Rights Risks of Using Affective Computing Technology in Public Governance and Their Regulation

As the frontier of intelligent computing technology,affective computing has been used in border inspection,case investigation,crime assessment,public opinion management,traffic management and other scenarios of public governance.However,there are still public risks associated with its failure to meet the basic requirements of modern public governance,and these risks are rooted in its technical characteristics.The technical characteristics of turning emotions into signals can give rise to such problems as degrading the right to informed consent,de-governance,and undermining human dignity when applied in public governance,and consequently can lead to social rights anxiety.Additionally,the affective modeling characteristics of affective computing tend to incur the rights risks of insufficient algorithm accuracy,algorithmic discrimination,and algorithmic black boxes.To avoid these risks,it is necessary to adopt the dynamic consent model as the premise for applying affective computing in public governance,and to regulate the auxiliary application of affective computing in public governance in a hierarchical manner,to achieve a balance between the application of affective computing technology and the protection of citizens'rights and the maintenance of public ethics.

Revisiting the Spirit of the UDHR and Discussing Human Rights Development——Summary of Views from the Seminar Commemorating the 75th Anniversary of the Universal Declaration of Human Rights

On December 4,2023,the China Society for Human Rights Studies hosted a seminar in Beijing commemorating the 75^(th) Anniversary of the Universal Declaration of Human Rights.Participants discussed topics such as the significance of the Universal Declaration of Human Rights,China’s theories and practices in respecting and safeguarding human rights,the three global initiatives and global human rights governance,human rights protection in the digital age,and telling Chinese stories of human rights in the new era.The discussions led to a broad consensus and achieved positive results.

The transformation of China＇s economic and government functions

The content of China＇s economic transformation is not single, and this article argues that it includes three parts. The first is the reform of economic system, the second is the change in the pattern of economic growth, and the third is the adjustment of economic structure. Government is the leading force of China＇s economic transformation, and repeated reform of government institutions has brought about some changes to government functions. But problems are obvious that lag changes of government functions have become an obstacle in China＇s economic transformation. This article describes the historical evolution and the reality of China＇s economic transformation, and analyzes the main reasons of lag changes in government functions, and reveals that the transformation of government functions is the key for successful transformation of China＇s economy.

An Overview of Government-Market Relationships:Evolving Perceptions,Role of the Market,and Government Functions

Building a high-level socialist market economy is conducive to giving full play to the market’s decisive role in resource allocations and bringing the government into better play.Correctly handling the market and the government relationships has been a central issue in China’s economic structural reform.Giving a comprehensive review and summary of the research findings achieved by the theoretical and academic circles in China,we generalize the evolution and working mechanisms of China’s socialist market economy system,following the developing trajectory and logic of relevant literature,focusing on the three aspects of evolving perceptions,the role of the market,and the functions of the government.Based on our literature overview,we also induced and extracted the basic conclusions and evolutionary features of relevant research and made suggestions for the future direction of theoretical research regarding China’s socialist market economy.

Human Rights and Development:China's Contributions Based on a Larger Concept of Human Rights

The Western liberal view of global governance can no longer effectively address the challenges facing the world today or respond to the demands of developing countries in the fields of human rights and development.Meanwhile,the United Nations human rights and development agenda also has its limitations.Against such a backdrop,China's path of human rights development has avoided the trap of human rights confrontation and the clash of civilizations.It has set an example of complementarity and positive interaction between human rights and development by unifying collective human rights with individual human rights and integrating the universality and particularity of human rights.Xi Jinping,general secretary of the Communist Party of China(CPC)Central Committee,delivered a speech at the 37th group study session of the Political Bureau of the CPC Central Committee on China's Path of Human Rights Development.This elevated China's human rights development to a new historical height.Practice has proved that China's concept and path of human rights in the new era have not only effectively promoted the development of its human rights cause,but also contributed Chinese wisdom to the global cause of human rights and development with a larger concept of human rights.Under the framework of the concept of building a community with a shared future for mankind,the Belt and Road Initiative,and the Global Development Initiative,China has contributed to enhancing the discourse power of developing countries in human rights and building a fairer,more just,more reasonable and more inclusive system for global human rights governance.

The Criminal Governance Model of Domestic Violence and Its Legislative Improvement

Domestic violence is a serious threat to the basic human rights of family members,especially victimized women.In order to effectively prevent domestic violence,the criminal law needs to respond in an appropriate and timely manner.However,the traditional criminal governance model suffers from the problem of the lagging involvement of public power.At the same time,the public-private partnership governance model,based on the personal safety protection order system stipulated in the Anti-domestic Violence Law of the People's Republic of China,is also flawed in its institutional design and specific implementation.The criminal governance model for domestic violence should be guided by the view of positive criminal law,and the governance path should be furtheroptimized from two aspects:strengthening the foundation of the public-private cooperation governance model and deepeningthe criminal-civil interface.This will help to fully protect the legitimate rights and interests of victims of domestic violence.

Evaluation of the Functionality of the Networking of Sexual and Reproductive Health Rights Services in the Event of Gender-Based Violence in the Commune of Kpomasse in 2022

Introduction: In developing countries, gender-based violence (GBV) is a real public health problem. In Benin, GBV affects the majority of women and girls (69%). Benin has implemented strategies and set up integrated centers for the management of violence in order to reduce cases of violence and ensure the holistic management of victims. The objective of our study was to assess the functionality of the network of sexual and reproductive health rights (SRHR) in case of GBV in the commune of Kpomasse in 2022. Method: This descriptive and evaluative study was conducted from March 21 to April 11, 2022. The sampling method used was non-probabilistic. Reasoned choice and convenience were the techniques used for the different targets of the study. The functionality of the SRHR service network was assessed first by calculating scores at the structure, process and outcome levels, and then by analysis using the human rights-based approach. Results: Out of the 34 GBV victims identified, only one had received a full response and 54% of the victims had no knowledge of SRHR. The lack of knowledge about health care facilities was 41% for victims and 80% for non-victims in the community who participated in the study. In the case of gender-based violence, the community preferred to settle out of court rather than report it. The functionality of the networking of sexual and reproductive health rights services in the event of the occurrence of gender-based violence in the commune of Kpomassè is insufficient. Lack of knowledge of the roles of rights holders (DD) and duty bearers (DO) explains the insufficient functionality of networking. Conclusion: Training of SRHR service agents and community sensitization are essential to improve the functionality of SRHR service networking in the commune of Kpomasse.

The Relationship between Government Subsidies and Research & Development Investment of Chinese Agricultural Listed Companies

Based on the background of China's emerging and transitional market,government subsidies to enterprises are regarded as a " helping hand" of promoting economic structural adjustment. In this paper,using China's A-share agricultural listed companies from 2010 to 2015 as research samples,we discuss the influence of government subsidies on research and development( hereinafter referred to as R & D) investment,and the difference in the relationships between the two from the perspective of different nature of property rights. The results show that,on the whole,the increase in government subsidies does not promote the intensity of R & D investment of agricultural listed companies. And after distinguishing the nature of property rights,the results show that state-owned enterprises can get more government subsidies than private enterprises,and the increase in government subsidies boosts the increase in R & D investment in private enterprises,but there is a negative correlation between government subsidies and R & D investment of state-owned enterprises. This conclusion can broaden the research perspective of the influence factors of corporate R & D investment,and it is of practical significance to further clarify the role of government subsidies in R & D investment decisions of enterprises with different nature of property rights.

The Main Responsibility and Reinforcement Strategy of Government in Emergency Communication Management

In modern state management system,“as the provider of public services,the maker of public policies,the manager of public affairs and the executor of public power,the government has the obligation to assume the main responsibility in emergencies”(Wang,2010).China’s Constitution,Emergency Response Law of the People’s Republic of China,and other laws have clarified the legal responsibility of the government in emergency response.The degree and effect of the government’s responsibility fulfillment determine whether emergency response successes or not.The government should fully fulfill its responsibility in emergency communication and management,innovate social governance,guarantee the right to know,strengthen public opinion guidance,and improve the ability to deal with the media.

Research on the Positioning of Government Functions in China under the Background of Smart City Construction

In the process of smart city construction, Beijing, Shanghai, Shenzhen and some other cities are facing many problems, among which the most essential one is the government＇ s leading role cannot give a better play due to the constraints of the traditional government functions. Therefore, it is necessary to carry out a reasonable position for the government functions in the construction of smart city. This paper issues that the government should reflect functions in the construction of smart city, such as the planning function of top-level design and unified planning; the organizational function of providing funds and talent protection; the coordinating function of promoting multiple-subject cooperation; the controlling function of establishing technical standards and legal norms.

On the Conflict and Balance Between Anti-terrorism and Protection of Human Rights

With the increasingly serious global terrorism situation,all countries have continuously revised their anti-terrorism laws and related criminal laws,adopting legislation to restrict and derogate civil liberties,increased the punishment for terrorists,and adopted corresponding anti-terrorism measures to increase monitoring of suspicious persons.In this context,conflicts and contradictions in human rights protection and the fight against terrorism often arise.The Xinjiang uygur Autonomous Region is at the forefront of China’s anti-terrorism efforts.Facing the special situation of dealing simultaneously with the slowdown in economic growth,making difficult structural adjustments,and absorbing the effects of the previous economic stimulus policies,since 2014,the local government of Xinjiang has adopted a combination of measures on anti-terrorism and de-extremism work and achieved significant results under the correct guidance of the strategy of governance in Xinjiang proposed by the central government.The most important consideration of anti-terrorism lies in the analysis Chinese and Western human rights values,coordinate and balance the relationship between anti-terrorism and human rights protection within the existing legal framework.
