Construction of Legal System of China's Farmland Protection under the Coexistence of Multiple Objectives:Historical Logic,Practical Problems and Optimization Paths

[Objectives]To explore the evolution of the legal system of farmland protection and explore the rules and characteristics of policy development based on the theory and logic of institutional change since China's reform and opening up,reveal the problems and deep-seated reasons of its legislation,clarify the direction of farmland protection in the new period,and solve the"non-agricultural""non-grain"and ecological problems of farmland.[Methods]Literature analysis and inductive deduction methods were used.[Results]The evolution of the farmland protection legal system has gone through the process of"national consciousness-policy guidelines-institutional system",the change from"single subject to multiple subjects";change from the use of"one-way administrative means to coordinated use of administrative,economic and technical means".The practical problems of the farmland protection legal system are mainly due to the insufficient systematization of the farmland protection legal system itself,the generalization of quantity protection,the transformation of quality protection,and the absence of ecological protection.[Conclusions]It is recommended to improve the existing farmland protection legal system from the establishment of the Farmland Protection Law,the improvement of the farmland protection public participation mechanism and supervision mechanism,the establishment of the farmland quality construction and improvement system,the differentiated farmland occupation and supplementation balance system,and the ecological restoration system.

The retrospect and prospect on environmental legal system research of Xi'an City

Xi'an City is an important city of western region, facing the mission of constructing international metropolitan. There are many environmental issues in the city, which should be solved by legal construction. Based on the environmental status of the city, the construction content of environmental legal system was analyzed, focusing on conflict resolution, and the corresponding ways of research were proposed.

Performance of a Horizontal Flow Constructed Reed Bed Filter for Municipal Wastewater Treatment: The Case Study of the Prototype Installed at Gaston Berger University, Saint-Louis, Senegal

In Saint-Louis, Senegal, a constructed wetland with horizontal flow reed beds (FHa and FHb) has demonstrated significant efficacy in treating municipal wastewater. Analyzing various treatment stages, the system showed only a slight temperature variation, from an influent average of 26.3°C to an effluent of 24.7°C. Electrical conductivity decreased from 1331 mS/cm to 974.5 mS/cm post-primary treatment, with suspended solids (SS) dramatically reduced from 718.9 mg/L to 5.7 mg/L in the final effluent. Biochemical oxygen demand (BOD5) and chemical oxygen demand (COD) saw a notable decrease, from initial levels of 655.6 mg/L and 1240 mg/L to 2.3 mg/L and 71.3 mg/L, respectively. Nitrogenous compounds (N-TN) and phosphates () also decreased significantly, indicating the system’s nutrient removal capacity. Microbiological analysis revealed a reduction in fecal coliforms from 7.5 Ulog/100ml to 1.8 Ulog/100ml and a complete elimination of helminth eggs. The presence of Phragmites and Typha was instrumental in enhancing these reductions. The system’s compliance with the Senegalese standards for disposal into natural environments, WHO recommendations for unrestricted water reuse in irrigation, and the European legislation for water reuse was established. The effluent quality met the stringent criteria for various classes of agricultural reuse, illustrating the system’s potential for sustainable water management. This wetland model presents a robust solution for water-stressed regions, ensuring environmental protection while supporting agricultural needs. The study calls for ongoing research to further refine the system for optimal, reliable wastewater treatment and water resource sustainability.

Unenumerated Rights Clauses and the System of Restriction on Fundamental Rights——Another Construction Plan for Article 51 of the Constitution of PRC

According to constitutional jurisprudence in China,Article 51 of the Constitution is an unenumerated restrictive clause.Such theoretical construction fails to justify the differentiated restrictions established in the Constitution and makes it difficult to explain the constitutional status of human dignity. Article 51 implies the possibility of other theoretical constructions. It is not an unenumerated restriction clause but an unenumerated rights clause. It aims to provide guarantees for general freedom of action not enumerated in the Constitution rather than restricting fundamental rights. The actual benefit of this kind of theoretical construction lies in that it can establish the basis of the constitutional text for general freedom of action and promote the people’s correct understanding of the model of restriction on fundamental rights established by the Constitution of PRC.

An Analysis of the Legal System for the Protection of Marine Resources in China

In order to realize the orderly development and rational use of marine resources,construct a new marine economic development model,effectively adjust the relationship between marine resource protection and social production,and promote the legalization and institutionalization of marine resource protection.Based on the reality,this article attempts to explore the ways and means of improving and constructing the legal system for the protection of marine resources from multiple dimensions.It aims to form a complete marine resource development system from the legal level and provide legal guarantee for the development of marine economy.

The Legal Conflicts, the Legislative Vacancies and the Legislative Lags in the Chinese Environmental Legal System

The inconsistency and disharmony in China’s environmental legal system are seriously undermining the authority and effectiveness of environmental laws, making it hard to achieve the national environmental legislative goals. It is found in this study that at least 18 administrative regulations and rules conflict with the five recently-revised environmental laws. The legislative vacancy rate of province-level environmental laws reaches 27.8%, and that of city-level environmental laws in the major cities reaches 59.7%. Besides, 66% of the local including both province-level and city-level environmental laws have the problem of legislative lags, with an average lag of 2547.8 days. In addition, there are many legal conflicts between national environmental laws and local environmental laws. In order to help China to build a harmonious and unified environmental legal system, some suggestions are proposed in this study, including comprehensively examining the lower-level environmental laws, strengthening the leading role of local people’s congresses in environmental legislation, improving the construction of filing and review mechanism, and optimizing the mechanisms for information disclosure and public participation.

On the “Law and Literature” Campaign in the Chinese Context and Its Significance for the Construction of China's Legal System

"Law and literature " comes from an American radical law school of the1970 s,and it was then considered a campaign,thus the school became one of the most post-modernistic schools of thought. Due to its western theoretic background,it is necessary to interpret its context; in other words,the "Law and literature"problems shall be interpreted in the Chinese context,which can also provide much inspiration and reference for the construction of China's legal system.

Construction and application of an assessment index system for evalu ating the eco-community’s sustainability

An assessment index system including environment, socio-culture, economy and technology was established for evaluating environmental construction level of community （objective construction）, and questionnaire was designed according to paper review for evaluating residential satisfaction （subjective satisfaction）. The index system was divided into four layers： system （A）, subsystems （B）, categories （C）, and indicators （D）, and in total of 38 indicators was established. The Xihe community, affiliated to Nanfen district, Benxi City, Liaoning Province, China was selected as a case study. Results indicated that the community sustainability index related to objective environmental construction was 0.4355 and was classified as class Ⅲ （moderate）; the community sustainability index related to the residential satisfaction was 0.4255, belonging to class Ⅲ. In conclusion, the sustainability of Xihe community was moderate and needed to be improved. Residential satisfaction was lower than objective environmental construction. The assessment index system established in this study is able to reflect the comprehensive sustainability of community and can be used to evaluate other similar communities＇ sustainability.

Advanced semiconductor catalyst designs for the photocatalytic reduction of CO_(2)

Using clean solar energy to reduce CO_(2)into value-added products not only consumes the over-emitted CO_(2)that causes environmental problems,but also generates fuel chemicals to alleviate energy crises.The photocatalytic CO_(2)reduction reaction(PCO_(2)RR)relies on the semiconductor photocatalysts that suffer from high recombination rate of the photo-generated carriers,low light harvesting capability,and low stability.This review explores the recent discoveries on the novel semiconductors for PCO_(2)RR,focusing on the rational catalyst design strategies(such as surface engineering,band engineering,hierarchical structure construction,single-atom catalysts,and biohybrid catalysts)that promote the catalytic performance of semiconductor catalysts on PCO_(2)RR.The advanced characterization techniques that contribute to understanding the intrinsic properties of the photocatalysts are also discussed.Lastly,the perspectives on future challenges and possible solutions for PCO_(2)RR are presented.

Review of Simultaneous Localization and Mapping Technology in the Agricultural Environment

Simultaneous localization and mapping(SLAM)is one of the most attractive research hotspots in the field of robotics,and it is also a prerequisite for the autonomous navigation of robots.It can significantly improve the autonomous navigation ability of mobile robots and their adaptability to different application environments and contribute to the realization of real-time obstacle avoidance and dynamic path planning.Moreover,the application of SLAM technology has expanded from industrial production,intelligent transportation,special operations and other fields to agricultural environments,such as autonomous navigation,independent weeding,three-dimen-sional(3D)mapping,and independent harvesting.This paper mainly introduces the principle,sys-tem framework,latest development and application of SLAM technology,especially in agricultural environments.Firstly,the system framework and theory of the SLAM algorithm are introduced,and the SLAM algorithm is described in detail according to different sensor types.Then,the devel-opment and application of SLAM in the agricultural environment are summarized from two aspects:environment map construction,and localization and navigation of agricultural robots.Finally,the challenges and future research directions of SLAM in the agricultural environment are discussed.

Influence of Reservoir on Groundwater Environment in the Ecologically Fragile Area, Northwest of China

As the research proposed reservoirs after impact on the surrounding ecological fragile areas of groundwater level and scope, through the proposed reservoir area and its surrounding data collecting, hydrogeology survey and related test, for Modflow system simulation platform, through to the boundary conditions, initial conditions and source sink term and related hydrogeological parameters, the model identification and verification, The model of hydrogeological parameters in the study area is constructed. The simulation results show that the groundwater depth near the reservoir area will be higher than the critical value (1.8 m) of secondary salinization of soil. At the same time, according to the investigation and experiment, if the reservoir does not do seepage treatment, the water infiltration in the reservoir will aggravate the environmental hydrogeological problems in the ecologically fragile area.

Causes,Effects,and Control Measures of Construction Change Orders in the U.S.

Change orders have a significant impact on many aspects of construction projects.They are known to be the primary cause of litigation in the construction industry.Change orders are almost inevitable due to the uniqueness of each project from many perspectives,such as the type of building,complexity of the design,human factors,and the available resources.Change orders are the formal mechanism to implement design changes during the execution phase.These changes are usually the outcome of lack of visualization by the owner,misunderstanding,miscommunication between different parties involved in the project,shortage in resources,and other factors.This research aims to investigate and rank causes,effects,and control measures of change orders in the construction industry in the U.S.This research presents the results of a questionnaire surveying owners,contractors,and consultants.A total of 123 industry professionals in the Architecture,Engineering,and Construction(AEC)field,with either significant or final decision-making authority on reviewing,issuing,and approving change orders responded to the survey.Results indicated that owners are the primary source followed by consultants and contractors,respectively.Some of the more important control measures identified in this research are collaboration and visualization technologies.

A Comparative Analysis of Visualization Methods in Architecture:Employing Virtual Reality to Support the Decision-Making Process in the Architecture,Engineering,and Construction Industry

The design process of the built environment relies on the collaborative effort of all parties involved in the project.During the design phase,owners,end users,and their representatives are expected to make the most critical design and budgetary decisions-shaping the essential traits of the project,hence emerge the need and necessity to create and integrate mechanisms to support the decision-making process.Design decisions should not be based on assumptions,past experiences,or imagination.An example of the numerous problems that are a result of uninformed design decisions is“change orders”,known as the deviation from the original scope of work,which leads to an increase of the overall cost,and changes to the construction schedule of the project.The long-term aim of this inquiry is to understand the user’s behavior,and establish evidence-based control measures,which are actions and processes that can be implemented in practice to decrease the volume and frequency of the occurrence of change orders.The current study developed a foundation for further examination by proposing potential control measures,and testing their efficiency,such as integrating Virtual Reality(VR).The specific aim was to examine the effect of different visualization methods(i.e.,VR vs.construction drawings)on,(1)how well the subjects understand the information presented about the future/planned environment;(2)the subjects’perceived confidence in what the future environment will look like;(3)the likelihood of changing the built environment;(4)design review time;and(5)accuracy in reviewing and understanding the design.

Environmental Protection of Biodiversity in Macedonia and Albania under Legal Analysis View

Environmental problems in the Republic of Macedonia and Albania are similar in other countries in the region. Numerous problems and deficiencies identified through different projects. The studies and planning documents are evident for environmental media and areas. Such as lack of regional integrated systems for municipal solid waste management. The system for special waste types management, including hazardous waste, insufficient coverage of populated places and municipalities by wastewater collection and treatment systems （especially in agglomerations above 10,000 populations）. The need to establish integrated river basin management is in accordance with the new law on waters, air pollution with different intensity in different parts of the country. This paper presents the imperative reforms to protect the natural resources and biodiversity in the countries.

Research on Postgraduate Classroom Construction Framework from the Perspective of Smart Education

Smart education is the future and development direction of higher education.Taking the graduate course Crime and Police Theory as the research subject,the shortcomings of smart education,which include the lack of understanding of the concept of smart education,the limited content structure of smart education,the poor cognition of smart education among teachers and students,and inadequate hardware and technical support for smart education,are systematically analyzed.In view of these shortcomings,several strategies are proposed,including improving the smart education curriculum development plan and management level,ensuring the construction quality of smart education projects,and raising funds for smart education construction from various sources.

Countermeasures for Solving the Environmental Problems and Accelerating the Model City Construction of Xi'an

Through careful study, it found that the key and difficult points of affecting and restricting Xi＇an to reach the model city construction standards in provincial and national levels were ＂urban air environment quality standards＂ and ＂water qualification rate of urban water environment function area＂. In order to tackle with the weak links, highlight the important points and focus on the difficult points to strengthen scientific and technological innovation, we actively explored new ideas and ways to resolve the dilemma in meeting the two standards of model city construction, and we managed to put forward the countermeasures to resolve the dilemma through innovating system and mechanism. ＂Place master system＂ should be carded out quickly to meet the ＂urban air environment quality standards＂, while ＂river master system＂ should be implemented as soon as possible to reach the ＂water qualification rate of urban water environment function area＂. The aim of this study was to enhance the qualification rates of the indicators for model city construction to make Xi＇an successfully pass the provincial and national assessment of model city construction through dealing with the weak links to accelerate the realization of becoming model environmental protection city.

Carbon emission risk of construction industry in Hebei Province of China based on carbon sink thresholds

In order to assess the environmental risks caused by carbon emissions from the construction industry in Hebei Province of China,an environmental risk assessment model based on forest carbon sink threshold was constructed to evaluate the carbon emission risks of the construction industry in Hebei Province,China from 2005 to 2020.The results are shown as follows:(1)The overall carbon emissions of the construction industry in Hebei Province of China showed an inverted"V"-shaped evolution trend during the past 16 years.Tangshan and Shijiazhuang maintained high carbon emissions,while Langfang,Hengshui and Baoding saw rapid increases in carbon emissions.(2)The environmental safety threshold of carbon emission from the construction industry in Hebei Province,China,has been continuously improved,and the provincial environmental safety threshold is between 9475080-23144760 tons;The environmental safety threshold was the highest in Baoding and Langfang,and the lowest in Xingtai.(3)In the past 16 years,the carbon emission risk of the construction industry in Hebei Province of China has been in a state of extremely serious risk,and the risk index generally presents an inverted"V"type trend.(4)The carbon emission risk of Hebei city in China presents a spatial pattern of"high in the south and low in the north",which goes through two stages:risk increase period and risk reduction period.

Advancement Towards Spatial Justice:The Barrier-Free Environment Construction from a Gender Perspective

Space is both a product and a producer of social relations.In the spatial domain,gender blindness has long existed,limiting women’s rights of access to and use of space,leading to structural oppression of women’s rights,and giving rise to new gender inequalities.The barrier-free environment construction has the functions of eliminating physical barriers and generating societal norms,and when combined with social changes,can facilitate justice correction across multiple dimensions.However,barrier-free environment construction itself,as a means of justice correction,also suffers from gender blindness.There remains room for improvement in the areas of facility construction,information exchange,and social services within the realm of barrier-free environments.In response to this phenomenon,gender equality offers a new critical perspective.Therefore,integrating a gender perspective into the barrier-free environment construction,focusing on the spatial rights of women,especially groups with multiple vulnerabilities,such as disabled women and elderly women,can contribute to the advancement towards spatial justice.

Legal study on water environmental protection of Three Gorges Reservoir Area

Water environment security of the Three Gorges Reservoir Area has become a more extensive concern since the impoundment of the reservoir. This paper describes the existing water environmental hazards and defects in current legal system for water environmental protection in this area, and also discusses their possible causes and potential problems in the future based on first hand materials and other literature. According to the theories of integrated river basin management and environmental equity principle, legal proposals are put forward, which include building an unitary legal system dedicated to the Reservoir Area, setting up a basin authority of the Yangtze River to preside over the resources protection and development, using interests' compensation system to solve interest conflicts among different reaches, and making concrete regulations to direct public participation in water environmental security protection of the Three Gorges Reservoir Area.
