Pioneering a New Realm of Human Rights Civilization in the Chinese Path to Modernization——An Overview of the Symposium on“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”

On October 14,2023,a symposium themed“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”was held in Changchun,Jilin Province,China.More than fifty experts,scholars,and researchers from national institutions and universities engaged in discussions and exchanges on human rights on the Chinese path to modernization,including the path,practice,knowledge systems,and civilization forms of human rights.This symposium played a significant role in advancing the construction of the disciplinary system,academic system,and discourse system of human rights in China.

The Path of Human Rights Development with Chinese Characteristics and the Party's Leadership Development

Driving the development of human rights in China and participating in global human rights governance are the inherent requirements for the development of human rights with Chinese characteristics.To explore a path for the development human rights with Chinese characteristics,the fundamental requirement is to push forward the development of the Party’s leadership in multiple dimensions while adhering to the Party’s leadership.Among them,the Party’s political leadership is the fundamental guarantee for the path of human rights development with Chinese characteristics to move in the right direction.The Party’s ideological leadership provides advanced guidance for the path of human rights development with Chinese characteristics.The Party’s strategic decision-making capability determines the effectiveness of the path of human rights development with Chinese characteristics.The Party’s capability of mobilizing and leading the whole of society and integrating political and social resources is a necessity for a sustainable power supply for the path of human rights development with Chinese characteristics.Establishing a path of human rights development with Chinese characteristics and further promoting respect for and protection of human rights are important actions to advance the Party’s leadership development in the New Era.

The Development Path for Human Rights with Chinese Characteristics

Like most countries in the world, China supports the ideal of human rights de- picted and advocated in the Universal Declaration of Human Rights and other international docu- ments and agrees with the idea that human rights should be universal. However, China also holds that to better realize the common goals of human rights requires that each coun- try explore and find the best and most efficient way in accordance with its own conditions. One of the reasons for the fast development of human rights in China since its reform and opening-up is that China has chosen a development path for human rights according to its own conditions. The path fits the conditions of China and therefore efficiently promotes the realization of universal human rights.

Basic Categories of the Chinese Socialist Human Rights Theory

The basic categories of the Chinese socialist human rights theory consist of four elements, namely, human rights history, human rights concepts, human rights attributes and human rights protection. The category of the human rights history includes ancient notions of human rights, classical human rights theory, Marxist human rights theory and the sinicized Marxist human rights theory. The category of human rights concepts includes the subjects, contents, forms, classification, origin and essence of human rights. The category of human rights attributes includes universality and particularity of human rights, harmony and confrontation between human rights, politicalness and a-politicalness of human rights, indivisibility between rights and duties, and conditioning of state power by human rights. The category of human rights protection includes human rights and sovereignty, human rights and democracy, human rights and the rule of law, human rights and property, human rights duty holders, and human rights education.

The Justification Logic of Human Rights in Chinese Modernization

As the fruits and symbols of human civilization, human rights are pursued by people all over the world. Respecting and protecting human rights is the basic spirit of modern civilization, so it is something inherent in the concept of modernization. Chinese modernization is socialist modernization pursued under the leadership of the Communist Party of China. It contains elements common to the modernization processes of all countries, but it is more characterized by features unique to the Chinese context. It is a new path to modernization and creates a new model for human advancement. on the road to promoting Chinese modernization, China cultivated innovative human rights jurisprudence, constructed an optimized human rights system, opened up a developmental human rights approach, established a harmonious human rights relationship, and continuously promoted the well-rounded development of the people. China created a theoretical,institutional, and practical paradigm for respecting and protecting human rights that follows the principle of universal human rights and suits the local conditions, opening up a new realm of human rights civilization of mankind. The successful promotion and expansion of Chinese modernization have justified that China has found a path of human rights development that conforms to the trend of the times and suits its national conditions. The modernization of more than 1.4 billion Chinese people, a number larger than the total population of all developed countries in the world today, and the new path of human rights development will change the basic pattern of human rights development in the world and profoundly influence the process and trend of human rights civilization of mankind.

Overview of the Symposium on Human Rights Cause in China in the New Era

The symposium on the "Progress of Human Rights Development in the New Era in China" was jointly hosted by the China Society for Human Rights Studies and the Publicity Department of the Guangdong Provincial Central Committee of the Communist Party of China and organized by Guangzhou University Institute for Human Rights in Guangzhou on 19 December 2017. Scholars and experts from more than 20 universities and institutes, as well as delegates from over 10 ministries and commissions under the State Council participated in the symposium. The symposium explored four themes: "Human Rights Connotations in Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era", "The Progress of Human Rights Development in China after the 18 th National Congress of the CPC", "The Prospective of Human Rights Development in the New Era in China", as well as "Building a Community with a Shared Future for Human Beings and the Progress of the Human Rights Development of the World". This Paper is a record of the important opinions articulated during the Symposium.

The Chinese Expression of the Right to Subsistence:The Progressive Disclosure of the Dual Dimensions

Dedicated to the independence and prosperity of the country and the happiness of the people,the Communist Party of China has continuously enriched and developed the human rights system with Chinese characteristics during a century of arduous efforts.The right to subsistence,as the primary basic human right,is expressed from dual dimensions:the international dimension and the domestic dimension.However,the current Chinese human rights discourse hasn’t paid enough attention to the international dimension of the right to subsistence,and its content at the domestic dimension needs further clarification.This not only makes it difficult to provide a sound theoretical basis and development direction for the practices of the right to subsistence but also directly affects the integrity of the human rights system with Chinese characteristics,which is not conducive to using our human rights discourse to disseminate China’s achievements and gain international recognition.Therefore,it is vital to further improve the theory construction of the dual dimensions of the right to subsistence in the human rights system with Chinese characteristics.With the country as the main form and carrier,the international dimension of the right to subsistence originates from the people’s demands emerging from the domestic level and ending at the international level.It aims to be able to stand in the international community with dignity and possess good conditions and environments at home and abroad for the people to exercise and protect their rights.The domestic dimension of the right to subsistence centers on each individual,takes development as the measurement of human rights,and looks at the initial stage of the development axis.The progress from the domestic dimension of the right to subsistence to the right to development is achieved by satisfying the underlying needs for people’s subsistence.This also reflects the progressive deepening of emerging from the inside,responding from the outside,and then moving from the outside to the inside.

中国式现代化与人类文明新形态的时代内涵

理解人类文明新形态的主要内涵、形成逻辑与重要意义,需要将其放在中国特色社会主义与社会主义初级阶段的特定语境之中,也即人类文明新形态有着特定的时代内涵。人类文明新形态源于中国式现代化的实践成就与理论升华,其产生的标志是统筹推进“五位一体”总体布局的提出,相应地“五个文明”的协调发展成为其核心以及主要表现形式。而新发展理念则从方法论与世界观的维度开创人类文明新形态并指引着其发展。在人类文明新形态的形成过程中,马克思主义中国化时代化的“两个结合”不仅构成其根脉和魂脉,而且为其发展成熟提供精神指引。在社会主义初级阶段乃至更高阶段,人类文明新形态以实现全体人民物质生活和精神生活的共同富裕以及人的全面自由发展为目标,而全体人民共同富裕彰显其先进特质并推动其发展。人类文明新形态的内涵也就借助中国式现代化、“五个文明”、新发展理念、“两个结合”与共同富裕等具有中国特色的话语表达出来,显示出其与传统社会主义文明和西方资本主义文明相比较的创新性、发展性、世界性及其使命追求。由于人类文明新形态产生于中国特色社会主义初级阶段,其发展与成熟既与中国式现代化的发展成熟同步,也是一个与之相比更长的发展过程,但在世界百年未有之大变局的时代背景下也给人类现代化与人类文明发展提供了方案与方向。

中国式现代化道路的命题一经提出,就受到国内学者的广泛关注。现有的研究主要集中在中国式现代化道路的基本内涵、生成逻辑、本质特征、价值意义和实践进路等方面。以中国知网(CNKI)数据库收录的论文为数据来源,运用相关文献计量工具,系统梳理当前学界对中国式现代化道路的研究脉络,可以发现:目前学界对中国式现代化道路问题的研究具有系统性的特点,不同学科从不同的研究视角出发,对这一主题进行了多元化的理论思考,同时,也存在基础理论有待夯实、研究内容有待深入、研究视角有待拓展等不足。因此,未来研究应加大理论创新力度,进一步完善中国式现代化道路的研究内容,为构建起立足本土、突出特色、面向世界、贯通中西的学术体系和话语体系做出应有贡献。

中国式现代化的理论价值及实现路径

试论人类文明新形态

近年来,习近平总书记多次强调人类文明新形态,要求学术界为人类文明新形态实践提供有力理论支撑。运用马克思主义社会形态学说审视人类文明新形态可以看到,习近平总书记所说的人类文明新形态本质上指的是社会主义社会文明新形态。以此为基点,辅以对苏联社会主义形态和资本主义社会形态的认识,更进一步言之,人类文明新形态即社会主义社会文明新形态主要是针对苏联社会主义形态而言的。由此来看,社会主义社会文明新形态,是以中国特色社会主义为代表的,是按照中国特色社会主义的“五位一体”来加以描述的。

中国特色社会主义人权法治思想的价值取向

人权具有多维属性,决定了人权法治的多元法律特征,表现为国内法治和国际法治、固有法治和继受法治、形式法治和实质法治、程序法治和实体法治的统一。中国特色社会主义人权法治思想的核心要义基于全面依法治国的宏大叙事背景生成,主要体现在立法、执法、司法和守法四个方面。中国特色社会主义人权法治思想在形成和发展过程中,深刻展现和反映了其独特的价值取向,始终坚持以人民为中心的主体观,优先保障生存权和发展权的内容观,促进人的全面发展的发展观和遵循以国际人权法为准则的国际人权治理观。
