Blockchain,artificial intelligence,and other technologies have been increasingly integrated with the law,and the construction of smart justice and Internet courts in various places has a prominent effect on court informatization.The Supreme People’s Court is currently carrying out the pilot reform of separation between complicated and simple cases in civil procedure,and legal technology will inevitably become a major means to enable the reform.In the field of electronic litigation,legal technology itself has become a goal of the reform.Regarding the trials of pilot basic courts,legal technology has been more deeply applied in many links such as trial activities and trial management,playing an essential role in improving judicial efficiency,and becoming an important way to solve judicial dilemmas such as“litigation explosion.”However,the history of modern society reminds us that we should be reasonably optimistic about the development of technology,especially in the field of justice.

An Analysis about the Influence of Culture Transfer on Legal Translation from the Perspective of Intercultural Communication

With the increasingly rapid social development,collusion and integration of different culture around the world,legal translation also becomes an exceedingly important tool in exchanges of laws.Legal translation,in essence,is a non-negligible aspect of intercultural communication,because legal translation is not only a transfer process from one language to another language,but also a study process of various legal cultures.In traditional researches about legal translation,most scholars only have a preference to pay more attention to the faithfulness and exactness of target language,but ignore the significance of cultural elements that are key limitations to the readiness of legal translation.Researchers can take advantage of culture transfer,which is a strategy to avoid misunderstandings in process of legal translation for the intention of improving the quality of legal texts.In this paper,legal translation refers to translation between English legal texts and Chinese legal texts.

With the legal globalization produced by the high-speed social and economic development of modern society,Chinese and western legal cultures has frequent exchanges and with gradually expanded range,therefore the manifestation patterns of the legal conflict have experienced a qualitative change.T his paper tries to explore the causes of the legal conflicts from the historical and cultural perspective,taking legal pluralism as the guidance,introducing the cultural turn research paradigm,and putting forw ard the principles and regulations for the resolution of cross-cultural legal conflicts,and leading the legal culture conflicts to dissolve and integrate through regulation.

Obligation Orientation and Right-Based Principle——The Difference between Chinese and Western Legal Culture Influenced by Confucianism and Christianity

As an important part of cultural and ideological progress construction,the improvement of Chinese modern legal system has become a keynote in the process of constructing the harmonious society in China.In the course of the development of Chinese legal system,transplanting from western legal culture is becoming a trend.Therefore,it is necessary to study the difference between Chinese and western legal culture and its influencing elements so as to provide a cultural basis for this transplant.As for cultural factor,Confucianism is the dominated thoughts in traditional Chinese history and Christianity occupies the same place in western culture,accordingly,their influence on the difference between Chinese and western legal culture is great.This paper discusses the difference of the obligation orientation and right-based principle between Chinese and western legal culture influenced by Confucianism and Christianity aiming at provide some important inspirations for the transplant of western legal culture in improving Chinese modern legal system.

The Two Cultures of Science: Implications for University-Industry Relationships in the U.S. Agriculture Biotechnology

Partnerships between U.S. universities and industries have existed for several decades and in recent years have become generally more varied, wider in scope, more aggressive and experimental and higher in public visibility. In addition, in the last few decades, public and private interests have advocated for government policies and laws to globally promote the commercialization of university science. This paper examines the persistence or convergence of the two cultures of science and the implications of this commercialization for university-industry relationships in agriculture biotechnology. The perceptions and values of over 200 U.S. university and industry scientists, managers and administrators who participate in or oversee research collaborations in agricultural biotechnology were analyzed. The findings revealed that the participants in these research relationships continue to perceive very distinct cultures of science and identify a wide range of concerns and disadvantages of these partnerships. Several actions were discussed to ensure that the two cultures serve complementary roles and that they maximize the public benefits from these increasing collaborations.

This paper is devoted to intercultural dialogue from the point of view of Pope Benedict XVI （pontificate between 2005 and 2013）. It presents pontifical documents, statements, and speeches dedicated to this issue as well as the conclusions resulting from them. The aim of the paper is to prove that intercultural dialogue and interreligious dialogue are within the context of a new scientific discipline--political science of religion--which deals with the issues of relations between the sphere of religion and the sphere of politics. Intercultural dialogue is tightly connected to interreligious dialogue. Interreligious and intercultural dialogue allows to create the world based on brotherhood and reconciliation. They are the foundation of the future, an effective tool to build a civilization of love and they are born out of God＇s mercy.

On the Theory of Communicative Action of Jurgen Habermas and the Reconstruction of the Legal Culture of China

Habermas is one of the Western scholars who make great contribution to the contem porary humanistic and social science. He puts forward the theory of communicative action,which,with language as the medium,aims at mutual understanding and reaching an agreement. The theory of communicative action of Haberm as has the model significance for the reconstruction of the legal culture of China. Through studying of such a theory,this paper attem pts to interpret the rationalistic philosophy of the Western legal democracy which is based on the theory of discussion,and according to the current situation of the legal culture of China,this paper puts forward that we should refer to the theory of communicative action of Haberm as in order to accelerate the socialist legislation and prom ote the im plementation of the socialist concept of ruling by law.

Construction of the "Three-integration" Rolling Development Mode in the Urban-rural Fringe from the Perspective of Thematic Business Engine : A Case Study of "Zhucheng Dinosaur Eco-city" in Shandong Province

Starting from the transformation and upgrading of traditional culture,the optimization and development of traditional industries,and the innovation of traditional models,this paper used cultural entrepreneurship to trigger the thematic business engine,and explored Zhucheng City with its unique dinosaur culture.It proposed"Three-integration"rolling development mode to build Zhucheng into a new highland of cultural entrepreneurship and create new competitiveness under the background of agricultural and rural modernization development.This paper also explored from the perspective of multi-subject collaboration of cultural entrepreneurship.Government needs to establish rolling development pilot projects and promote their application;enterprises need to play the engine role of thematic business through the mode of"getting larger to help smaller ones";the masses need to pay attention to the reaction of culture to the economy,so as to promote the wave of high-level promotion of cultural inheritance and urban-rural integration.

论计算法学的全球发展趋势

随着新文科建设的推进,计算法学正成为近年来炙手可热的新兴学科和研究范式。中国计算法学现今的问题是:对计算法学之发展脉络,尤其是在学科的研究范畴和发展路径上没有形成一致的认识。文章通过使用多种统计学方法和研究工具,系统地梳理、分析和对比全球近二十年的计算法学研究的相关文献,重现了从21世纪初至近年国内外计算法学研究阶段、科研合作、研究主题和知识结构的演进过程和差异。与国外相比,中国计算法学在不同研究范畴上可能走向分化。倡导问题导向的计算法学研究有利于梳理不同研究路径的关系,促进学科的有序发展。学界需要尝试在问题意识、研究能力和研究方法的不同维度上整合计算法学的研究路径,探索计算法学发展的中国道路。

文化强国背景下中国学术话语权评价体系的构建与提升路径探析——以中国社会科学学科为例

[目的/意义]目前在文化强国战略背景下,我国学术话语权正处在重要的发展阶段,学术话语权评价有助于促进中国学术应对新时代发展的挑战,推动中国特色学术话语权国际化和本土化,明晰未来中国学术话语权发展的总体方向与具体举措。[方法/过程]本文采用文献与网络调研、比较研究、科学计量学等方法,系统地梳理了国内外学术话语权的基本理论、实践脉络,立足于中国学术话语权国内外发展实践,基于学术主体视角,参照相关学术成果评价指标体系,并对中国社会科学学科进行了实证研究,在此基础上,进一步思考和分析了提升中国学术话语权的现实路径。[结论/发现]中国学术话语权评价的核心要素主要由学术引领力、学术竞争力、学术创新力和学术传播力4部分组成,通过实证分析发现中国社会科学学科的多数学科在国际上的地位还比较低。最后提出了提升中国学术话语权国际影响和地位可从这4个方面进行全面提升。
