Speech at the Symposium on Study and Implementation of the Spirit of the 19^(th) CPC National Congress at the China Society for Human Rights Studies

Following the successful conclusion of the 19thCommunist Party of China National Congress,there has been a nationwide upsurge in the study and implementation of the spirit of the Congress.It was therefore both necessary and timely for the China Society for Human Rights Studies to organize a symposium on the study and implementation of the spirit of the Congress.I’d like to express my understanding of the study and implementation of the spirit of the 19th CPC National Congress from three aspects:

Human Rights NGOs and the United Nations Human Rights Council——Participation by the China Society for Human Rights Studies in the Universal Periodic Review Mechanism

Since its founding in 1993, the China Society for Human Rights Studies （CSHRS） has extensively participated inthe human rights work of the United Nations （UN） and has actively carried out international exchange and cooperation. In May 2012, the UN Human Rights Council （UNHRC） initiated the second round of country reviews on human rights.

An In-depth Interpretation of the Universal Declaration of Human Rights With the Common Values of Humanity As the Research Paradigm

Interpreting the Universal Declaration of Human Rights from political,juridical and philosophical perspectives is es-sential for promoting the guiding principles of the Declaration,build-ing consensus on human rights,and advancing human rights practice in the new historical context.To conduct an academic,systematic in-terpretation of the Declaration that conforms to the trends of the times and answers the fundamental questions of the world,it is necessary to find a new research paradigm.The common values of humanity,namely peace,development,equity,justice,democracy and freedom,put forward by Xi Jinping,general secretary of the Communist Party of China(CPC)Central Committee,provide the most explanatory and penetrating scientific paradigm for reaching the issue.This paper an-alyzes and reflects on the views,value foundation and principled(con-tractual)consensus of human rights in the Declaration,and narrates and foresees the far-reaching significance of the three global initia-tives(namely,the Global Development Initiative,the Global Security Initiative,and the Global Civilization Initiative)with the common val-ues of humanity as the soul in advancing the modernization of global human rights governance and building a new form of human rights civilization.

The Historical Position and Value Dimensions of Human Rights Civilization

Human beings are the mainstay and the ultimate goal of civilization.The history of human civilization is a continuous struggle to realize the respect,liberation,protection,and development of humanity.Human rights are an achievement of humanity and a symbol of progress,and the human rights civilization is an important component of human civilization.Understanding and interpreting human rights from the perspective of human rights civilization means that human rights are not only a concept or an idea but also a grand historical and long-term social practice.Up to now,the development of human rights civilization has roughly experienced four awakening eras:initialization,revolution,popularization,and globalization.In terms of its value dimensions,it has the characteristics of progressiveness,diversity,commonality,inclusiveness,indivisibility,openness,and so on.The historical position of human rights civilization and the development of its value dimensions have shown to the world that human rights are the common wealth of humanity,and human rights belong to all mankind;human rights are historical,concrete,and developmental;the concept of human rights is constantly evolving,and its connotations and categories are constantly expanding;achieving the free and well-rounded development of every person is the highest value realm of human rights civilization.The Chinese modernization endows Chinese civilization with modern strength and opens up new horizons for human rights civilization.The new pattern of human rights civilization to be created by Chinese modernization not only possesses the common characteristics of human rights civilization but also enjoys Chinese characteristics based on its own national conditions,enriching and developing the diversity of human rights civilization for all mankind.

Speech at the Seminar Commemorating the 75^(th)Anniversary of the Universal Declaration of Human Rights

Seventy-five years ago,when the haze of World War II was still dissipating,the pursuit of human rights and peace had long been in progress.On December 10,1948,the Universal Declaration of Human Rights(hereinafter referred to as the Declaration)came into being as the fog of war gradually gave way to sunshine.This document,which is of great significance in the history of human civilization,reaffirms the inherent dignity of all members of the human family,calls on all countries to respect human rights,and advocates pluralistic consensus to address confrontations and conflicts.

The Three Global Initiatives Contribute to the Sound Development of Global Human Rights Governance

At the 10^(th)collective study session of the Political Bureau of the CPC Central Committee held on the afternoon of November 27,2023,Xi Jinping,general secretary of the CPC Central Committee,emphasized that“China will actively participate in the reform and development of the global governance system,promote its development towards a more just and reasonable direction,use good international laws to promote global governance,and contribute to the building of a human community with a shared future.”Obviously,“global human rights governance”is an inherent part of“global governance.”

The report delivered by Xi Jinping, General Secretary of the Communist Party of China (CPC) Central Committee, to the 20th CPC National Congress laid out goals,tasks, and major policies for developing the cause of the Party and the country for the next five years and more, clarified a number of defining, fundamental and strategically significant issues and put forward a series of new ideas, strategies and measures. It is a programmatic document that guides China to build a modern socialist country in all respects and advance toward the Second Centenary Goal.

Mutual Promotion between the Chinese Dream and the Human Rights Protection in China

The Chinese Dream is not only the dream of rejuvenation of the Chinese nation,but also the dream of human rights of the Chinese people.To accurately understand the shared root and origin of the Chinese Dream and the protection of human rights in China,we must understand that the Chinese Dream provides new strategic guidance for the protection of human rights in China,and the protection of human rights in China is an important measure to promote the realization of the Chinese Dream.To realize the Chinese Dream in the new era,Chinass human rights protection must always be people-centered,and adhere to the resolution of the main social contradictions in the new era.On the basis of raising the awareness of the whole Party and society to respect and protect human rights,we should remove obstacles and barriers to human rights protection and promote the building of a community with a shared future for human beings.At the same time,the protection of human rights in China in the new era must be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era.We must adhere to the path of human rights development with Chinese characteristics,and study and solve various practical problems of human rights protection in China in the course of upholding integrity and innovation,so as to promote the realization of the Chinese Dream.Upholding the leadership of the Communist Party of China is the fundamental guarantee for realizing the Chinese Dream and protecting human rights in China.We must unswervingly follow the CPC’s lead and open up a new stage in the development of Chinas’human rights cause in the new era on the great journey to the Chinese Dream.

The Change and Constancy of “Equality Issue” in Human Rights Theory Research During the 40 Years of Reform and Opening-up

In 1978, academia broke through the theoretical forbidden zone with the slogan of "equality before the law" and initiated a great discussion on some important legal issues including legal equality. During the past 40 years since the reform and opening-up, the relevant research has changed from the ideological contention deeply influenced by class discourse to the abstract theoretical research where class discourse has been fading away, and then turn to the technical and concrete practical research. This "change" is clearly visible and, to a certain extent, reveals the track of the development of human rights theory. However, there is "constancy" in "change". "Constancy" not only lies in the study of legislative equality throughout the past 40 years, but also embodies the inherent logic of theoretical research in response to social development and changes in the times.

Building a Sustainable Environment for Human Rights Development; Earnestly Respecting and Ensuring Human Rights

Constructing an environ- ment for human rights development is a large, comprehensive project as well asa long and arduous mission. Although constructing an environment for human rights development was not mentioned much in the past, in actuality it began early and achieved sustained progress. It is a gradual process that is also a prerequisite for earnestly respecting and ensuring human rights. There are five dimensions to building a sustainable environment for human rights development.
