensity of entrepreneurs＇ political connection also plays a certain influence on enterprise merger and acquisition, and the central political connection and the local political connection are significantly different in the influence on the enterprise M＆A performance.

This shows the full affirmation and trust in the university＇s education, research and training work and also represents encouragement for its future work.

To Actively Perform the Judicial Administration Function and Promote the Development of Cause of Human Rights

Respect for human rights and protection of human rights are significant rules in the Constitution of the People’s Republic of China.In 2015,judicial administration departments at all levels legally exercised their duties,implemented the principles and rules in constitution,and kept strengthening propagation of human rights through creation of contents and methods which had acquired great effects.What they have done contributes significantly toward the development of human rights in China.

ESG表现与企业高质量发展:理论分析与实证检验

选取2010-2022年中国沪深A股上市公司数据,采用华证ESG得分衡量ESG表现,基于“双碳”目标对ESG表现与企业高质量发展之间的作用机制进行研究。研究结果显示,良好的ESG表现可以促进企业高质量发展,且主要通过获得更高的政府补贴助力企业的高质量发展。进一步研究发现,数字化转型可以正向调节ESG表现对企业高质量发展的促进作用;异质性结果表明,ESG表现对企业高质量发展的积极影响在国有企业中更为显著。

高速S-CO_(2)向心透平几何参数优化及变工况特性分析

透平是热力循环中实现热功转换的核心设备,优化透平几何参数以改善气动性能,是提升系统热效率的关键。该文以面向某船舶主机烟气余热利用的超临界二氧化碳布雷顿循环透平设计参数为基础,给出向心透平主要几何参数,采用耦合CO_(2)真实物性参数的CFX仿真方法,分析几何参数动、静叶包角以及叶轮出口几何角对透平性能的影响规律并进行参数优化,进一步研究非设计工况下的透平运行特性。结果表明:增大静叶包角会使动叶前缘出现扰动涡流并减少余速损失,增大叶轮出口几何角,动叶包角对透平效率的影响规律不变,但效率峰值点会沿动叶包角减小的方向移动;动、静叶包角和叶轮出口几何角分别为49°、21.5°、25°时透平设计点总-静等熵效率高达87.99%,相比优化前,提高0.54个百分点;透平偏离设计点±20%工况下等熵效率大于80%。结果可为超临界二氧化碳高速向心透平设计提供一定参考。

Ⅰ导联R/(R+S)对胸前V3导联移行流出道室性心律失常起源部位的鉴别价值

目的:探索鉴别胸前V3导联移行流出道室性心律失常(OT-VA)起源部位的体表心电图指标。方法:连续选择2017年1月至2022年8月行导管射频消融术的胸前V3导联移行OT-VA患者65例。比较左室流出道起源组(LVOT组)和右室流出道起源组(RVOT组)室性心律失常发作时体表心电图QRS波振幅及相关指标的差异,选择差异有统计学意义的指标,绘制ROC曲线评价所选取指标鉴别OT-VA起源部位的效能。结果:LVOT组11例,RVOT组54例,两组间差异有统计学意义且ROC曲线下面积(AUC)最大的指标为Ⅰ导联R波/(R+S)波振幅比[R/(R+S)],其鉴别OT-VA起源部位的AUC(95%CI)为0.949(0.894~1.000),截断值为0.50。Ⅰ导联R/(R+S)<0.50诊断胸前V3导联移行LVOT起源OT-VA的敏感度、特异度和准确度分别为0.909、0.944和0.938。结论:Ⅰ导联R/(R+S)<0.50可准确鉴别LVOT起源的胸前V3导联移行OT-VA。

深水采油树Spring-Seal密封圈接触模型构建与实验测试

为提高深水采油树在高压、高温、低温等工况下长时间工作的稳定性,对采油树密封圈进行重新设计,提出Spring-Seal密封圈(以下简称S密封圈);基于赫兹接触理论、填料密封接触理论,重新构建S密封圈接触力学模型;建立有限元仿真分析模型,分析不同条件下S密封圈的密封性能,同时验证新建接触模型的合理性;利用实验测试S密封圈的实际密封效果。研究结果表明:S密封圈在高压、高温、低温等工况下能够长时间稳定工作且密封性能良好。研究结果可为S密封圈的接触研究及工程运用提供理论参考。

D-S理论和Markov链组合的桥梁性能退化预测研究

为准确预测桥梁性能退化,考虑到数据随机性和微小扰动发生状态跳跃,提出了一种D-S(Dempster-Shafer)证据理论和Markov链组合的桥梁性能退化组合预测模型和性能退化率的概念.该模型基于指数平滑(exponential smoothing,ES)方法获得新的预测数据序列,并利用Markov链和D-S理论不断进行优化,从而实现桥梁性能退化的组合预测.实际工程的应用结果表明:性能退化率可以直观地表征在梁性能退化的速度.其次,该模型的平均相对误差为1.54%,较于回归、灰色和模糊加权Markov链模型,精度分别提高了1.11%,0.88%和2.8%,而后验差比值为0.242,小于0.35;模型的标准差为9.021,相比其他模型分别减小了3.978,3.405和7.500,而变异系数为0.109,均小于其他模型,验证了组合预测模型在精度和稳定性方面的优越性,可为在役桥梁结构性能退化预测与维护提供理论基础.

高效液相色谱法测定纺织品中四溴双酚S

建立了一种以磁固相萃取纺织品中四溴双酚S,再利用高效液相色谱分析的方法。试验以Fe_(3)O_(4)-GO磁性材料为磁性固相吸附剂,并采用正交试验对萃取过程中的萃取剂用量、温度和时间等因素进行优化,再以0.1 mmol甲酸-乙腈(V∶V=30∶70)为流动相,采用Athena C18-WP柱(2.1 mm×100.0 mm,5.00μm)分离,检测波长214 nm,外标法定量。结果表明,在0.01~50.00 mg/L范围内四溴双酚S线性良好,相关系数R^(2)>0.999,加标回收率达到98.6%~101.5%,相对标准偏差(RSD)小于5.0%(n=6)。该方法高效、简单、灵敏,能够满足纺织品中四溴双酚S的检测。

基于S-CAD方法的宅基地“三权分置”改革试点政策评估——以新疆试点市县为例

采用S-CAD政策评估方法对新疆宅基地“三权分置”政策试点地区伊宁市和奇台县的政策执行效果进行评价,研究发现伊宁市和奇台县两试点政策整体逻辑一致性较好、政策要素之间具备充分性与必要性,利益相关者支持程度较高,有效实现了宅基地“三权分置”改革的政策目标,但仍存在政策手段与政策目标充要性不足,预期政策效果与实际政策效果有一定偏差等问题。针对此,提出宅基地“三权分置”改革政策应适应城乡融合发展趋势,加强农户利益保障机制建设;坚持因地制宜,创新农村宅基地“三权分置”改革思路;兼顾多方利益与公平,提升综合价值效应的建议。

政府影响力、决策权配置与企业ESG表现——基于企业集团的经验证据

文章以2010—2021年A股上市公司为研究样本,实证检验决策权配置对企业ESG表现的关系、具体机制路径以及政府影响力(以产权属性和政府控制层级为表征)的异质性作用。研究结果发现,企业集团决策权配置通过发挥资源效应及治理效应显著提高企业ESG表现,随着政府影响力的加大,决策权配置与企业ESG表现之间的正效应越强。进一步经济后果检验表明,决策权集中配置下企业ESG表现的提升能够显著提高企业全要素生产率和企业价值。研究认为应合理配置母子公司间权限,充分发挥国有企业尤其是央企带头领导作用,践行ESG理念,赋能企业高质量发展。

Experimental study on the shear performance of quasi-NPR steel bolted rock joints

Quasi-NPR(negative Poisson’s ratio)steel is a new type of super bolt material with high strength,high ductility,and a micro-negative Poisson’s effect.This material overcomes the contrasting characteristics of the high strength and high ductility of steel and it has significant energy-absorbing characteristics,which is of high value in deep rock and soil support engineering.However,research on the shear resistance of quasi-NPR steel has not been carried out.To study the shear performance of quasi-NPR steel bolted rock joints,indoor shear tests of bolted rock joints under different normal stress conditions were carried out.Q235 steel and#45 steel,two representative ordinary bolt steels,were set up as a control group for comparative tests to compare and analyze the shear strength,deformation and instability mode,shear energy absorption characteristics,and bolting contribution of different types of bolts.The results show that the jointed rock masses without bolt reinforcement undergo brittle failure under shear load,while the bolted jointed rock masses show obvious ductile failure characteristics.The shear deformation ca-pacity of quasi-NPR steel is more than 3.5 times that of Q235 steel and#45 steel.No fracture occurs in the quasi-NPR steel during large shear deformation and it can provide stable shear resistance.However,the other two types of control bolts become fractured under the same conditions.Quasi-NPR steel has significant energy-absorbing characteristics under shear load and has obvious advantages in terms of absorbing the energy released by shear deformation of jointed rock masses as compared with ordinary steel.In particular,the shear force plays a major role in resisting the shear deformation of Q235 steel and#45 steel,therefore,fracture failure occurs under small bolt deformation.However,the axial force of quasi-NPR steel can be fully exerted when resisting joint shear deformation;the steel itself does not break when large shear deformation occurs,and the supporting effect of the jointed rock mass is effectively guaranteed.

售货机升降系统S型速度控制策略

在传统三闭环控制方式下,售货机升降接货系统易因启停过程中加速度突变产生冲击,导致系统运行不平稳。针对这一问题,文中对传统升降系统加减速控制策略进行改进,加入前馈和微分负反馈,提出一种S型速度曲线控制算法。根据路径规划判别条件将S型速度曲线分为七段式、六段式和四段式3种,并给出各路径约束条件下的参数求解方法和具体执行流程。将该算法运用到升降控制系统中进行仿真和实际工况测试,实验结果表明,与传统三闭环控制相比,文中所提控制策略可以提高售货机升降系统运行的平稳性,减小冲击,使速度曲线更加柔和,并能够保持较好的跟踪性能。
