An Important Acupuncture Demonstration in the History of Legalization of Acupuncture in the United States

This article details a public acupuncture demonstration that took place on May 9,1972,in San Francisco,California.It was conducted by two traditional Chinese medicine doctors Pien Bae Chi(卞伯岐)and Leung Kok Yuen(梁觉玄),and was observed by 500 American medical doctors.This was an important public acupuncture demonstration in the early history of acupunccture in the United States(US).It directly promoted the passage of the first acupuncture bill by California government and had a significant impact on the legalization of acupuncture in California.

A Dialogue with the Ancient and Reflection on the Interpretation of History of Bianque and Traditional Chinese Medicine

Based on the description of epidemic diseases in the chapter of “The Story of Bianque” in Records of Historian, the author has analyzed and explored the truthfulness of its background data and the possibility of the plague spreading at that time from both macro and micro angles. The symptoms of plague including chills formation of some doctrines in Traditional Chinese Medicine (TCM) such as exopathic heat disease doctrine, internal injury of spleen and stomach doctrine and epidemic febrile disease doctrine. The course of exogenous phenomena, the author has explored the effect on the initial medical theory, primitive religion and culture due to the spreading of epidemic diseases from the angles of epidemiology, the theory of images and figures, originated from epidemic diseases was proposed. The author also put forward some opinions on the relationship between epidemic diseases spreading and traditional education of TCM, sustained development of TCM.

Along with the legends about epidemic demons,China has developed over the centuries a medical approach to epidemic diseases based on the teachings of Hucng Di Nei Jing(《黄帝内经》Huangdi s Intermnal Classic),Nan Jing(《难经》Classic of Difficult Issues),and Shang Han Lun(《伤寒论》Treatise on Cold Damage).Other doctors and scientists participated in this evolution of knowledge,like Wang Shuhe(王叔和),Ge Hong(葛洪),Chao Yuanfang(巢元方),Sun Simiao(孙思邈),and Liu Wansu(刘完素).However,it was in the 17^th century,after the great break of the Song,Jin,and Yuan eras that an innovative spirit,Wu Youke(吴又可1582-1652)first foresaw the existence of microorganisms as we know them now.His Wen Yi Lun(《瘟疫论》Treatise on Pestilence)foreshadows an original approach to epidemic diseases,particularly emerging infectious diseases of the 21^st century.After them,traditional Chinese medicine developed a comprehensive method of diagnosing and treating of these diseases(Epidemic Diseases Theory瘟疫学说)within the School ofHeat Diseases(温病学派).In a third article,we will examine some applications in the treatment of the SARS 2003-2004 epidemic(非典型肺炎)and the current COVID-19(新型冠状病毒肺炎)pandemic.

On the Establishment of Chinese Self-Independent Knowledge System of Legal Science

Constructing the Chinese self-independent knowledge system of legal science is a great project to adapt Marxist legal science to the Chinese context and the needs of our times in the new era, a profound revolution in the field of legal science, a precursor and foundation for constructing a system of legal science with Chinese characteristics, an urgent need to train high-quality legal talents with both virtues and talents, and an inevitable requirement for promoting the Chinese path to the modernization of the rule of law. To carry out such a systematic project, it is imperative to focus on the seven basic principles and scientific methods that include adhering to the ideological guidance of XI Jinping Thought on the Rule of Law. The theory of the system of socialist rule of law with Chinese characteristics, which is the cornerstone for the development of the Chinese self-independent knowledge system of legal science, has provided a necessary and much-needed theoretical paradigm for the development of the Chinese self independent knowledge system of legal science, has led to the innovative development of legal theory with Chinese characteristics in the new era, and will continue to do it.

中国翻译理论史研究:“一体双层”模式建构

当理论研究发展到一定阶段,就需要进行必要的学术史梳理,以便回望来路,展望去路。近年来,中国翻译理论史研究正成为国内译学界研究的热点之一,以应对翻译学学科进一步发展的诉求。但与当前欣欣向荣的翻译史研究相比,国内的翻译理论史研究还较为薄弱。本研究聚焦中国翻译理论史研究模式的元思考,尝试以翻译理论史的4个要素——译论、翻译实践、译论者和社会为构成性的“一体”,从内层——心理层和外层——社会层以及相对应的两个跨学科视角——发生认识论和知识社会学作为阐释性的“双层”,建构一个研究和撰写中国翻译理论史的“一体双层”模式,并对该模式进行宏观与微观相结合的理论阐发和举例论证,最后对中国翻译理论史研究提出几点建议,特别是提出建立一个译学分支学科——“译论思想史”的设想。本研究希望能为中国翻译理论史的研究和撰写提供研究模式方面的可能途径,助力中国翻译理论史研究向纵深发展。

重写文明史:建构中国自主知识体系的底座

中国自古便有完整的哲学体系、文论体系、史学体系、艺术体系、教育体系、医学体系、科学技术体系以及其他各个学科的自主知识体系。然而,中国原有的自主知识体系在现当代基本上不被承认。这一问题的根源在文明观,文明观是基础,是自主知识体系的底座。近现代以来支撑各学科知识生产的标准、内涵、体系都建立在西方文明的底座上。文明底座是西方的,所构建的知识体系也就必然唯西是从,直接导致了对中国文明的贬低,对中国知识体系的全盘否定,形成了中国自主知识体系整体性的垮塌,走上了自毁长城之歧途。建构中国自主知识体系,首先要“重塑文明观”,重塑文明观则必须“重写文明史”,再从文明底座上建构哲学、史学、医学、科学技术等各个学科的自主知识体系,重获各学科知识体系本来的“话语权”,向世界呈现“理论中的中国”“创新中的中国”“文明中的中国”,建构自立自强的中国自主知识体系。

外来中药辣木叶的药性与功用再探索

辣木叶(Moringa spp.)是印度传统草药,因其具有降血糖、降血脂、抗氧化、利尿、改善睡眠、增强人体免疫力、延缓衰老、抗肿瘤等作用而引起人们的广泛关注。辣木叶目前合法引入中国,并因其确切的药理活性与安全无毒的药物属性,应用与研究日益增多。但当前其暂无中药标准,仅有少量药性记载。辣木叶的中药药性亟待完善,以有利于辣木叶与中药合理配伍运用从而充分发挥其应有的价值。以“文献研究→理论探讨→药性验证→临床实践”为路径构建新外来药物“中药化”的研究策略与范式,以临床应用为依据、实验研究为参考,进行外来中药辣木叶的药性与功用的深入探讨,对规范其应用具有重要意义。

我国刑事诉讼法典编纂的历史智慧

我国古代虽无专门的刑事诉讼法典,但法典编纂的历史智慧依旧博大精深。自周代区分狱、讼开始,有关刑事诉讼的立法愈发精进,其重要成果分布于各个历史时期具有代表性的法典当中。在体例上,立法者以高超的“提取公因式”技术实现了总则制定,以精妙的编纂技巧完成了由繁至简的体系化过程;在理论上,以德立法的文化熏陶出兼顾情理,以矜恤弱势群体、依法断罪、宽严相济为代表的诉讼原则;在制度上,典范性的规定贯穿于诉讼程序的起诉、举证以及审理阶段,发展出了颇为完备的诉讼制度。当前,法典编纂已成为重要的时代命题,推动刑事诉讼法的法典化,一方面应吸收借鉴中国古代法制中优秀的法律传统与诉讼规律,另一方面需兼容解决现实问题以保证立法的前瞻性。

卢梭的立法者难题及其中国解决方案

卢梭认为,立法者承担着塑造政治生活方式和塑造人民的职能,其行动原理是公意。不过,卢梭在其政治理论中引入独立的立法者,却产生了一个难题,那就是如何确保人民和立法者关系的统一。立法者不是人民本身,如何确保立法者制定的法律正是人民自己想要的法律或者确保立法者制定的法律就是人民自己制定的法律,卢梭并没有解决这一难题。中国的立法实践从实质上初步解决了卢梭的立法者难题,既能保证人民成为真正的立法者,又能保证人民制定的法律符合公意。

作为法学学科体系中一门特征明显的交叉学科,法律史学可成为新文科理论与实践改革的优质素材,新文科理念的融入可有效提高法律史研究的科学性。法律史专业在国内法学院中的边缘化处境,不利于满足党的二十大报告提出的传承和发展中华优秀传统法律文化的要求。法律史研究内容、研究视角、研究方法等要素与法律实践较为脱节;同时,其研究成果的碎片化和表象化等倾向,严重影响法律史研究的科学发展及研究共同体的形成与稳固,也就难以形成能够反映中国风格与气派的学术研究成果,削弱我国法律文化在国际上的竞争力。认识新文科之于法律史研究的总体意义,并以新文科为标尺,检视当下法律史研究存在的不足之处,把新文科作为促进法律史研究法学化的重要抓手,探索其着力发展的具体路径,切实推动具有自主性的中国法律史学科体系和话语体系的形成与发展,无疑具有重要的学科价值。

新文科建设背景下应用型大学中国法律史教学改革的思考

新文科建设同课程思政的建设目标有相通之处,作为专业课教师,需要通过教学内容的设计,实现教学的育人目标。而应用型大学的培养目标决定了教学对象的特殊性,是教学过程必须考虑的因素。因此,根据新文科建设及应用型大学人才培养的需要,在法律史教学中明确教学目标,调整教学内容,丰富教学方法,对于培养德法兼备的应用型人才具有重要意义。

重读中国国际关系理论的探索与发展:一种文明互鉴的视角

新中国成立以来的国际关系理论发展受到战后全球文明交流交锋和多元共存的国际政治现实的推动。其中,文明互鉴既是理论研究发生发展的历史背景,也是实现理论知识整合的主要动力,更是开展理论创新的国际化面向。新中国国际关系理论在文明互鉴下的探索与发展呈现出一种动态、多元、辩证的前进趋势,主要体现为三个阶段:一是在建国初期、冷战大国文明博弈背景下同苏联、美国等国际关系理论间的文明激荡与文化交锋;二是改革开放后,在多元文明共存与和平发展的时代判断下,主动开展对国外理论知识的批判性引介,在融会中外的基础上提升本国理论自觉与意识系统化;三是21世纪后,积极推进中国国际关系理论创新,在新一轮的全球文明交流交锋中,凝聚以“中国学派”为代表的共同体意识,产生了面向国际学术界传播的理论范式成果,进一步增强了文化自信与理论自信。中共十八大以来,习近平外交思想对国际关系理论“中国学派”建设发挥着总领性、全面性的指导作用,围绕国际关系的重大理论问题提出了许多新的概念和命题,而文明互鉴则将在新时期继续为中国国际关系理论的进步与成长提供新的动力。
