Commentary on the Newly Published White Paper Concerning the Rule of Law in China

On February 28, 2008, the State Council Information Office published a white paper entitled China＇s Efforts and Achievements in Promoting the Rule of Law. This document is the first white paper published by the government on China＇s rule of law. It contains eight chapters and six appendices to review China＇s achievements on the road to practicing the rule of law in a compre- hensive way, and to expound the official Chinese policy and position on this is- sue. With some essential points inside, the publication of this white paper is of great significance, especially this year, to China＇s rule of law, human rights prog- ress, and its communication and dialogue with the international community.

On the Choice of the Path for the Development of the Rule of Law in China: From the Perspective of Improving the Rule of Law Quality by Promoting the Substantive Rule of Law

The continuous debate on the formal rule of law and the substantive rule of law in the construction of the rule of law in China not only affects the understanding of the connotation of the rule of law in China,but also the choice of the path for the development of the rule of law in China.In the new stage of “comprehensively advancing the Law-Based Governance of China”,the process of “comprehensively advancing the Law-Based Governance of China” is also a process of continuously improving the rule of law quality in China.And from this perspective,the relationship between the formal rule of law and the substantive rule of law has got a new meaning.Promoting the substantive rule of law is an important way to realize the development of the rule of law and improve the quality of the rule of law.At the same time,the promotion of the substantive rule of law should follow the “people-centered” nature of the rule of law and the objective is conducive to the promotion of the rule of law and the formation of the “rule of law ecology”.

The Connotations of the Constitutional Clause on Human Rights Protection From the Perspective of Foreign-related Rule of Law

The inclusion of the human rights clause in the Chi-nese Constitution is the core normative manifestation of the constitu-tionalization of human rights,and points to the relationship between international law and the Constitution in the sense of positive law.The inclusion of the human rights clauses in the Chinese Constitution itself is an inherent part of the development of China’s socialist constitution,and socialism has already contributed valuable concepts and practices of human rights protection to the modern world in its early stage.The constitutionalization of human rights protection does not necessarily lead to the superiority of international law over the constitutional order of a country,but rather to the convergence of international law and domestic law through the constitutional order.The relevant rules of international law will be effective only when they are transformed into domestic law through the Constitution and the human rights clause in the Constitution.Correspondingly,the domestic legal order is brought into line with the international legal order through the Con-stitution and its human rights clause.Behind the system of fundamen-tal rights in the constitutional order is the value foundation of the en-tire legal system.The advancement of foreign-related rule of law has brought new opportunities for China’s judicial practice to further pro-mote the protection of human rights.In the future,we should further integrate the human rights values embedded in socialism into China’s constitutional practice,enhance human rights protection around the country,and take a more active part in global human rights gover-nance.

Exploring the rules of cropland elevation uplift in China

Cropland elevation uplift(CLEU) has recently become a new challenge for agricultural modernization,food security,and sustainable cropland use in China.Uncovering the rules of CLEU is of great theoretical and practical significance for China’s sustainable agricultural development and rural revitalization strategy.However,existing studies lack in-depth disclosure of multi-scale CLEU evolution rules,making it difficult to support the formulation of specific cropland protection policies.We analyzed the spatio-temporal evolution and multiscale CLEU in China from 1980 to 2020 using the Lorenz curve,gravity center model,hotspot analysis,and cropland elevation spectrum.The results indicated that the center of gravity of cropland moved to the northeast from 1980 to 2000 and then shifted to the northwest.The spatial distribution of cropland became increasingly imbalanced from 1980 to 2000.The change hotspots clustered in the northwest and the northeast,whereas cold-spots were mainly in southeastern China.The average elevation of cropland increased by 17.38 m,and the elevation uplift rule in different regions differed evidently across scales.From 1980 to 2000,all provinces except Xinjiang,Inner Mongolia,Gansu,and Yunnan exhibited CLEU,with Qinghai,Tibet,Beijing,and Guangdong showing the most noticeable uplifting.The CLEU can alleviate the shortage of cropland to some extent.However,without a planning constraint,the CLEU will lead to the increase of ecological risk and food security risk.

The Role of Consultative Democracy in a Constitutional System and the Rule of Law in China

The rule of law in China should be advanced under a systems framework. The systems framework on which the Chinese rule of law relies is shaped by the socialist democratic system. Socialist consultative democracy, which responds to the core themes of the determinant of socialism, Party leadership, the democratic tradition of New China and native resources for constructing the rule of law, is an important resource for constructing the rule of law in China. In a constitutional system of＂ruling Party--political power--the people＂ that takes the sovereignty of the people as the logic of its starting point, consultative democracy plays the role of functional coupling. Popular sovereignty gains political legitimacy on the basis of multi- party cooperation and political consultation under the leadership of the CPC, thus translating the will of the ruling Party into the will of the state. Consultative democracy constitutes an essential process in national decision-making, affording a basis for the construction of the inherent logical sequence of ＂ruling Party--Consultative Conference--People＇s Congress.＂ The democratic supervision exercised by the Consultative Conference is an extension of political consultation; from it unfolds the systems framework of the rule of law in China.

Worldview and Methodology of Advancing the Construction of the Rule of Law in China

This work discusses a worldview and a methodology concerning ideological approaches by which Marxists can understand and transform the world,based on well-defined value truth,theory and philosophy.The work builds on the Report to the 20th National Congress of the Communist Party of China(CPC),which highlights the following priorities to which XI Jinping Thought on Socialism with Chinese Characteristics for a New Era must adhere:putting the people first,maintaining self-confidence and self-reliance,upholding fundamental principles and breaking new ground,adopting a problem-oriented approach,applying system thinking,and maintaining a global vision.Furthermore,this work argues that these priorities should be applied to promote the rule of law in China’s new journey.As the starting points of analysis and understanding,the meta-theory and“six must-dos”follow the general principles of Marxism in interpreting and promoting socialist concepts,theory,law-based path and legal system in the New Era with Chinese characteristics.The metatheory and the“six must-dos”provide the logical foundations and fundamental compliance with XI Jinping Thought on the Rule of Law.Only by applying these“six must-dos”well can we understand and implement XI Jinping Thought on the Rule of Law,enhance the rationality,initiative,foresight and creativity of our work in comprehensively promoting the rule of law in China.

The Current Situation,Problems,and Improvement Path of Rule of Law Education in Primary and Secondary Schools in Chaoshan Area

Rule of law education in primary and secondary schools is an educational process to popularize legal knowledge,establish legal awareness,and cultivate the ability to respect,abide by,and use the law for the special group of primary and secondary school students.The research found that rule of law education in primary and secondary schools in Chaoshan has yielded positive outcomes.However,there exist problems such as uneven synergy,incomplete inclusion of teachers and students,shortage of adequately trained professional teachers,and the need for enhanced organizational support.The relevance and effectiveness of rule of law education in primary and secondary schools will be enhanced by clarifying the target tasks,enhancing the effectiveness of the classroom,creating an atmosphere of the rule of law,and strengthening organizational support.

Revisiting the Spirit of the UDHR and Discussing Human Rights Development——Summary of Views from the Seminar Commemorating the 75th Anniversary of the Universal Declaration of Human Rights

On December 4,2023,the China Society for Human Rights Studies hosted a seminar in Beijing commemorating the 75^(th) Anniversary of the Universal Declaration of Human Rights.Participants discussed topics such as the significance of the Universal Declaration of Human Rights,China’s theories and practices in respecting and safeguarding human rights,the three global initiatives and global human rights governance,human rights protection in the digital age,and telling Chinese stories of human rights in the new era.The discussions led to a broad consensus and achieved positive results.

Transforming the Evaluation of the Rule of Law in China

Over the past ten years, China has seen a number of practices exploring the evaluation of the rule of law. It is important that we sum up the practical experience of these evaluations, analyze the problems they encounter, determine their direction nationwide, and put forward constructive ideas. With the issuing of the Decision of the Central Committee of the CPC on Some Major Issues Concerning Comprehensively Deepening the Reform and the Decision of the Central Committee of the CPC on Promoting a Number of Major Issues of the Rule of Law, evaluation of the rule of law faces a transformation both in theory and in practice. The key points in this transformation are having the right orientation, innovative mechanisms and solutions to tricky issues of quantitative evaluation; summing up evaluation of experience; and elevating evaluation to the level of theory. A precondition for its effective evaluation is a scientific mechanism for evaluating the rule of law; in turn, the key to a scientific evaluation is solving the problems in quantitative evaluation of the rule of law; and the necessary requirements for evaluation practice are summing up evaluation experience and elevating it to the level of theory. The key to innovative mechanisms for evaluating the rule of law lies in implementation of the third party evaluation model and in quantitative evaluation that starts with particular programs.

Research on the Scientific Meaning of Rule of Law in China

Forty Years' Construction of Rule of Law and the Legalization of Human Rights Protection in China

The Fourth Plenary Session of the 18th Central Committee of the Communist Party of China （CPC） reviewed and approved the Decision of the CPC Central Committee on Certain Key Issues Concerning Comprehensively Pushing Forward the Rule of Law （hereafter, ＂Decision＂）. The plenary session was convened at a pivotal stage in comprehensively building a well-off society and comprehen- sively deepening reform. It was the first of its kind with the theme of the rule of law and was a landmark event in China＇s legal construction. The Journal interviewed Professor Luo Haocai, who is also president of the China Society for Human Rights Studies （CSHRS）.

A Research of the Finding and Distribution Law of Taisui in Modern China

The academic world is still uncertain about the classification of Taisui. It is debating whether Taisui is living or not, myxomycete complex or fungi. The passage studies the 228 finding reports of Taisui in modern China. It confirms that the first finding time of Taisui in modern China is 1963, and the first reported time is 1992. Taisui has been found in 25 administrative divisions. Taisui occurs the most times in Shandong Province. Besides, provinces where Taisui has been found most times are in northern China. Finding locations of Taisui vary from place to place. Taisui is most often found in normal earth layer, with different burying depth. Taisui is mainly found through seeing, tramping, and digging. Taisui findings lack subjective motivations and are connected with the life and production of the finders. Conclusion: Taisui is an object growing in earth layer.
