The inclusion of the human rights clause in the Chi-nese Constitution is the core normative manifestation of the constitu-tionalization of human rights,and points to the relationship between international law and the Constitution in the sense of positive law.The inclusion of the human rights clauses in the Chinese Constitution itself is an inherent part of the development of China’s socialist constitution,and socialism has already contributed valuable concepts and practices of human rights protection to the modern world in its early stage.The constitutionalization of human rights protection does not necessarily lead to the superiority of international law over the constitutional order of a country,but rather to the convergence of international law and domestic law through the constitutional order.The relevant rules of international law will be effective only when they are transformed into domestic law through the Constitution and the human rights clause in the Constitution.Correspondingly,the domestic legal order is brought into line with the international legal order through the Con-stitution and its human rights clause.Behind the system of fundamen-tal rights in the constitutional order is the value foundation of the en-tire legal system.The advancement of foreign-related rule of law has brought new opportunities for China’s judicial practice to further pro-mote the protection of human rights.In the future,we should further integrate the human rights values embedded in socialism into China’s constitutional practice,enhance human rights protection around the country,and take a more active part in global human rights gover-nance. 展开更多

Cropland elevation uplift(CLEU) has recently become a new challenge for agricultural modernization,food security,and sustainable cropland use in China.Uncovering the rules of CLEU is of great theoretical and practical significance for China’s sustainable agricultural development and rural revitalization strategy.However,existing studies lack in-depth disclosure of multi-scale CLEU evolution rules,making it difficult to support the formulation of specific cropland protection policies.We analyzed the spatio-temporal evolution and multiscale CLEU in China from 1980 to 2020 using the Lorenz curve,gravity center model,hotspot analysis,and cropland elevation spectrum.The results indicated that the center of gravity of cropland moved to the northeast from 1980 to 2000 and then shifted to the northwest.The spatial distribution of cropland became increasingly imbalanced from 1980 to 2000.The change hotspots clustered in the northwest and the northeast,whereas cold-spots were mainly in southeastern China.The average elevation of cropland increased by 17.38 m,and the elevation uplift rule in different regions differed evidently across scales.From 1980 to 2000,all provinces except Xinjiang,Inner Mongolia,Gansu,and Yunnan exhibited CLEU,with Qinghai,Tibet,Beijing,and Guangdong showing the most noticeable uplifting.The CLEU can alleviate the shortage of cropland to some extent.However,without a planning constraint,the CLEU will lead to the increase of ecological risk and food security risk. 展开更多

The systems framework on which the Chinese rule of law relies is shaped by the socialist democratic system. Socialist consultative democracy, which responds to the core themes of the determinant of socialism, Party leadership, the democratic tradition of New China and native resources for constructing the rule of law, is an important resource for constructing the rule of law in China. In a constitutional system of"ruling Party--political power--the people" that takes the sovereignty of the people as the logic of its starting point, consultative democracy plays the role of functional coupling. Popular sovereignty gains political legitimacy on the basis of multi- party cooperation and political consultation under the leadership of the CPC, thus translating the will of the ruling Party into the will of the state. Consultative democracy constitutes an essential process in national decision-making, affording a basis for the construction of the inherent logical sequence of "ruling Party--Consultative Conference--People's Congress." The democratic supervision exercised by the Consultative Conference is an extension of political consultation; from it unfolds the systems framework of the rule of law in China. 展开更多

This work discusses a worldview and a methodology concerning ideological approaches by which Marxists can understand and transform the world,based on well-defined value truth,theory and philosophy.The work builds on the Report to the 20th National Congress of the Communist Party of China(CPC),which highlights the following priorities to which XI Jinping Thought on Socialism with Chinese Characteristics for a New Era must adhere:putting the people first,maintaining self-confidence and self-reliance,upholding fundamental principles and breaking new ground,adopting a problem-oriented approach,applying system thinking,and maintaining a global vision.Furthermore,this work argues that these priorities should be applied to promote the rule of law in China’s new journey.As the starting points of analysis and understanding,the meta-theory and“six must-dos”follow the general principles of Marxism in interpreting and promoting socialist concepts,theory,law-based path and legal system in the New Era with Chinese characteristics.The metatheory and the“six must-dos”provide the logical foundations and fundamental compliance with XI Jinping Thought on the Rule of Law.Only by applying these“six must-dos”well can we understand and implement XI Jinping Thought on the Rule of Law,enhance the rationality,initiative,foresight and creativity of our work in comprehensively promoting the rule of law in China. 展开更多

Over the past ten years, China has seen a number of practices exploring the evaluation of the rule of law. It is important that we sum up the practical experience of these evaluations, analyze the problems they encounter, determine their direction nationwide, and put forward constructive ideas. With the issuing of the Decision of the Central Committee of the CPC on Some Major Issues Concerning Comprehensively Deepening the Reform and the Decision of the Central Committee of the CPC on Promoting a Number of Major Issues of the Rule of Law, evaluation of the rule of law faces a transformation both in theory and in practice. The key points in this transformation are having the right orientation, innovative mechanisms and solutions to tricky issues of quantitative evaluation; summing up evaluation of experience; and elevating evaluation to the level of theory. A precondition for its effective evaluation is a scientific mechanism for evaluating the rule of law; in turn, the key to a scientific evaluation is solving the problems in quantitative evaluation of the rule of law; and the necessary requirements for evaluation practice are summing up evaluation experience and elevating it to the level of theory. The key to innovative mechanisms for evaluating the rule of law lies in implementation of the third party evaluation model and in quantitative evaluation that starts with particular programs. 展开更多

It is debating whether Taisui is living or not, myxomycete complex or fungi. The passage studies the 228 finding reports of Taisui in modern China. It confirms that the first finding time of Taisui in modern China is 1963, and the first reported time is 1992. Taisui has been found in 25 administrative divisions. Taisui occurs the most times in Shandong Province. Besides, provinces where Taisui has been found most times are in northern China. Finding locations of Taisui vary from place to place. Taisui is most often found in normal earth layer, with different burying depth. Taisui is mainly found through seeing, tramping, and digging. Taisui findings lack subjective motivations and are connected with the life and production of the finders. Conclusion: Taisui is an object growing in earth layer. 展开更多
