Research on the Impact of Digital Transformation on the Business Performance of Commercial Banks

Nowadays,with the development of the digital economy,commercial banks are actively conducting digital transformation.Studying the impact of the digital transformation of commercial banks on their operating performance can help commercial banks form a stronger core competitiveness and promote high-quality financial development.Based on the above background,this article first describes the status and development of digital transformation and development of commercial banks,and secondly analyzes whether Chinese commercial banks’digital transformation is conducive to improving their operating performance.Thirdly,by selecting the data of the listed commercial banks in the ten years of 2012–2022,this article obtains the empirical testing of the digital transformation on different property rights.Finally,the higher the level of digitalization,the higher the digital level,the more significantly promotes the performance of commercial banks.Finally,based on the above analysis,this article puts forward feasibility opinions on commercial banks and related regulators.

Impacts of Changes in Structure of Rural Land Property Rights on Agricultural Performance

In the reform process of the rural land property rights system,the incentive mechanism of the rural land property rights system has a crucial impact on the production activities of rural economic entities.Due to the different rights structures of the property rights system in different social and economic development stages,the land rights and interests enjoyed by rural economic subjects are different,and the degree of incentives for farmers is also different.This difference in incentives affects farmers investment in agricultural production factors,which in turn affects agricultural performance.This paper analyzes the incentive impacts of the structure of rural land property rights on the changes of farmers land rights and agricultural performance since the founding of the People s Republic of China,in order to further deepen the reform of the land system,protect the rights and interests of farmers,promote the modernization of agriculture and rural areas,and explore the realization form and operation mechanism of the rural collective land system in the new era.

Usefulness of myocardial performance index for assessing right ventricular function after percutaneous closure of atrial septal defect

Objective Assessment of right ventricular function in patients with atrial septal defect (ASD) is difficult. The Doppler myocardial performance index (MPI) may provide a method of assessing function in these patients. The purposes of this study were to evaluate the right ventricular function and its changes in patients with ASD after transcatheter closure of ASD. Methods MPI, defined as the sum of isovolumic relaxation time and isovolumic contraction time derived by ejection time, was measured from tricuspid inflow and right ventricular outflow;Doppler velocity profiles recorded during routine echocardiography.Twenty nine patients (13 men, 16 women;mean age 25.28±12.69, range 6 to 57 years) were diagnosed to secundum ASD [the stretched diameters of ASD were from 9 To 36 (24.91±7.98) mm], and had a successfully placed Amplatzer septal occluder (ASO) (the sizes of ASO were from 11 to 40 mm );there were 81 sex-matched, age-matched healthy people (control group 41men, 40 women;mean age 29.02 ± 14.22, range 4 to 45 years ). MPI was measured again on 3 days and 1 month after closure of ASD. Change in the study group was assessed and compared to the control subjects with structurally normal hearts. A complete 2-dimensional and Doppler echocardiographic examination was performed in all study groups. Results 1) The isovolumic relaxation and isovolumic contraction times [respectively(77.59 ± 14.39)ms vs (60.93 ±12.94)ms, P<0.0001;(28.28 ±10.88)ms vs (23.64 ±9.01)ms, P=0.027] were prolonged, and ejection time [(260.65 ±21.86 )ms vs (271.85 ± 21.92)ms, P=0.033] was shortened in patients with ASD compared with that in control subjects, resulting in a marked increase in the MPI(0.40 ± 0.07 vs 0.31 ± 0.05, P<0.0001) from normal values;2) by Pearson's correlations, the MPI had no correlation with heart rate and blood pressure in control subjects and patients with ASD, but it correlated positively with age in patients with ASD;3) by Pearson's correlations, the MPI correlated positively with the diameter of ASD and pulmonary artery pressure;4) after transcatheter closure of ASD, the MPI decreased markedly. Conclusions 1) MPI is a conceptually new, simple, and reproducible Doppler index in patients with ASD;2) MPI is free from the effect of age, heart rate and blood pressure;(3) MPI appears to be relatively dependent on changes in the diameter of ASD and pulmonary artery pressure;4) the right ventricular function was improved after transcatheter closure of ASD.(J Geriatr Cardiol 2007;4:220-224.)

Right Ventricular Outflow Tract Septal Pacing versus Apical Pacing: A Prospective, Randomized, Single-blind 5-Years Follow-up Study of Ventricular Lead Performance and Safety

Summary： Lead placement for ventricular pacing variably impacts the physiological benefit of the pa- tient. This study evaluated the ventricular lead performance and safety of right ventricular outflow tract septal pacing in patients with bradyarrhythmia in South China over 60-month follow-up. Totally, 192 patients （108 males, and 84 females, 63-4-21 years old） with bradyarrhythmia were randomly divided into two groups. The right ventricular outflow tract septum （RVOTs） group had lead placement near the sep- tum （n=97）, while the right ventricular apex （RVA） group had a traditional apical placement （n=95）. RV septal lead positioning was achieved with a specialized stylet and confirmed using fluoroscopic projec- tion. All patients were followed up for 60 months. Follow-up assessment included stimulation threshold, R-wave sensing, lead impedance and lead complications. The time of electrode implantation in both the ROVTs and RVA groups were significantly different （4.29±0.61 vs. 2.16±0.22 min; P=0.009）. No dif- ferences were identified in threshold, impedance or R-wave sensing between the two groups at 1 st, 12th, 36th and 60th month during the follow-up period. No occurrence of electrode displacement, increased pacing threshold or inadequate sensing was found. The long-term active fixation ventricular electrode performance in RVOTs group was similar to that in RVA group. RVOTs pacing near the septum using active fixation electrodes may provide stability during long-term follow-up period.

Study on Farmers' Cognition and Willingness to Plant Trees during Collective Forest Right Reform Based on Data from Plain Areas of Henan Province

On the basis of the survey data from plain areas of Henan Province,farmers' cognition and willingness to plant trees in collective forest right reform are studied. According to statistical analysis and regression equation of binary logistic regress analysis,it is generally believed that different participants have various attitudes to the reform,with regard to if planting trees or more,reform variables have a distinct effect,as well as income variable and loaning or lending variable. At last,some advices are put forward,that is,the government should strengthen collective forest right reform,accelerate matching reform and increase policy and financial support to forestry farmers.

Performance Evaluation of Motor Insurance Companies: Panel Data Evidence from Nigeria

This paper evaluated performance of motor insurance companies in Nigeria. The objectives were to determine the following: 1) significant effects of claims settlements on motor insurance firms’ earned premium;2) differences in managerial/technological capabilities among the companies and 3) effects of policy (or time effect) on insurance firms’ output within the study period. Panel data obtained for this study comprised operational data on premium earned and direct claims settlement by these companies over a period of six (6) years. Using panel data statistical models, we found that direct claims settlement negatively affected insurance companies’ earned premium. Also, significant differences in technological and managerial capabilities were found to exist among the companies, though only one company exhibited this heterogeneity. Besides, there were no policy impacts (or time effect) on vehicle insurance firms’ output in the study period. Policy implications of the results were discussed.

民法教学中的“一体化”思维模式培养

民法作为法学教学中最重要的一门专业课之一,一直面临一个不可回避的困难,即民法下属各分支领域之间的“思维壁垒”。为突破此困难,文章以请求权,这个民法理论和实践上的双重核心概念为支点,提出以“一体化”民事法律思维培养为中心的教学理念,并以“债权”,这个民法中最复杂、最特殊、最重要的分支为例,详细论证“一体化”思维模式培养的三个教学模块,即债权请求权的分类体系、债权请求权的抗辩体系和债权请求权的后置程序。同时根据上述内容改变传统的案例教学方法,形成一套能够适应“一体化”思维模式培养要求的案例教学方法。

论合同履行请求权普通诉讼时效期间的起算时点

与对诉讼时效制度的程序法理解和实体法理解相应,普通诉讼时效期间起算客观时点的确定方法有权利被侵害与请求权可行使之别,但在各自的理论脉络下两种确定方法的实质均为权利可行使。权利被侵害的确定方法无法适用于合同履行请求权,《中华人民共和国民法典》第一百八十九条、第六百九十四条第一款和《最高人民法院关于审理民事案件适用诉讼时效制度若干问题的规定》第四条第一分句采纳了请求权可行使的确定方法。《最高人民法院关于审理民事案件适用诉讼时效制度若干问题的规定》第四条第二分句与《中华人民共和国民法典》第一百八十九条的规定相悖,属于司法解释的败笔。具有行为请求权性质的履行请求权普通诉讼时效期间自权利人主张权利时起算,但代偿请求权具有不当得利的性质,应适用不当得利债权的起算规则。继续履行请求权属于履行请求权的延续,不存在独立的诉讼时效期间。作为次请求权的损害赔偿请求权不受履行请求权诉讼时效期间的规制,存在自己独立的普通诉讼时效期间起算时点。我国民事立法关于普通诉讼时效期间起算时点的规定呈现出二元结构,体系化不足。

第三人代缴税款的逻辑证成与制度构建研究

第三人代缴税款或能化解“先税后证”形成的僵局,或是税收法定下双方合意实现交易目的的结果,在有助于财政目的实现的同时并未影响税收公平分配功能的发挥。由于税款缴纳依其性质可代为履行,第三人代缴税款可以借鉴《民法典》第524条第三人代为清偿的制度和理论,舍去“合法利益”这一构成要件,将大量的代缴税款行为纳入第三人代缴税款规制中。以“目的合适说”构建第三人代缴税款制度,代缴税款后第三人享有“求偿权”而不是“代位权”;代缴税款前后的债权性质从公法性质转为私法性质,从社会功能型转为非社会功能型债权,第三人不享有专属于税务机关的税收优先权。第三人代缴税款制度具有回应税费承担条款争议和衡平纳税人权利之功能。其应在“以纳税人为主、第三人为辅”的纳税人主体意识基础上采用“设定技术”进行税法建构。同时其在民事领域的运用应限制在一定的范围内。

用能权交易制度对城市碳排放绩效改善的影响研究

用能权交易制度作为我国实现绿色发展的一项重要制度创新,对改善城市碳排放绩效具有重要意义。本文基于2006~2022年我国281个地级市的面板数据,采用双重差分模型检验用能权交易制度对城市碳排放绩效的作用机制及其溢出效应。研究发现:(1)用能权交易制度显著降低城市碳强度和提升碳全要素生产率;(2)用能权交易制度有利于非老工业基地和资源型城市碳强度的降低,同时也有利于非老工业基地和非资源型城市碳全要素生产率的提高;(3)用能权交易制度主要通过结构效应、创新效应和监管效应等途径改善城市碳排放绩效;(4)用能权交易制度的碳排放改善作用存在显著的正向空间溢出,能够实现环境红利和社会福利相容发展。因此,稳步扩大试点政策范围,积极探索实现路径和推进区域协同是实现绿色低碳的重要保障。

我国家庭法上遗产酌给请求权人规则之构造--以法定继承制度与遗产酌给制度之严格区分为法理基础

在我国家庭法视阈内,为妥当区分法定继承制度与遗产酌给请求权制度,根据遗产酌给请求权的规范目的,遗产酌给请求权人应当被认定为“法定继承人以外的主体”。未实际继承遗产的法定继承人并非遗产酌给请求权人。不过,倘若没有实际继承遗产的法定继承人契合“依靠被继承人扶养”或者“对被继承人扶养较多”要件之规定,则其仍可借由遗产酌给请求权条款之类推适用,而取得“准寄养人遗产酌给请求权”或“准扶养人遗产酌给请求权”,继而根据具体情况分得适当遗产。此外,就未实际继承遗产的法定继承人类推适用遗产酌给请求权条款而言,应当根据不同类型的遗产酌给请求权之规范旨趣,结合未实际继承遗产的法定继承人与被继承人之间的法定扶养关系、亲属关系等因素,酌定其可以分得的遗产份额。

论生态环境损害赔偿制度的法理基础与规范构造

理解生态环境损害赔偿制度,须从环境治理体系和治理能力现代化的整体视域展开,同时,还要厘清生态环境与自然资源、生态环境损害与损害赔偿、赔偿请求权与赔偿诉权等核心概念。既有理论将自然资源国家所有权作为生态环境损害赔偿中的实体权利基础,然而,不论是公权说、私权说,还是二阶结构说、三层结构说,都不周延。因为生态环境损害赔偿制度存在二元构造,即赔偿请求权区别于赔偿诉权,赔偿请求权中基于自然资源所有权的物上请求权区别于侵害生态环境的侵权之债请求权,赔偿诉权中程序意义上的提起生态环境损害赔偿诉讼区别于实体意义上的救济自然资源所有权。这种二元构造客观上源于生态环境中单体自然资源的结构面向与整体生态功能的功能面向存在区分,其学理基础在于承继和发展了传统所有权的解释范式,其核心内容是对生态环境类的损害进行类型化。为此,该制度可从两个方面予以展开。长期而言,须仰仗制定中的生态环境法典规定生态环境损害赔偿的系列内容;当务之急,则是借助司法解释促进这些内容的适度法制化。

债权人撤销权行使的法律效果

《民法典》第542条关于债权人撤销权行使效果的规定近年来争议颇大。根据《合同编通则解释》的最新规定,撤销权行使既可致使债务人的行为自始绝对无效,也可发挥债权人得请求相对人向债务人承担返还财产等法律后果的效力。根据我国现行强制执行规则,要使撤销权的请求力发挥一种不可替代的作用,应允许行使撤销权的债权人代位受领相对人向债务人提出的给付。为与代位权制度保持适度的规范体系平衡,行使撤销权的债权人可以通过《民法典》有关抵销的规定,代为受领相对人的给付而直接实现债权。当债务人为企业法人时,债权人撤销权的行使效果应注意与《企业破产法》规定的破产管理人撤销权的衔接适用。

农民专业合作社的规范与发展——“鱼与熊掌”能否兼得?

农民专业合作社的规范与发展能否兼得?何以兼得?这对审视当下中国合作社发展路径具有重大意义。本研究基于安徽省423家国家级示范社监测数据,探讨了规范治理对经营绩效的影响,分析了何种权利安排能够实现合作社兼顾规范与发展。研究发现:第一,规范治理对合作社经营绩效具有显著正向影响,且对组织绩效的增进效应强于对社员绩效的增进效应。第二,盈余分配和民主决策规范对合作社经营绩效的影响具有异质性,相对于民主决策规范,盈余分配规范是提高合作社经营绩效的主要路径。第三,调整合作社权利安排、实现剩余控制权与索取权有效匹配,是实现合作社规范与发展兼得的关键路径,而调整决策方式、设置优先股等是实现“两权”有效匹配的可行路径。本文对重塑合作社治理机制,探寻中国合作社发展路径具有启示和借鉴意义。
