The right of minors to express their opinions in family litigations refers to minors,who have a certain degree of mental capacity and assertiveness,having the right to express their opinions on the arrangements or decisions related to themselves when the courts handle familial litigation cases involving their interests,and to request the courts hear their opinions.In essence,the right of minors to express their opinions in family litigations belongs to the basic procedural rights of minors as well as judicial beneficiary rights.As for the protection of the right of minors to express their opinions in family litigations,recognizing the status of minors as independent subjects of rights is the logical premise,the procedural guarantee for the rights of the substantive parties involved is the direct cause,and ensuring the best interests of children is the fundamental reason.In order to protect the right of minors to express their opinions in family litigations,China should standardize the mechanisms for judges to hear the opinions of minors directly,improve the mechanisms for family investigators,and establish mechanisms for representing the interests of minors. 展开更多

商标恶意维权是一种特殊的民事侵权行为,反赔是规制该行为的有效路径之一。《商标法》第五次修订草案新增恶意诉讼反赔条款,但其规定过于简单。反赔请求的前提应由商标恶意诉讼扩张至商标恶意维权。“恶意”的认定应以明显违反诚实信用... 商标恶意维权是一种特殊的民事侵权行为,反赔是规制该行为的有效路径之一。《商标法》第五次修订草案新增恶意诉讼反赔条款,但其规定过于简单。反赔请求的前提应由商标恶意诉讼扩张至商标恶意维权。“恶意”的认定应以明显违反诚实信用原则为基础,强调同时具备认识因素和目的因素,并结合具体个案中的客观事实综合判断。反赔请求的实现方式包括反诉、另行起诉和在确认不侵权之诉中提出三种路径。反赔责任范围中的商誉损害可通过无形资产评估的方式确定,合理开支应包含制止商标恶意维权所支出的必要律师费。需提高举证妨碍制度的适用率以化解反赔请求人举证难、判赔低的问题,减少法定赔偿标准的适用率并肯定惩罚性赔偿制度在打击商标恶意维权行为中的积极意义。 展开更多

文保组织能够以专业性、地缘性、公益性等显著优势在民事公益诉讼中助力文物事业扎实推进;但目前,其并不具有行使公益诉权的法定资格。鉴于文保组织提起文物保护民事公益诉讼在制度供给和实践经验上尚属空白,在参考环保组织提起环保民... 文保组织能够以专业性、地缘性、公益性等显著优势在民事公益诉讼中助力文物事业扎实推进;但目前,其并不具有行使公益诉权的法定资格。鉴于文保组织提起文物保护民事公益诉讼在制度供给和实践经验上尚属空白,在参考环保组织提起环保民事公益诉讼的经验后,发现赋予文保组织公益诉权可能会面临合法原告资格难取得、与行政机关诉权位次关系不明、行使损害赔偿请求权有争议、诉讼动力补足性措施缺失等风险。因此,构建文保组织提起文物保护民事公益诉讼制度,应放宽合法原告准入门槛、确定文保组织先于行政机关的顺位设计、允许提出文物损害赔偿诉讼请求,同时建立激励机制以鼓励社会组织行使公益诉权。 展开更多

论基于生效法律文书的个别清偿在破产程序中的撤销 被引量:1

在破产临界期内,债务人依据具有执行力的生效法律文书实施个别清偿极有可能加速债务人资不抵债的到来,难以维护债权人的整体利益,实现全体债权人平等受偿的破产法目的。对于这种实践中常见的偏颇行为撤销情形,《破产法解释二》第15条却... 在破产临界期内,债务人依据具有执行力的生效法律文书实施个别清偿极有可能加速债务人资不抵债的到来,难以维护债权人的整体利益,实现全体债权人平等受偿的破产法目的。对于这种实践中常见的偏颇行为撤销情形,《破产法解释二》第15条却采取了破产撤销权“否定说”的制度安排,该规定有利于保护当事人对生效法律文书的信赖利益,却无意中为特定债权人恶意利用诉讼、仲裁等方式“哄抢”债务人财产提供了制度温床。在破产撤销权行使受阻的情况下,有必要在程序法上为受损害的其他债权人寻找救济渠道。2019年《全国法院民商事审判工作会议纪要》第120条对于普通债权人提起第三人撤销之诉采“肯定说”,为破产领域提供了类推适用的解释论空间。基于破产撤销权与债权人撤销权原理上的相似性,应允许管理人以诉讼担当人身份提起第三人撤销之诉来对抗已为生效裁判既判力遮断的偏颇性清偿,并通过降低申请人证明标准,证明责任适当转换,加大法院依职权调查取证力度以及拓宽管理人调查取证权等手段,破解“恶意串通”要件事实证据偏在的困境。 展开更多

《民法典合同编通则解释》在债权人撤销权制度上完成了向责任说的靠拢。在功能定位上,债权人撤销权诉讼的提起及其执行的目的都在于使具备积极性的债权人能够不必依赖债务人的配合而直接从相对人处得到清偿。债权人为了实现自身权益,可... 《民法典合同编通则解释》在债权人撤销权制度上完成了向责任说的靠拢。在功能定位上,债权人撤销权诉讼的提起及其执行的目的都在于使具备积极性的债权人能够不必依赖债务人的配合而直接从相对人处得到清偿。债权人为了实现自身权益,可同时提出针对债务人的主给付之诉与针对债务人和相对人的撤销之诉、次给付之诉,形成诉的合并。债权人应选择依托主给付之诉的胜诉判决强制执行相对人应当向债务人给付的财产,并视情况提出合适的诉讼请求。债权人撤销权制度的程序设计应当以实体法上的优先主义和“相对无效”的导向为指引,厘清债权人保全相对人财产的原理,并同时关注破产程序和参与分配程序等例外情形。 展开更多

执行异议之诉作为民事诉讼中的小众类型,我国现行《诉讼费用交纳办法》并未考虑此类诉讼与其他民事诉讼的明显区别,因而尚未有专门性条款对此类案件的诉讼费用进行规定。在此情形下,不同地区相继出台了一些区域性的收费规定,但彼此差距... 执行异议之诉作为民事诉讼中的小众类型,我国现行《诉讼费用交纳办法》并未考虑此类诉讼与其他民事诉讼的明显区别,因而尚未有专门性条款对此类案件的诉讼费用进行规定。在此情形下,不同地区相继出台了一些区域性的收费规定,但彼此差距较大,在案件受理费的负担主体认定方面、是否为财产性案件的认定方面、交纳计费的基础方面、非财产执行异议之诉的收费标准方面,均处于杂陈不一的状态,一定程度上影响当事人对诉讼的选择和对司法公信的认知判断。执行异议之诉与其他民事诉讼不同,案外人因为他人的执行而被动进入诉讼,败诉方未必存在过错。执行异议之诉案件中兼有财产性和非财产类型且案件类型多样,多数标的额较大,建议明确执行异议之诉中不同类型案件的财产性和非财产性,并针对性规定不同的计费基数。同时,变败诉方承担为败诉方与真正过错方(被执行人)共同承担,并完善救济途径,以彰显倡导诚信和对诉讼权利的全面保护。 展开更多
