A potential global power transition characterized by emerging economies of BRICS where China is the likely leading contender against the United States as the only global hegemon seems inevitable.The increasingly multi...A potential global power transition characterized by emerging economies of BRICS where China is the likely leading contender against the United States as the only global hegemon seems inevitable.The increasingly multipolar world is evidenced by the attention given to right-wing populism in Europe and USA attributed to China’s aggressive approach to international trade through its stealth entry and subsequent investments in global political-economy.China’s presence in Africa and Trump’s America first policy’s attempt to open“new business frontiers”in emerging economies of Asia and Africa in order to contain Chinese influence and threat in global hegemony are interesting happenstances that require closer scrutiny.Kenya,the biggest economy in East Africa,which is among the fastest growing regions globally,is the gateway to the East African Common Market.Historically,Kenya has a policy of non-alignment in international relations making it possible to receive FDI from both China and the US but with highly contested elections.Therefore,Kenya presents a perfect laboratory for examining the emerging power-shift in global political-economy as the country grapples with traditionally chaotic electoral power transitions and the two biggest economies in the world compete for business in Nairobi.The 2017 elections not only betrayed the international community’s commitment to Western values of human rights and democracy,but also revealed the challenges of governance in post-World War II global liberalism characterized by sophisticated media institutional spaces.展开更多
The International Covenant on Civil and Political Rights reflects the world’s perception of human rights, and is of vital importance in the field of international human rights. The Covenant has been signed by Chinese...The International Covenant on Civil and Political Rights reflects the world’s perception of human rights, and is of vital importance in the field of international human rights. The Covenant has been signed by Chinese government. Although not ratified yet, it will definitely have an impact on the reform of China’s Criminal Law. Therefore, it is necessary to further change our notion of the criminal law system by defining the boundary between public power and civil rights and developing the view of human rights protection. In terms of the specific system, it is necessary to further reduce the number of crimes punishable by the death penalty and limit the application of the death sentence, improve China’s Criminal Procedural Law to protect the fundamental rights of suspects and defendants in terms of compulsory measures, investigation means and judicial form, and add some charges like enslavement and illegal human experimentation, which are criminalized around the world, so as to be in line with the requirements of international human rights protection.展开更多
Today,we are witnessing a profound transformation of the dominant model of representative democracy which is increasingly giving way to a new form of democracy of the public,as Bernard Manin defined it.In a democracy ...Today,we are witnessing a profound transformation of the dominant model of representative democracy which is increasingly giving way to a new form of democracy of the public,as Bernard Manin defined it.In a democracy of the public,parties tend to personalise themselves,becoming machines serving one particular person,who embodies public feelings.Participation and social organization within the territory are progressively replaced by a widespread communication and social media framework where the citizens become just passive spectators.To this,we must add that the spectacularisation of the current democratic systems,adopted to satisfy the audience,leads to negative effects on the protection of fundamental rights.This article will analyse the aspects that characterise the democracies of the public,and their social and legal effects on the consideration of human rights.The article goes further without being limited to this issue.In fact,it wants to emphasise the way human rights are crucial to bolstering democracies,rather than merely the other way around.Doctrines and politics have frequently emphasised the need for democracy,and,more specifically,the export of democracies to advance human rights.Contrarily,a shift in perspective is required in order to preserve liberal democracies.展开更多

In many cases, they bring their religion with them--as Muslim women, Yezidi women or as Christian women, alone or with their children and their families. Seeking refuge is a process of change for themselves as well as for the European societies. What kind of experiences do women gain during and after their flight? Are there experiences that are specific to women? The insights into the reality of fleeing women lead to existential philosophical reflections. Hannah Arendt's definition of humanity and the right to have rights is relevant to current migrants' experiences. Intersectionality examines the multiple discriminations and social inequality of women seeking asylum in Europe. On the basis of political theory Seyla Benhabib clarifies that the right to have rights is inexorably dependent on whether social acceptance has been granted or not. To analyze these questions, the requirements of and advantages to European societies must be defined. And how can this line of inquiry be used to develop a politically motivated theology?展开更多
Institutional reform and social changes in northeast China during the late Qing period are usually attributed to the Qing dynasty changing its policy on immigration to northeast China.However,institutional reform beca...Institutional reform and social changes in northeast China during the late Qing period are usually attributed to the Qing dynasty changing its policy on immigration to northeast China.However,institutional reform because of debt appeals between civilian creditors and the Mongolian princes is often overlooked.Using administrative cases from Fengtian Governor Archives and Kirin Prefecture Archives,this study identifies how the governor officers of northeast China changed Mongolian land rights and official finance institutions through appeal judgments in the late Qing dynasty.Appeals were related to Mongolian land rights reform and promoted the financial institutional reform in northeast China.This study concludes by arguing that the judgments affected the profits of the litigants and changed the local society.展开更多
