The Connotations of the Constitutional Clause on Human Rights Protection From the Perspective of Foreign-related Rule of Law

The inclusion of the human rights clause in the Chi-nese Constitution is the core normative manifestation of the constitu-tionalization of human rights,and points to the relationship between international law and the Constitution in the sense of positive law.The inclusion of the human rights clauses in the Chinese Constitution itself is an inherent part of the development of China’s socialist constitution,and socialism has already contributed valuable concepts and practices of human rights protection to the modern world in its early stage.The constitutionalization of human rights protection does not necessarily lead to the superiority of international law over the constitutional order of a country,but rather to the convergence of international law and domestic law through the constitutional order.The relevant rules of international law will be effective only when they are transformed into domestic law through the Constitution and the human rights clause in the Constitution.Correspondingly,the domestic legal order is brought into line with the international legal order through the Con-stitution and its human rights clause.Behind the system of fundamen-tal rights in the constitutional order is the value foundation of the en-tire legal system.The advancement of foreign-related rule of law has brought new opportunities for China’s judicial practice to further pro-mote the protection of human rights.In the future,we should further integrate the human rights values embedded in socialism into China’s constitutional practice,enhance human rights protection around the country,and take a more active part in global human rights gover-nance.

Conflict： Efficient State or State Under the Rule of Law？-- The Hungarian Case of the Victory of the Efficient State over the State Under the Rule of Law

This study is seeking an answer as to whether the efficient state and the state under the rule of law are indeed irreconcilable, as well as to whether these two categories are by nature to be seen as contrary concepts. The basic issue is whether efficiency is to be handled as an ＂extralegal＂ category, or whether legal regulation, in accordance with public administration traditions in Europe, can in itself meet the requirement of efficiency. Also the study presents the formation of the issue of conflict between the effective state and the state under the rule of law in Hungary after the election held in 2010 in the practice of economic policy and legislation of the Orban government. We are trying to answer the question of the tendency of power concentration to really menace the principles of a traditionally-formed state under the rule of law, as well as whether the economic policy of the government can be implemented effectively in a strongly centralized political and state administrative system.

A compositional model for CO_(2) ooding including CO_(2) equilibria between water and oil using the Peng–Robinson equation of state with the Wong–Sandler mixing rule

This paper presents a three-dimensional, three-phase compositional model considering CO2 phase equilibrium between water and oil. In this model, CO2 is mutually soluble in aqueous and hydrocarbon phases, while other components, except water,exist in hydrocarbon phase. The Peng–Robinson(PR) equation of state and the Wong–Sandler mixing rule with non-random two-liquid parameters are used to calculate CO2 fugacity in the aqueous phase. One-dimensional and three-dimensional CO2 flooding examples show that a significant amount of injected CO2 is dissolved in water. Our simulation shows 7% of injected CO2 can be dissolved in the aqueous phase, which delays oil recovery by 4%. The gas rate predicted by the model is smaller than the conventional model as long as water is undersaturated by CO2, which can be considered as 'lost' in the aqueous phase. The model also predicts that the delayed oil can be recovered after the gas breakthrough, indicating that delayed oil is hard to recover in field applications. A three-dimensional example reveals that a highly stratified reservoir causes uneven displacement and serious CO2 breakthrough. If mobility control measures like water alternating gas are undertaken, the solubility e ects will be more pronounced than this example.

A Health State Prediction Model Based on Belief Rule Base and LSTM for Complex Systems

In industrial production and engineering operations,the health state of complex systems is critical,and predicting it can ensure normal operation.Complex systems have many monitoring indicators,complex coupling structures,non-linear and time-varying characteristics,so it is a challenge to establish a reliable prediction model.The belief rule base(BRB)can fuse observed data and expert knowledge to establish a nonlinear relationship between input and output and has well modeling capabilities.Since each indicator of the complex system can reflect the health state to some extent,the BRB is built based on the causal relationship between system indicators and the health state to achieve the prediction.A health state prediction model based on BRB and long short term memory for complex systems is proposed in this paper.Firstly,the LSTMis introduced to predict the trend of the indicators in the system.Secondly,the Density Peak Clustering(DPC)algorithmis used todetermine referential values of indicators for BRB,which effectively offset the lack of expert knowledge.Then,the predicted values and expert knowledge are fused to construct BRB to predict the health state of the systems by inference.Finally,the effectiveness of the model is verified by a case study of a certain vehicle hydraulic pump.

On the Choice of the Path for the Development of the Rule of Law in China: From the Perspective of Improving the Rule of Law Quality by Promoting the Substantive Rule of Law

The continuous debate on the formal rule of law and the substantive rule of law in the construction of the rule of law in China not only affects the understanding of the connotation of the rule of law in China,but also the choice of the path for the development of the rule of law in China.In the new stage of “comprehensively advancing the Law-Based Governance of China”,the process of “comprehensively advancing the Law-Based Governance of China” is also a process of continuously improving the rule of law quality in China.And from this perspective,the relationship between the formal rule of law and the substantive rule of law has got a new meaning.Promoting the substantive rule of law is an important way to realize the development of the rule of law and improve the quality of the rule of law.At the same time,the promotion of the substantive rule of law should follow the “people-centered” nature of the rule of law and the objective is conducive to the promotion of the rule of law and the formation of the “rule of law ecology”.

A G^E/Equation of State Mixing Rule for Vapor-Liquid Equilibria

A new excess Gibbs free energy/equation of state type mixing 0rule was derived byremoving the infinite pressure boundary condition imposed by Wong and Sandler.The mixing rulewas extensively tested in terms of a comprehensive data base,consisting of 52 simple nonpolar-nonpolar,carbon dioxide containing,hydrocarbon-hydrocarbon,CFC,polar-polar,nonpolar-polarbinary and multicomponent systems.Focused on the complete predictive capability,a comparisonbetween the Wong-Sandler and the mixing rule proposed was conducted.The results indicate that thenew mixing rule is in general superior to the Wong-Sandler’s,and the binary interaction parameteras required by the latter is removed,which reduces computing effort and is reliable in predictions ofvapor-liquid equilibria from low pressures to high pressures.

A numerical study of comparison of two one-state-variable,rate-and state-dependent friction evolution laws

The two one-state-variable, rate- and state-dependent friction laws, i.e., the slip and slowness laws, are com- pared on the basis of dynamical behavior of a one-degree-of-freedom spring-slider model through numerical simulations. Results show that two （normalized） model parameters, i.e., A （the normalized characteristic slip distance） and β-α （the difference in two normalized parameters of friction laws）, control the solutions. From given values of △, β, and α, for the slowness laws, the solution exists and the unique non-zero fixed point is stable when △〉（β-α）, yet not when △ 〈（β-α）. For the slip law, the solution exists for large ranges of model parameters and the number and stability of the non-zero fixed points change from one case to another. Results suggest that the slip law is more appropriate for controlling earthquake dynamics than the slowness law.

The Socialist Rule of Law with Chinese Characteristics and Human Rights Protection

Law is the fundamental method of governance and the rule of law symbolizes modern civilization. The socialist rule of law is the rule of law rooted in the Chinese tradition, and designed and led by the Communist Party of China(CPC). It is not only a tool for government, but also a driver of social progress. Meanwhile, the Chinese human rights system is also designed by the CPC. Both concepts—the socialist rule of law and the human rights system——are different from the West in terms of theory, path and systems. Human rights are the fundamental values of and the ultimate goal pursued by the rule of law; and the rule of law is the recognition of and guarantee for human rights. Efforts must be made to advance legislative, administrative and judicial protection of human rights.

New insight into prediction of phase behavior of natural gas hydrate by different cubic equations of state coupled with various mixing rules

Progress in hydrate thermodynamic study necessitates robust and fast models to be incorporated in reservoir simulation softwares. However, numerous models presented in the literature makes selection of the best,proper predictive model a cumbersome task. It is of industrial interest to make use of cubic equations of state(EOS) for modeling hydrate equilibria. In this regard, this study focuses on evaluation of three common EOSs including Peng–Robinson, Soave–Redlich–Kwong and Valderrama–Patel–Teja coupled with van der Waals and Platteeuw theory to predict hydrate P–T equilibrium of a real natural gas sample. Each EOS was accompanied with three mixing rules, including van der Waals(vd W),Avlonitis non-density dependent(ANDD) and general nonquadratic(GNQ). The prediction of cubic EOSs was in sufficient agreement with experimental data and with overall AARD% of less than unity. In addition, PR plus ANDD proved to be the most accurate model in this study for prediction of hydrate equilibria with AARD% of 0.166.It was observed that the accuracy of cubic EOSs studied in this paper depends on mixing rule coupled with them,especially at high-pressure conditions. Lastly, the present study does not include any adjustable parameter to be correlated with hydrate phase equilibrium data.

Extension of Huron-Vidal-type Mixing Rule to Three-parameter Harmens-Knapp Cubic Equation of State

In this paper was extended the HV-type mixing rules to Harmens-Knapp cubic equation state(HK CEOS). The new HV-type mixing rule with HK CEOS was tested for Vapor-liquid equilibrium(VLE) of different polar and nonpolar systems. The tested results are in good agreement with existing experimental data within a wide range of temperatures and pressures. In comparison with the VDW mixing rule, the new mixing rule gives much better predictions for the VLE of nonpolar and polar systems.

Advancing the Rule of Law

The Fourth Plenary Session of the 18th Central Committee of the Communist Party of China （CPC）, held in Beijing from October 20 to 23, set the blueprint for rule of law in the world＇s second-largest economy. Chang Jiwena professor with the Institute of Law at the Chinese Academy of Social Sciences, believes the meeting has taken the rule of law to a higher level. Excerpts of his arguments follow：

A Scheme for Mining State Association Rules of Process Object Based on Big Data

This paper devises a scheme which can discover the state association rules of process object. The scheme aims to dig the hidden close relationships of different links in process object. We adopt a method based on difference and extremum to compute the timing. Clustering is used to classifying the adjusted data, and the next is associating the clusters. Based on the rules of clusters, we produce the rules of links. Association degrees between each two links can be determined. It is easy to get association chains according to the degree. The state association rules that can be obtained in accordance with association rules are the final results. Some industry guidance can be directly summarized from the state association rules, and we can apply the guidance to improve the efficiency of production and operational in allied industries.

Perception of Abortion and Abortion Laws by Lawyers in Anambra State Nigeria

Abortion is the knowing destruction of the life of an unborn child in the womb other than for the principal purpose of producing a life birth or removal of a dead tissue. The Nigeria law stipulates that abortion is allowed only where there is risk to the life of the woman and or to her physical or mental health. This study is aimed at determining the perception of abortion and the relevant laws by lawyers in Anambra State, Nigeria. It is a descriptive cross sectional study carried out between May-June 2010 using pre-tested self administered questionnaires to collect data from consenting 200 lawyers in the 3 major towns of Anambra State. All the respondents knew about abortion, recognized health hazards associated with it and mentioned infertility as the major complication of abortion (53%) followed by death (52.5%) and bleeding (42.5%). About 80% of respondents said abortion should be allowed in cases of danger to woman’s life, rape or incest. Eighty-five percent of the lawyers were aware of the existing abortion law in Nigeria and 76.5% of this knew abortion was legal only to save the life of the woman. Only 26% were in support of legalization of abortion. The Lawyers recommended health education and family planning, among others as means of preventing abortion and its complications. Stigma associated with abortion should be removed to improve free reporting of abortion cases for legal actions. Further research should involve other stakeholders on abortion to make for a holistic approach to the problem.

Extension of LCVM-type mixing rule to three-parameter equations of state for vapor-liquid equilibria of mixtures

In this paper, the LCVM mixing rule is extended to the multi-parameter equations of state by combining infi- nite-pressure and zero-pressure mixing rule models. The new LCVM-type mixing rule, coupled with Patel-Teja equation of state (EOS) is applied for vapor-liquid equilibria of different polar and non-polar systems in which the NRTL activity coefficient model is used to calculate the excess Gibbs free energy. The tested results agree well with existing experimental data within a wide range of temperatures and pressures. In comparison with the Van der Waals mixing rule, the new mixing rule gives much better corre- lations for the vapor-liquid equilibria of non-polar and polar systems.

Three-dimensional nonlinear H_2/H_∞ guidance law based upon approach of solving the state feedback Nash balance point

Based upon the theory of the nonlinear quadric two-person nonzero-sum differential game,the fact that the time-limited mixed H2/H∞ control problem can be turned into the problem of solving the state feedback Nash balance point is mentioned. Upon this,a theorem about the solution of the state feedback control is given,the Lyapunov stabilization of the nonlinear system under this control is proved,too. At the same time,this solution is used to design the nonlinear H2/H∞ guidance law of the relative motion between the missile and the target in three-dimensional(3D) space. By solving two coupled Hamilton-Jacobi partial differential inequalities(HJPDI),a control with more robust stabilities and more robust performances is obtained. With different H∞ performance indexes,the correlative weighting factors of the control are analytically designed. At last,simulations under different robust performance indexes and under different initial conditions and under the cases of intercepting different maneuvering targets are carried out. All results indicate that the designed law is valid.

The Temperature Dependence of the Thermodynamic Density of States and Urbach Rule

It is invited statistical explanation of the frequency and temperature dependence of the absorption coefficients of semiconductors on the long-wave edge of the fundamental absorption. With the help of mathematical modeling, it shows that the thermal broadening of the energy states of the conduction band and the discrete states in the band gap can cause long-wave decline according to the Urbach rule.
